BACKGROUND
Shandin Hills was originally subdivided through a series of 11 tract
maps and one conditional use permit, Tracts 11320-11330, and CUP 994.
The various tract maps and conditional use permit were approved by the
Mayor and Common Council on December 8, 1980. The tracts combined
created a 2,449 unit planned residential development and a 16.1 acre
commercial/office complex, The site encompassed 367 acres located on
the north side of Shandin Hills, south of Kendall Drive, east and west
of Little Mountain Drive.
Subsequently, Tentative Tract 11323, 11324, 11326, 11328, 11329 and
11330 have been recorded, Tentative Tract 11327 is currently pending
recordation. The remaining tracts 11320, 11321, 11322 and 11325 have
expi red.
The entire development is within the boundaries of the State College
Redevelopment Project #4 which was approved by Ordinance No. 3067,
adopted April 27, 1970. The State College Redevelopment Project #4,
designates the Shandin Hills area for development with a maximum of
2,252 residential units and an associated commercial center. The ele-
ven tract maps and conditional use permit were found to be consistent
with the State College Redevelopment Project #4 at the time of their
ori gi nal approval.
At this time, the applicant has chosen to file new tract maps within
the boundaries of the recorded tract maps. The applicant has elected
to file new maps because the site plan and product types are substan-
tially different. The applicant has submitted 4 new tract maps and
one new conditional use permit for apartment development. Recorded
Tract Maps 11327, 11329, 11330 and 11323 have been refi led as ten-
tative tracts 12955, 12956, 12957, 12958 and Conditional Use Permit
No, 84-78, respectively. The above mentioned four tract mpas were
originally approved for 1271 dwelling units, The new maps submitted
to replace the earlier ones propose 873 dwelling units. The remaining
recorded tracts, which have not yet been refiled, include a total of
574 dwelling units thereby bringing the total number of units
currently planned for development at Shandin Hills to 1445. The
applicant has indicated, however, that recorded Tract 11324 will be
redesigned at a later date, going from 156 to 88 dwelling units. If
this change occurs, the total number of units at Shandin Hills will be
1358.
The subject of this staff report will be the new maps filed within the
recorded boundaries of Tract 11329 and 11330. Tentative Tract 12957
will replace Tract 11329 and Tentative Tract 12958 will replace Tract
11330. Originally, Tracts 11329 and 11330 were approved for a total
of 259 units, 99 and 160 units respectively. The new tract maps 12957
and 12958 propose a total of 169 units, 51 and 118 respectively.

TENTATIVE TRACT NO. 12957
Tentative Tract 12957 encompasses the areas established through
recorded Tract 11329 and is located southerly of Kendall Drive and
adjacent to the south boundary of the planned commercial center. The
project area wi 11 be bounded by the future extensi on of "F" Street and
40th Street. Tract 11329 contained 8.2 acres gross and 5.8 acres net
with a total of 99 condominium units planned, Development of the
tract as originally planned would have resulted in a density of 12.1
gross and 17.1 net units per acre.
The development plan will be replaced by Tentative Tract l2957 which
proposed 51 detached single-family units as a patio home type develop-
ment on 9.2 acres gross and 7.7 acres net. The resulting density will
be 5.5 dwelling units per acre gross and 6.6 dwelling units per acre
net.
The proposed density of 6.6 dwelling units per acre will be well
within the zoning designation of Planned Residential Development up to
a maximum of 18 units per acre. The proposed development will be con-
sistent with the City of San Bernardino General Plan designation of
Residenti al 8-14 units per acre. The development wi 11 also be in
compliancp. with the State College Redevelopment Project #4.
Tentative Tract 12957 will be developed as a Planned Residential
Development with 51 lots ranging in size from 4,000 square feet to
10,700 square feet, the average lot size will be 4,672 square feet. A
centrally located common open space area will be provided encompassing
97,102 square feet. The common open space area represents 28 percent
of the total project area, exceeding the San Bernardino Municipal Code
requirement of 25% open space in the PRD Zone,
The architectural design, building placement and utilization of open
space will be reviewed in a conditional use permit required prior to
issuance of bui lding permits.
None of the lots wi 11 take access from the major streets of "F" and
40th, rather the rear lot line will bound these streets, In order to
provide visual conformity, a six foot decorative wall will be required
around the perimeter of the entire Tract 12957. A private interior
circular street with driveways from 40th and "F" Street will provide
access to each i ndi vi dua 1 lot.

