San Bernardino was designated a Service Delivery Area and, as such, established a Private Industry Council, called PlC, composed of 24 members appointed by the Mayor. A majority of the members werc required to represent th~private sector, and the remaining representatives were required to represent educational organizations, labor and other agencies. " From a list of recommendations supplied by the San Bernardino Area Chamber of Commerce, representing the private sector, the Mayor appointed me, representing my company and a small business, one of the first members of the PIC in 1983 and my colleagues elected me as Vice Chairman. After I announced my candidacy for Mayor of the City of San Bernardino, Mayor Holcomb wrote a letter on December 11, 1984, in which he said, ~It's unfortunate that this comes under the present political circumstances but, as you know, I find your philosophies on many important manpower and economic development issues differ from mine. For this reason, I have decided to replace' you." We have never discussed our manpower and economic development philosophies. I was obviously fired from my volunteer position on the City's Private Industry Council because I.chose to run for the office of Mayor. I believe I was illegally removed from the PIC as the State Law provides that the members of the PIC shall serve terms of not less than two years. The Federal law states that members of the PIC "may be removed for cause in accordance with procedures established by the Council". These two laws mean that I have not yet completed my two year term, and that I can only be removed from the PIC for cause, and then only in accordance with procedures established by the PIC, and not at the authoritative whim of the Mayor.
