failed to pass on a vote of 4-4, with 1 absent.

REQUEST
The applicant requests approval of a Conditional Use Permit
under authority of San Bernardino Municipal Code Section
19.78.020(18) to construct an 80 unit retirement home for
senior citizens on 2.07 acres located on the west side of
Medical Center Drive approximately 200 feet south of the
centerline of Highland Avenue in the C-3A and C-M zones.
(See Attach "I")
BACKGROUND
Conditional Use Permit 87-64 was before the Development
Review Committee on January 14, 1988. The item was continued
due to Police Department concerns regarding isolated parking
areas and the fact that the area has such high crime rates
that any persons occupying the proposed complex may be
subjected to acts of violence and other crime. The item was
continued pending revision of the site plan with regard to
parking lot locations.
On March 24, 1988, the Development Review Committee cleared
the site plan, not',;:! continued objection from the Police
Department. The plJject was concurrently reviewed by the
Environmental Review Committee, being evaluated in terms of
noise, traffic and safety. On March 31, 1988, a Negative
Oeclaration was recommended to be adopted. However, the
Police Department voted "no", citing concerns of safety and
crime.
On May 3, 1988, the item was scheduled for a properly noticed
public hearing before the Planning Commission. At that time,
staff's recommendation was for approval (see Attachment "C",
Planning Commission Staff Report). After public testimony
regarding the inability of the general area to support the
senior housing; the conversion of a former senior project
(Little Zion) to low income housing due to the inability of
the area to support the senior housing; the fact that, should
the project convert to housing for others than seniors, the
unit floor areas and parking provisions would not meet Code,
nor would a residential use be allowed in the C-3A and C-M
zones; the crime rates and vulnerability of senior citizens
to crimes; and the intrusion of a three-story structure on
surrounding single-family units; the Planning commission
voted unanimously to deny the Conditional Use Permit (see
Attachment "B" of official Planning Commission action).

On M3Y 9, 1988, Planning Commissioner Francisco Gomez
requested the Planning Commission reconsider their denial of
Conditional Use Permit 87-64. The request was scheduled for
the Planning Commission meeting of May 17, 1988. The request
to reconsider the decision was denied by a 4 to 4 vote. Mr.
Terry Crawford, the applicant, appealed the May 3, 1988
decision of the Planning Commission to the MayQr and Common
Council on May 12, 1988, citing that due to the issuance of a
Conditional Use Permit, coupled with zoning rest~ictions, the
senior complex would not convert to any other residential
use. (See Attachment .A., applicant's appeal letter)
CONCLUSION
It was concluded that due to the potential conversion to
rental stock for the general population and the inability of
the project to meet minimum standards required by Code should
that occur, and due to the potential increase of crime
related problems, the health, peace, safety and general
welfare of the Citizens of San Bernardino could be adversely
affected.

On May 3, 1988. our application for a proposed Senior Citizen Retirement
Center located 200 feet south of Highland Avenue on Medical Center Drive
in the Northwest Redevelopment Project AI''' was heard by the Planning
Commission. At that hearing. the Planning Department's Recommendation
for Approval and a Negative Declaration were denied. As the applicant,
I would like to appeal the Planning Commission's decision based on the
following information.
Apparently there is a misconception that if the project were approved.
it could become a low-cost apartment complex which the neighborhood
does not want.
However, the misconception lies in the fact that this project could never
become a low-cost apartrrent complex because of zoning. parking require-
ments and the Condition..; Use Permit issued by the City.
Congregate Care Facilities are very popular as an alternative to single
family housing in that they provide. meals, linen service. housekeeping,
a wellness p..og..am. planned activities, transpo..tation to medical appoint-
ments and shopping. 24-hour staff. emergency pull cords in every unit
and a ..ecreation building with kitchen, dining area, lib..ary, game roan.,
and a beauty/barbershop.
In closing. there is no good ..eason to change a senio.. citizen ..eti..ement
center into something else when the demand is greete.. than the supply
of this type of needed housing. In fact, nearly all of these facilities
through out the City of San Be..nardino, and indeed Southern California,
have a tenant waiting list.
I sincereiy believe that there is a need for senior citizen housing in the
City of San Bernardino and that this project would greatly benefit the
Wests ide Community.

FINDINGS OF FACT
1. Approval of the proposed conditional u.e permit is

and that adequate parking is provided in that the

by the use. Parking meets code requirements for the
project. A van pool for tenants will be provided by
management of the center.
5. That the granting of the conditional use permit will be
detrimental to the peace, health, safety and general
welfare of the citizens of San Bernardino in that the
potential for crime related problems will increase in
the area.