Tentative Tract 12958 will be located within the recorded tract boun-
daries of Tract 11330, Tract 11330 is located directly south of the
previously discussed Tract 11329, As previously approved Tract 11330
encompassed 53.7 acres gross and 29.6 acres net, Tract 11330 was
approved for development with 160 units on one lot, creating a
density of 2.9 dwelling units per acre gross and 5.4 dwelling units
per acre net.
The zoning on the subject 53 acre site was Planned Residential
Develoment with a maximum of 6 units per acre. However, to facilitate
the current proposal for single-family development of the site, the
zoning has been changed from PRD-6/U to R-1-7200, Change of Zone No,
85-6, from PRD-6/U to R-1-7200, was approved by the Mayor and Common
Council on April 1, 1985.
Tract 12958 proposes a standard single-family subdivision with 118
lots, The proposed development will result in an overall density of
2.1 dwelling units per acre gross and (net acre 48.2 acres) a net den-
sity of 2,4 dwelling units per acre. The density is low because a
large portion of land within the tract boundary is hillside area,
which will not be developed but rather utilized to transfer density
into the valley area. Tentative Tracts 12957 and 12958 are located in
the valley area in between the two hills which form Shandin Hills.
Tentative Tract 12958 will be developed in the valley up to the toes
of the slopes. Some grading will be done to accommodate the lots, but
pri mari 1 y the rear lot 1 i ne wi 11 be located at the toe or bottom of
the slope, In some locations, the lots will be located above the
streets, Slopes ranging in size from 10 to 18 feet will be located in
between lots at the side and rear lot lines.
Contour grading must be utilized to minimize the negative visual
effect of grading. If properly done, contour grading can make manfac-
tured slopes look natural,
Maintenance of these large graded slopes wi 11 be primarily the respon-
si bi 1 i ty of the i ndi vi dua 1 lot owner. Due to the importance of mai n-
taining these slope areas in good condition with planted material, it
is recommended that an accessment district be formed with the specific
responsiblity for maintenance of the slopes on the individual lots,
Without proper maintenance and handling of these slopes, a severe ero-
sion problem could arise.
The proposed density and number of units is well within the limits of
the R-1-7200 Zone and General Plan designation of Residential 4-7
dwelling units per acre. Tract 12958 is also consistent with the
State College Area Redevelopment Project #4.

The proposed parcels for single-family units will range in size from
7,200 square feet to 15,700 square feet. The average lot si ze wi 11 be
9,599 square feet. Access to the subdivision will be provided via "F"
Street and 40th Street which will lead into Shandin Drive and Canyon
Terrace Drive. These two public streets will form a loop system
throughout the development with cul-de-sacs providing access to the
i nteri or lots.
ENVIRONMENTAL ISSUES
The Environmental Review Committee recommends issuance of a Negative
Declaration for Tentative Tracts 12957 and 12958. The Committee found
that the new tracts, as proposed, pose much less of an environmental
effect than the previously approved tracts. The Committee made the
determination for a Negative Declaration after resolution of several
environmental issues through the accumulation of previously prepared
material and the submittal of additional information by the applicant.
Information which has been prepared subsequently to the original
approval of the tracts was accumulated by the applicant and submitted
to the Environmental Review Committee. These reports include: traf-
fic study; drainage; hydrology; geological and erosion studies. The
traffic study, completed for the previous tracts at a higher number of
units than currently proposed, dealt with traffic generation impacts
created by the development. The report evaluated existing circulation
systems and improvements needed to adequately accommodate the
increased traffic loads, Recommendations of the traffic study will
be utilized by the Engineering Department to establish requirements
for improvements in and around the Shandin Hills Project Area.
The Environmental Review Committee raised some additional concerns
which had not previously been resolved. A brief discussion will
follow regarding each of those areas of concern.

Substantial grading will be required to develop Shandin Hills as pro-
posed. As presented by the applicant, grading will be balanced on the
5i te, whereby di rt cut from one area wi 11 be used as fi 11 for another
area. Large quantities of dirt (1.9 million cubic yards) will be cut
from the ridge where Tracts 12956 and 12955 are being considered.
Most of the dirt will then be transported to the valley area to be
used as fill for Tracts 12957 and 12958 and additional tracts.
Tract 12955 will cut 1,900,000 cubic yardS of dirt. Tract 12956 will
cut 96,140 cubic yardS of cut and use 202,483 cubic yards of fill.

