Previous Planning Commission action:
At the meeting of the Planning Commission on May 15, 1985, the
following recommendation was made:
The application for Change of Zone No. 85-11 was recommended
for approval.
The Negative Declaration for environmental review was also
recommended for approval.
Vote: 6-2, 1 absent.
Recommended motion:
To approve the responses to comments and to adopt the Negative
Declaration for environmental review which has been reviewed
and considered.
To approve, modify or reject the findings and the recommendation
of the Planning Commission and to direct the City Attorney to
prepare the necessary amendments to the Zoning Ordinance.

1. The proposal is to change the land use zoning district from
R-3-3000, Multiple-Family Residential, R-1-7200, Single-Family
Residential, and "0", Open Space to PRD-14U/Acre, Planned
Residential Development at 14 units per acre. The site is an
irregularly-shaped parcel of land consisting of approximately 13
acres located on the southeasterly side of University Parkway bet-
ween North Park Blvd. and Kendall Drive having a frontage of
approximately 240 feet on North Park Blvd. and 657 feet on Kendall
Dri ve.
2. The San Bernardino General Plan designates the site and
surrounding area to the east between Kendall Drive and North Park
Blvd. for medium density residential 8-14 units per acre,
clustered. The surrounding zoning and land use pattern west of
the site has developed with single-family residences rather than
multi-family residential as shown on the General Plan. Properties
to the south across Kendall Drive are also designated by the
General Plan for medium density residential 8-14 units per acre,
however are presently zoned and developed with single-family residences.
3. The General Plan designates the hillside property to the west
across University Parkway for Flood Control and Administrative-
Professional on the level area adjacent to the northwest corner of
Kendall Drive and University Parkway. San Bernardino State
University is located to the north across North Park Blvd.
4. The porti on of the si te that is currently desi gnated "0", Open
Space is located at the southeastern corner of North Park Blvd.
and consists approximately of 3.32 acres bisected by a San
Bernardino County Flood Control Channel. However, the Federal
Flood Hazard Insurance Map and the San Bernardino County Flood
Control Department indicate that the area currently designated
"0", Open Space is not subject to i nundati on and may be consi dered
suitable for residential development, however given the unimproved
status of the Flood Control Channel, building setbacks and some
improvements to the channel may be required upon development.
5. The portion of the site which is presently zoned R-1-7200 abuts
the same zoning designation along its westerly boundary line. The
remaining site area is zoned R-3-3000 which yields the same den-
sity as requested under the proposed PRD-14U/Acre Planned
Residential Development at 14 units per acre. Approximately .98
acres of the area currently zoned R-3-3000 will be acquired from
land located behind the existing fire station. The fire station
will remain at its current location and will be uneffected by the
ch ange of zone.

6. Given the proximity of the existing single-family residences,
development within the PRD Zone will require building height and
setback restrictions in order to insure compatibility with these
existing residences, including appropriate turn around at the ter-
minus of Ranch Road which terminates adjacent to the westerly pro-
perty line. Consideration of environmental factors will also be
required relative to noise from the abutting fire station,
building setback and limited improvement of the Flood Control
Channel, restricted access onto University Parkway and limited
access onto Kendall Drive which is a State right-of-way.
7. The applicant has agreed to waive any rights for a density bonus
above the requested 14 units per acre as stipulated in their
Development Agreement wi th the City's Redevelopment Agency for the
total acreage being obtained from the Agency. In addition, it
will be a requirement prior to the final reading of the zone
change ordinance that the property owner waive any right to a den-
sity bonus for the entire site including that area not being
obtained from the Redevelopment Agency. The waiver requirement is
based in part on the substantial increase in density on those por-
tions of the site which are currently zoned "0" and R-1-7200 which
represent a 100 percent and 43 percent increase in density
respectively.
RECOMMENDATION
The Planning Department recommends adoption of the Negative
Declaration and approval of the requested change of zone with the sti-
pu 1 ati on th at the app 1 i cant wi 11 wai ve any ri ght to a density bonus
for the entire site.

