RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION NO. 10584
ENTITLED IN PART "A RESOLUTION . . . ESTABLISHING . . . EMPLOYER-EMPLOYEE
RELATIONS. . . ; AND CHANGING THE DEFINITION OF EMPLOYEE, MANAGEMENT, AND
CREATING A DEFINITION FOR MIDDLE-MANAGEMENT AND LISTING OF J08 CLASSIFICA-
TIONS.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. Resolution No. 10584, Section 3, Subsection (F) is hereby
amended to read as follows:
"(F) EMPLOYEE, MANAGEMENT - means any amployee who is in an adminis-
trative and policy-influencing position with responsiblity for formulating,
administering or managing the implementation of City policies or programs
within a major City function or rendering management advice to top-level
administrative authority, including, but not limited to, department heads,
assistant department heads, directors, and division heads."
SECTION 2. Resolution No. 10584, Section 3, is hereby amended by add-
inq thereto the following Subsection (F-l) between Subsection (F) and Sub-
section (G) to read as follows:
"(F-l) EMPLOYEE, MIDDLE-MANAGEMENT - means any employee, regardless of
job description, having authority in the interest of the City to hire, trans-
fer, suspend, layoff, recall, promote, discharge, assign, re-assign, reward,
or discipline employees, or the responsibility to assign work to and direct
them, or to adjust their grievances, or to effectively recommend any of the
foregoing, if the exercise of such authority or the making of any such rec-
ommendation is not of merely routine or clerical nature, but requires the
use of independent judgement."
SECTION 3, Resolution No. 10584 is hereby amended by adding thereto
the following Section 17.6 to read as follows:

(A) Middle-Management employees, as defined in Section 3 hereof, shall
include those general permanent employees performing the functions or
occupying the positions as listed below:

(B) Middle-Management employees are excluded from representation by
the General Employees' bargaining unit and are restricted from representing
other than middle-management employees of the City of San Bernardino on
matters within the scope of representation. U