Tract 12957 will utilize 174,287 cubic yards of fill dirt and Tract
12958 will utilized 400,000 cubic yards of fill dirt. Therefore,
the 4 tract maps combined will result in the cutting of l,996,140
cubic yards of dirt and filling of 776,770 cubic feet of dirt to form
pad areas. However, 1,219,370 cubic yards of dirt will be used for
TR 11324, 11323, 11326, 11328,
Exposing and moving large quantities of dirt can cause very serious
erosion, dust, air quality and truck traffic problems. An air quality
report has been submitted to evaluate the effect of grading on local
and regional air quality caused by wind erosion of exposed surfaces,
truck traffic and long term emissions generated by vehicular traffic
at project build-out, The report estimates 1,008 tons of dust will be
generated by the grading process, The number of vehicles expected to
be utilized for grading and the total days of operation are listed
below:

The following mitigation measures are proposed to reduce air quality
impacts:
1. Grading operations will be conducted in non-Santa Ana conditions
in conformance with the proposed grading plans. City Staff will
monitor grading operations and wind conditions. The Staff will
notify the developer of severe wind conditions which may cause
excessive soil erosion, During these conditions, grading activity
may cease temporarily; however, graded slope areas will continue
to be watered,
2. All material will be retained within Phase I to achieve a balanced
grading operation of cut and fill reducing vehicle travel and
disposal of material.

3. Increased slope stabilization and compaction will reduce wind ero-
sion, The relandscaping will occur in three phases:
a, Phase 1 - During grading, graded areas will be watered and
soils compacted.
b. Phase 2 - After grading but prior to installation of a
permanent water system, graded areas including slopes, streets,
and pads will continue to be watered or temporary irrigation
system will be installed. Rye grass will be planted in pads
to decrease erosion potential.
c, Phase 3 - After grading and installation of a permanent water
system, a permanent irrigation system and plant material will
be installed and maintained on graded slope areas, A tem-
porary irrigation system will be maintained on the remaining
pads and streets until completion of buildings.
4, Following relandscaping, the overall particulate generation is
expected to be similar to existing conditions.
5. The project proposes to landscape and irrigate all graded slopes
and to rye seed or apply straw on exposed pads to revegate graded
areas, Following relandscaping, the overall particulate generation
is expected to be similar to existing conditions,
6. Truck emissions resulting from travel will be reduced through the
regrading of the site in a single period and the proximity of cut
and fill operations,
7, Particulates generated from grading and construction will be re-
duced by watering graded surfaces and planting groundcover,
8. A commercial center is planned in the project which will reduce
vehicle miles traveled.
9. To encourage transit use, bus transit and bus bays are planned on
Kendall Drive.
10. Pedestrian systems will be planned in the form of paved sidewalks
along proposed streets to reduce vehicle miles travelled.
11, Buildings will be designed to comply with Title 24 standards for
energy efficiency.
12. Structures and recreational uses may be oriented to maximize use
of solar energy,

13. Recreational facilties are planned in selected areas throughout
the project to reduce vehicle miles travelled.
14. The project is close to the California State University at San
Bernardino. In addition, the project is 1/2 mile or less from
an elementary, juni or hi gh and a hi gh school. Thi s wi 11 further
reduc~ vehicle miles travelled.
15. Street pavement will be built as soon as possible to reduce wind
wind and soil erosion,
LONG TERM IMPACTS ON AIR QUALITY
When the grading and housing construction is completed, air quality in
the region will be directly effected by motor vehicles emissions and
indirectly affected by pollutants emitted by power generation plant
which serves the project. The emission generation from motor vehicles
and power plants is summerized in the "Air Quality Report." A total
of 1358 dwelling units will create 21,094 average daily vehcile trips

SLOPE STABILITY AND EROSION
The grading report includes recommendations for slope gradiants to
further increase slope stability and decrease erosion potential.
Employment of the mitigation measures outlined for air Quality control
will also decrease erosion potential. Revised grading plans will be
submitted to the Engineering Department to reflect the redesign of
Shandin Hills. Contour grading and slopes not exceeding 2:1 should be
employed throughout the development.
SECONDARY ACCESS
The entire Shandin Hills development is within the High Fire Hazard
Area, and as such secondary access is required to serve the sub-
division, Although the only access into and out of the subject 4
tracts from three points on Kendall Drive, the Fire Department has
indicated that secondary access to serve Shandin Hills is adequate.