REQUEST FOR ZONE CHANGE - DAN EVANS/KEITH HARWOOD
We have been advised by Messieurs Dan Evans and Keith Harwood that they
have applied for a zone change for land located at Kendall, University
and Northpark Blvd., in the State College Project. A portion of the
property is currently zoned R3-3000 and a portion zoned open space.
In 1984, this Agency entered into escrow with Evans/Harwood for the sale
and development of a 3.32 acre site at Kendall and State College
(266-112-04). The escrow was contingent upon the developer being able to
acquire land owned by the Water Department (151-241-11) and two acres
adjacent to the fire department site referred to as the Wilk, ie parcel.
On March 7, 1985, the Community Development Commission approved, in
concept, the acquisition by the Agency of 4.67 acres of land from the
Water Department (266-112-04) and approximately .98 acres of land, behind
the fire station, from the City. A public hearing will be conducted on
May 6, 1985 to consider the sale of these two parcels to Evans/Harwood
and amend their Disposition and Development Agreement accordingly. A
copy of Exhibit "D" to the Amendment is attached for your records. You
will notice that the Developer will be required to agree that he shall
conform to R3-3000 zoning requirements, not to exceed 14 units per acre.
This Agency has no problem in the request for zone change, if said
request does not change the density beyond 14 units per acre.

OBLIGATIONS AND UNDERTAKINGS OF REDEVELOPER
Redeveloper agrees:
1. To open an escrow with First American Title Insurance
Company or some other escrow office satisfactory to Agency within
thirty (30) days and close escrow within six months from the date
of this agreementl recording of the parcel map shall be included
as part of escrow.
2. To construct at least one hundred seventy-five (175)
total apartment units on the property being acquired from the
Agency, but in no event to exceed a density of 14 units per acre.
The estimated value of the completed development is $7.5 million.
3. To file a completed application for tentative parcel map
not later than sixty (60) days after the date of this agreement,
and to vigorously pursue such parcel map to completion. All
expenses thereof shall be paid by Redeveloper.
4. To complete the construction in not more than two
phases, as follows:
Phase I: To commence construction of approximately 100
units within one hundred eighty (180) days from the close of
escrow, and complete construction within twelve (12) months
thereafter. Construction shall be deemed complete upon approval
of occupancy permits.
Phase II: To commence construction of the remaining units
of the development within one year from the completion of Phase
I, and to complete construction within nine (9) months
thereafter.

5. To waive any right to a density bonus on the total
acreage being obtained from Agency, and to file with the City of
San Bernardino a covenant running with the land waiving any
density bonus, and agreeing that density shall conform to RJ-3000
zoning requirements.
6. To landscape and maintain the area adjacent to
University Parkway as an open area as required by Section 5 of
the original agreement, and as required by the provisions of this
agreement whereunder Redeveloper accepts all duties of the City
of San Bernardino to maintain the trees, pursuant to an agreement
with the Harriet S. Munn Trust. The parties contemplate that not
all of the lOa-foot strip shall be required for landscaping or
open space, but shall be developed in accordance.with plans
approved by the City of San Bernardino.
7. To include California State University, San Bernardino,
as a reviewing party in the review of final plans for this
project.
8. On that parcel for which full payment is not being made
through escrow, to execute a first trust deed to Agency together
with a promissory note,both in from satisfactory to Agency
Counsel, securing the unpaid balance on such property.

Dear Mayor and Common Council,
The members of the Lewis Homes University Homeowners Association
are appealing the Planning Commission decision of item No. 22
on May 14, 1985. The item is for change of zone No. 85-11.
Subject property located on the southeasterly side of University
Parkway between North Park Blvd. and Kendall Drive.
We feel this zone change is inappropriate for the following
reasons:
1. Would not conform to the surrounding area.
2. Would effect our view.
3. Would effect our privacy.
4. We would not have purchased our homes if surrounding land
was zoned for apartments.
5. Schools already overcrowded.
6. Loss of value of our homes.
7. City standards of multiple family units planned for the
University area are poor in quality. Riverside and Redlands
University areas should be used as an example.
We also request this item be heard in the evening. The majority
of the local residents work during the day and would not be
able to attend a day meeting. A 7 p.m. meeting would be greatly
appreciated.
