RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH THE SAN BERNARDINO UNIFIED SCHOOL
DISTRICT RELATING TO TYPE "A" LUNCHES AND TYPE "B" SNACKS AT THE
I DELMANN HEIGHTS COMMUNITY CENTER HEAD START/PRE-SCHOOL PROGRAM.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is
7 hereby authorized and directed to execute on behalf of said City
8 I an Agreement with the San Bernardino Unified School District
relating to Type "A" lunches and Type "B" snacks at the Delmann
Heights Community Center Head Start/Pre-School program, a copy
of which is attached hereto, marked Exhibit "A" and incorporated
herein by reference as fully as though set forth at length.

FOOD SERVICE AGREEMENT
THIS AGREEMENT is entered into on this 6th day of October , 1978,
by and between the San Bernardino City Unified School District, of the State of
California, hereinafter referred to as "DISTRICT" and the City of San Bernardino,
herei nafter referred to as "CITY."
WHEREAS, DISTRICT has the capability for proViding such service; and,
WHEREAS, CITY has a present need for the d,I'1ly deHvery of lype A lunches to
CITY's Delmann Heights Head Start Center; and,
WHEREAS, DISTRICT is willing to provide such service to CITY on a cost reimburse-
ment basis;
NOW, THEREFORE, the parti es hereto agree as follows:
DISTRICT SHALL:
1. Prepare and deliver Type A lunches on or before the lunch hour each
school day, including minimum days, in accordance with the number of meals re-
quested for that day. Disposable eating utensils and napkins will also be pro-
vided daily. '
2. Be responsible for meeting the nutritional standards for Type A lunch as
set forth by the United States Department of Agriculture for the National School
Lunch Program and also for the temperature and quality of the lunches at the time
of delivery.
3. Pick up hot food transport carts.
4. Present CITY with an itemized invoice the first day of each month for
the previous month's deliveries. Type A lunches will be billed at the rate of
sixty-three cents ($0.63) each. Milk and straws are not included.
5. Assume all liability for proper use and protection of any and all surplus
commodities assigned to them by the CITY. '
6. Provide CITY with a semimonthly menu one week prior to:the beginning of
the period covered by said menu. '
7. Maintain all necessary records on the nutritional components of the
lunches and the number of lunches delivered to the CITY and make said records
available for inspection by State and Federal authorities upon request.
8. DISTRICT shall be unable to provide lunches to CITY on days when school
is not in session and food is not prepared for distribution.

CITY SHALL:
1. Request by telephone no later than 8:30 a.m. on the day of delivery an
accurate number of lunches to be delivered to CITY site. ErrOrs in count called
in shall be the responsibility of the CITY. '
2. Insure that an individual is available at the CITY's site at 11:00 a.m.
each school day to receive the requested number of lunches. '
3. Provide personnel to serve lunches, clean the serving and eating areas,
and assemble transport carts for pick up by DISTRICT at 1:30 p.m. on the same
school day.
4. Establish collection procedures which are in accordance with State and
Federal regulations relating to the overt identification of needy pupils and
keep accurate records of the'number of free, reduced price, 'paid and adult lunches
served daily.
5. Prepare all c1aim~ for reimbursement under its own agreement number, re-
ceive and approve all free and reduced price meal applications. and maintain all
necessary records to substantiate the above items.
6. Assign to DISTRICT all commodities for which the CITY ~s entitled and
the liability for use of such commodities.
7. Pay DISTRICT by the tenth of each month the full amount as presented on
the monthly itemized invoice.
8. CITY shall bear the sole responsibility to properly care for all re-
frigerated perishable food items after they have been delivered to the delivery
site by the DISTRICT until the time of ultimate consumption.
9. CITY agrees to bear the cost of any losses resulting from theft or im-
proper storage once the lunches are received or delivered to authorized CITY
personnel; the CITY assumes the responsibility to dispose of such and return no
food items. If CITY improperly orders more food than it is able to consume, it
shall not be entitled to any credit on said items from future food orders.
10. The CITY will save harmless and indemnify the DISTRICT against all
claims. demands, suits, judgments and expenses or costs of any and every kind,
insofar as it may legally do so and subject to the availability: of funds, on
account of the injury to or death of persons or loss of or damage to property
arising in any manner out of this agreement.
TERM:
This Agreement becomes effective September 26 , 1978 and will continue
until June 30, 1979, to be renewed the following school year if both parties
agree. This Agreement may be amended by mutual consent of both parties.

BE IT FURTHER RESOLVEO that Harold L. Boring, Assistant Superintendent,
AdmInistrative Services, be authorized to sign the Agreement on behalf
of the Board of Education.