"Kecent and rapid development of the State University area is producing
qrowing serious impaction problems for the schools in the surrounding
area, This development as planned, will further contribute to the
impaction problems, The School District is unable at this time to
financially develop school housing to keep pace with the new housing
developments. Therefore, the District requests that an EIR be
required to study the impaction problem and mitigation options."
The San Bernardino Unified School District is currently in the process
of developing a letter of impaction to establish appropriate mitiga-
tion measures. The Environmental Review Committee, San Bernardino

1. Prior to issuance of Building Permits, a Review of Plans, appli-
cation shall be filed with the Planning Department and approved
by the Development Review Committee.
2. Prior to issuance of building permits, the property owner shall
submit to the Planning Director a recorded and executed agreement
signed by said developer and the San Bernardino Unified School
District whereby the developer agrees to provide mitigation
measures as deemed necessary by the San Bernardino Unified School
District and adopted through a letter of impaction by the Board
of Trustees.
3, An Assessment District shall be formed and legally documented
with the specific responsibility for providing perpetual main-
tenance and up-keep through landscaping methods of all slopes
within public areas and all common areas to be dedicated to the
City for greenbelt and landscape purposes.
4. Revised grading plans shall be submitted to the Engineering
Department and Planning Department showing grading methods which
will provide contour grading, slope stability and reduce soil
erosion potential.
5. The following measures shall be employed to reduce soil erosion,
increse slope stability and decrease dust generation:
A, Grading operations will be conducted in non-Santa Ana con-
ditions in conformance with the proposed grading plans. City
Staff will monitor grading operations and wind conditions.
The Staff will notify the developer of severe wind conditions
which may cause excessive soil erosion. During these con-
ditions, grading activity may cease temporarily; however,
graded slope areas will continue to be watered.
B. All materials within Phase 1 will be retained on-site to
achieve a balanced grading operation of cut and fill reducing
vehicle travel and disposal of material. Minor deviations
shall be approved by the Engineering and Planning Departments.
C. Increased slope stabilization and compaction will reduce wind
erosion. The relandscaping will occur in three phases:
a, Phase 1 - Duri ng gradi ng, graded areas wi 11 be watered and

b. Phase 2 - After grading but prior to installation of a
permanent water system, graded areas including slopes,
streets, and pads will continue to be watered or temporary
irrigation system wi 11 be installed. Rye grass wi 11 be

c. Phase 3 - After grading and installation of a permanent
water system, a permanent irrigation system and plant

reduced by watering graded surfaces and planting groundcover.
G. A commercial center is planned in the project which will reduce
vehicle miles traveled.
H, To encourage transit use, bus transit and bus bays are planned
on Kendall Drive.
1. Pedestrian systems will be planned in the form of paved
sidewalks along proposed streets to reduce vehicle miles
travelled.
J, Buildings will be designed to comply with Title 24 standards
for energy efficiency.
K. Structures and recreational uses may be oriented to maximize
use of solar energy,
L. Recreational facilties are planned in selected areas
throughout the project to reduce vehicle miles travelled.
M. The project is close to the California State University at San
Bernardino. In addition, the project is 1/2 mile or less from
an elementary, junior high and a high school. This will
further reduce vehicle miles travelled.

6. A five-foot high decorative block wall shall be constructed along
the rear lot line of all double frontage lot and at the rear lot
line of all key lots (those lots with rear lot lines which form
the side lot line of an adjacent lot). A five-foot block wall
shall be constructed at the rear of Lots 20, 21, 44, 45, 46, 47,
48, 71, 72,90,91,92,84 and 85.
7. Sewer Capacity Rights for 118 units must be purchased at the
Redeveloment Agency or Mayor's Office; or proof of purchase must
be submitted to the San Bernardino Water Department prior to
issuance of Bui 1 di ng Permits. All costs for mai n extensi on,
metered service, and any other required water facilities will be
in accordance with the rules and regulations of the Water
Department in effect at the time of application for service.
8. Tentative Tract No. 12958 shall have a minimum 50-foot greenbelt
along the perimeter when abutting natural open areas. Such areas
shall be landscaped wi th fire resistant plant that maintain soil
contiuity along the automatic irrigation system. Said design and
treatment shall be reviewed and approved by the Fire Department
and Parks and Recreation Department prior to issuance of building
permits,
9. There shall be a five-foot fire access way provided abutting each
side lot line.
10. COVENANTS, CONDITIONS AND RESTRICTIONS FOR P.R.D.
a. The Covenants, Conditions and Restrictions (CC&R's) shall be
reviewed and approved by the Planning Department prior to
final approval of the tract maps. The CC & R's shall include
liability insurance and methods of maintaining the natural
slope areas.
b. No lot or dwelling unit in the development shall be sold
unless a corporation, association, property owner's group,
or similar entity has been formed with the right to assess
all properties individually owned or jointly owned which
have any rights or interest in the use of the common natural
slope areas. Such assessment power to be sufficient to meet
the expenses of such enti ty, and wi th authori ty to control,
and the duty to maintain, all of said mutually available
features of the development. Such entity shall operate under
recorded CC&R's which shall include compulsory memberhship of
owners of lots and/or dwelling units and flexibility of
assessments to meet changing costs of maintenance, repair,

GRADING:
11. All grading shall be done in compliance with Ti tle 15 of the
Municipal Code and the requirements of the City Engineer, and
previously approved rough grading ~lan and preliminary
geotechnical investigation prepar&d by Pioneer Consultants for
Tract lo's. 11320 through 11330, and air quality analysis f
prepared by Psomas/Harrison and Associates on March, 1985.
12. The site/plot/grading plan submitted for a buil.ding permit shall

All entrances to private streets from public streets shall be
identified by a private street name sign, tex'tured pavements,
driveway approaches, or as approved by the City Engineer.
The structural section for all streets shall be designed and

DRAINAGE:
All necessary drainage and flood control measures shall be sub-

Proper facilities for disposing of spring water from known

a. The Covenants, Conditions and Restrictions (CC&R's) shall be reviewed

of maintaining the open space, recreation areas, parking areas, private
roads, and exterior of all buildings. The CC&R's shall also include
a statement that no radio frequency antenna shall be included within
the complex except for central antenna systems.

been formed with the right to assess all properties individually owned
or jointly owned which have any rights or interest in the use of the

Prior to issuance of any building permit, access rights shall be granted to

the project for all necessary City vehicles including fire, police, and
refuse disposal vehicles, and any other emergency vehicles. The documents

All refuse storage areas are to be enclosed with a decorative wall.
Location, size, type and design of wall are subject to the approval of the

.2.- LANDSCAPI NG:
a. Three copies of a master landscape plan shall be submitted to the

plan must be submitted to demonstrate that a buildable lot area is possible
and to justify the lesser depth.
Variable front building setback lines of at least 5 feet and averaging

When graded slopes occur within or between individual lots, the slope face
shall be a part of the downhill lot. Exceptions to this requirement must

Fire hydrants shall be of an approved type with two 21-inch outlets and one
4-inch outlet, per Water Department standards.
Protect the on-site fire hydrants from damage by providing suitable traffic
barriers.
An on-site fire hydrant system shall be installed to comply with the appli-
cable sections of National Fire Protection Association Standard 24.
The area around the private fire hydrant shall be designated as a no
parking zone by painting an 8-inch-wide red stripe for 15 feet in each

Submit a complete floor plan showing the "footprint" that the structure
will make. All changes of elevation must be shown from the building
finish flooring through thresholds, down corridors and walkways, through
entrances to designated parking areas. Show contour lines if level changes
exceed 6 inches.
PARKING:
a. Handicap parking spaces must be provided at a rate of 1 space per 40
regular spaces. The spaces shall be 14 feet wide or 9 feet with a
5-foot transfer/access or walkway adjoining. The handicap spaces shall

CONDITIONS FOR TENTATIVE TRACT NO. 12957
1. Prior to issuance of building permits, a Conditional Use Permit
shall be filed with the Planning Department and approved by the
Planning Commission.
2. Prior to issuance of building permits, the property owner shall
submit to the Planning Director a recorded and executed agreement
signed by said developer and the San Bernardino Unified School
District whereby the developer agrees to provide mitigation
measures as deemed necessary ~ the San Bernardino Unified School
District and adopted through a letter of impaction by the Board
of Trustees.
3. The following measures shall be employed to reduce soil erosion,
increase slope stability and decrease dust generation.
A. Grading operations will be conducted in non-Santa Ana con-
ditions in conformance with the proposed grading plans. City
Staff wi 11 moni tor gradi ng operati ons and wi nd condi ti ons.
The Staff will notify the developer of severe wind conditions
which may cause excessive soil erosion. During these con-
di ti ons, gradi ng acti vity may cease temporari ly; however,
graded slope areas will continue to be watered.
B. All material within Phase 1 will be retained on-site to
achieve a balanced grading operation of cut and fill reducing
vehicle travel and disposal of material. Minor deviations
shall be approved by the Engineering and Planning Departments.
C. Increased slope stabilization and compaction will reduce wind
erosion. The relandscaping wi 11 occur in three phases:
a. Phase 1 - During grading, graded areas wi 11 be watered and
soils compacted.
b. Phase 2 - After grading but prior to installation of a
permanent water system, graded areas including slopes,
streets, and pads wi 11 continue to be watered or temporary
i rri gati on system wi 11 be i nsta 11 ed. Rye grass wi 11 be
planted in pads to decrease erosion potential.
c. Phase 3 - After grading and installation of a permanent
water system, a permanent irrigation system and plant

will be maintained on the remaining pads and streets until
completion of buildings.

GRADING:
11. All grading shall be done in compliance with Title 15 of the.
Municipal Code and the requirements of the City Engineer, and
previously approved rough grading plan and preliminary
geotechnical investi ga ti on prepared by Pi oneer Con sul tan ts for
Tract No's. 11320 through 11330, and air Quality analysis
prepared by Psomas/Harrison and Associates on March, 1985.
12. The site/plot/grading plan submitted for a buil~ing permit shall

system within the development. Drainage facilities shall be

43. An electrical energy fee for street lights, for a period of 4B
months, shall be paid to the City Engineer prior to recordation
of the Final Map. The energy costs for the street lights within

PLANS:
46. If the project is to be developed in phases, each individual
phase shall be designed to provide maximum public safety,
convenience for public service vehicles, and proper traffic
circulation. In order to meet this requirements, the following
will be required prior to the finalization of any phase:
a. Completion of the improvement plans for the total project or
sufficient plans beyond the phase boundary to verify the
feasibility of the design to the satisfaction of the City
Engineer.
b. A plan shall be submitted for review and approval by the
Engineering Division, Fire, and Planning Departments

SEWER CAPACITY:
4B. A sewer capacity study shall be prepared by the developer and

each individual tract sewer improvement plans. Such a study

RESIDENTIAL DEVELOPMENT
1. Tentative Tract 12957 shall be in effect for a period of 24 months from the
date of approval by the Planning Commission and/or Planning Department.
However, if no development has been initiated at the end of the 24-month
time period the approval shall expire. Additional time may be approved
by the Planning Commission upon request of the applicant prior to expira-
tion of the2~-month time period. Expiration Date: May 8,1987
COVENANTS, CONDITIONS AND RESTRICTIONS FOR P.R.D.

a. The Covenants, Conditions and Restrictions (CC&R's) shall be reviewed
and approved by the P 1 anni ng Department pri or to fi na 1 approval of the
tract maps. The CC & R's shall include liability insurance and methods
of maintaining the open space, recreation areas, parking areas, private
roads, and exterior of all buildings, The CC&R's shall also include
a statement that no radio frequency antenna shall be included within
the complex except for central antenna systems.
b. No lot or dwelling unit in the development shall be sold unless a cor-
poration, association, property owner's group, or similar entity has
been formed with the right to assess all properties individually owned
or jointly owned which have any rights or interest in the use of the
common areas and common facilities in the development, such assessment
power to be sufficient to meet the expenses of such entity, and with
authority to control, and the duty to maintain, all of said mutually
available features of the development, Such entity shall operate under
recorded CC&R's which shall include compulsory membership of all
owners of lots and/or dwelling units and flexibility of assessments to
meet changing costs of maintenance, repairs, and services. Recorded
CC&R's shall permit enforcement by the City of provisions required by
the City as conditions to approval. The developer shall submit evi-
dence of compliance with this requirement to, and receive approval of,
the Commission prior to making any such sale. This condition shall not
apply to land dedicated to the City for public purposes.
c. Every owner of a dwelling unit or lot shall own as an appurtenance to
such dwelling unit or lot, either (1) an undivided interest in the com-
mon areas and facilities, or (2) a share in the corporation, or voting
membership in an association, owning the common areas and facilities.
d. Maintenance for all landscaped and open areas, including parkways,
shall be provided for in the CC&R's.

PARKING:

a. This development shall be required to ~aintain a minimum of __ parking

Prior to issuance of any building permit, access rights shall be granted to
the City for the purpose of allowing access over the private drives within
the project for all necessary City vehicles including fire, police, and
refuse disposal vehicles, and any other emergency vehicles. The documents
covering this matter shall be prepared by the owner and approved by the
Planning Department.
All refuse storage areas are to be enclosed with a decorative wall.
Location, size, type and design of wall are subject to the approval of the
Planning Department and Division of Public Services Superintendent.
Energy and noise insulation shall comply with all state and local require-

LAND SCAPI NG :
a. Three copies of a master landscape plan shall be submitted to the
Planning Department/ Park and Recreation Department for review and
approval. The plan shall include, but not be limited to, the

3) Such other alternate plants, materials and design concepts as may

All lots shall have a minimum area of square feet, a minimum depth of
feet, and a minimum width of feet, ( feet on corner lots). In
addition, each lot on a cul-de-sac or on a curved street where the side lot
lines thereof are diverging from the front to rear of the lot, shall have a
width of not less than 60 feet measured at the building setback line as
delineated on the tract map.
Where lots occur on the bulb of the Cul-de-sac, a minimum lot depth of
feet will be permitted. If the proposed depth is less than feet, a plot

The developer shall obtain Planning Department approval of the visual or

At least two different routes of ingress and egress to the area or property
entrance shall be provided by streets having a minimum paved width of 24
feet.
The names of any new streets (public or private) shall be submitted to the
Fire Department for approval.
Private fire hydrants shall be installed to protect each building located
more than 150 feet from the curb line. No fire hydrant should be within 40
feet of any exterior wall. (Uniform Fire Code 10.301c).
Fire hydrants shall be of an approved type with two 21-inch outlets and one
4-inch outlet, per Water Department standards.
Protect the on-site fire hydrants from damage by providing suitable traffic
barri ers.
An on-site fire hydrant system shall be installed to comply with the appli-
cable sections of National Fire Protection Association Standard 24.
The area around the private fire hydrant shall be designated as a no
parking zone by painting an 8-inch-wide red stripe for 15 feet in each
direction in front of the fire hydrant in such a manner that the hydrant
will not be blocked by parked vehicles. Suitable no parking signs shall be
installed.
The developer shall provide for adequate fire flow as computed by the Fire
Prevention Bureau. Fire flow shall be based on square footage, construc-
tion features, and exposure information as supplied by the developer.

Identify each gas and electric meter with the number of the unit which it
servi ces.
Fire extinguishers must be installed prior to the building being occupied.
The minimum rating for any fire extinguisher is 2A10B/C. Minimum distribu-
tion of fire extinguishers must be such that no interior part of the
building is over 75-feet travel distance from a fire extinguisher.
Submit plans for the fire protection system to the Fire Department prior to
beginning construction on the system. Work is not to commence on systems
without approved plans.
Each stairway shall be identified by signs according to the Uniform Fire
Code Stairway Numbering System, Uniform Fire Code 12, 106f and Appendix H
(applies to buildings four or more stories in height).
Standardized signs shall be installed on each landing in each stairway to
inform the user which stair landing he is on and the upper and lower ter-
mination of the stairway (Uniform Fire Code Appendix H).
Install spark arrestors on chimneys of all fireplaces. Spark arrestor
shall be constructed of metal, 19 guage minimum, with 3/8-inch to 1/2-inch
opening, and shall be entirely visible from the ground.
An approved standpipe system shall be provided as required by the Uniform
Building Code. System shall conform to National Fire Protection
Association Standard 14.
Provide an approved fire alarm system. The system must provide a mlnlmum
sound level of 10 decibles above ambient in all parts of the building.
Plans shall be submitted for approval prior to installation.
The direction of swing of the exit door at location shall be with the flow
of traffic,
Fire Department connection to (sprinkler system/standpipe system) shall be
required at curb line.

be 48 inches wide. Walks shall be of a continuing common surface - no
steps or aburpt changes of level.