1. REOUEST
The applicant is requesting approval to construct a
three-story, 80 unit senior citizen retirement complex
with a centrally located recreation center. The project
is located in the C-3A, Limited General Commercial and
C-M, Commercial-Manufacturing Districts.
2. SITE LOCATIQH
The subject site is a 2.07 acre parcel located on the
west side of Medical Center Drive approximately 212 feet
south of the centerline of West Highland Avenue. The
subject site is currently vacant with native grass in
place. The site is relatively flat with no outstanding
geologic features, (see Attachment "A").

The proposed project is consistent with the Municipal
Code and is in conformance with the letters dated June
1, 1987, July 3, 1987, August 18, 1987, January 14, 1988
and February 5, 1988 from the State Office of Planning

stipulate that ....land uses proposed during the period
of the extension will be consistent with the purpose of
'the updated general plan provisions..... The project is
also consistent with the Northwest Redevelopment Project
Area Plan.
4. !::...~A. STATUS
At its regularly scheduled meeting held on March 31,
1988, the Environmental Review Committee recommended a
Negative Declaration be adopted for Conditional Use
Permit No. 87-64. The recommendation was based on an
Initial Study prepared by staff, (see Attachment "C").
Negative Declaration was advertised for a public review
and comment period from April 7, 1988 to April 21, 1988.

Staff found no prior cases on the specific site under
review.

6. ANALYSIS

The submitted site plan indicates a three-story senior
citizen retirement home of 56,145 square feet including
the recreation and laundry facilities, (see Attachment
WOW). The actual building area on the grade level is
19,970 square feet. The complex is planned for three
stories overall with the following unit breakdown:

The complex is designed to be four-sided with the
recreational/1Exndrary, a large
recreational room (approximately 1,230 square feet), a
kitchen, storage)a three-story elevator and stairs.

Under San Bernardino Municipal Code Section 19.56.090,
retirement homes must have one space for everyone and
one-half units. The plot plan meets that standard by
having 55 parking spaces, including two handicap spaces
and one compact car space. The internal circulation
shows two parking areas, one located in front of the
project near Medical Center Drive and another to the
south of the building. The front parking lot has a one
way traffic pattern with parking on both sides of the
drive aisle. This lot has 30 standard-sized parking
stalls, wit~ a small adjoining area for four standard
and one compact car spaces located to the north. The
other parking lot located on the south side of the
project, consists of 20 standard and two handicap spaces
with a turn around space. The aisle width varies from

approximately 28 feet near the security gate in front to
approximately 39 feet in the mid-portion of the lot. The
project meets redevelopment standards regarding on-site
landscaping. The size and shape of the parcel is
adequate for the project under consideration.

Noise
The City of San Bernardino Fire Station
located across Medical Center Drive, is an

the interior face of the exterior wall. This
results in an interior wall construction of two
layers of 5/8" gypsum board over 2X4 wood studs
with insulation in the cavity and 7/8" stucco on
the exterior of the wall.
The units requiring this construction include the units
bordering Medical Center Drive and one adjacent type "0"
unit and one aljacent type "A" unit at each end of the
building. All exterior faces of these units require
this construction with the exception of the west face,
(see Attachment "E"). This requirement is included in
the recommended Conditions of Approval.
Security
With the introduction of a six-foot high perimeter wall
on the north, south and west property lines, and a
three-foot high berm with a three-foot wrought iron
fence along the eastern property line, additional safety
will be provided. The parking lot location provides a
high level of safety due to sight visibility from
Medical Center Drive. In addition, electric security
gates shall be provided at both access points to the
project.

The subject site is developed to the north, south and
west. To the north of this site is an automobile repair

of the proposal is a vacant field with the City Fire
Station located south of the field. Commercial type uses
are within the immediate area; this project will
continue the general commercial type theme in that area.
Van service will be provided to the tenants by a
project-owned van. This van will provide rides to the
malls and medical appointments. A condition is attached
reflecting such. Within five miles of the project are
located medical offices, retail outlets, a hospital, the
fire station which will provide immediate emergency
response and a grocery store.
7 . COMMENTS
No comments have been received to date, with the
exception of the letter dated December 29, 1987, from
the Northwest Redevelopment. Project Area Committee
requesting City staff to attend an informational meeting
on this project, (see Attachment nEn). The CAC
anticipates taking a formal position on the project
prior to the Planning Commission hearing.
8. CONCLUSI~
The size and shape of the parcel are adequate for the
project. It meets the Municipal code requirements for
landscaping, parking and internal circulation. With the
Conditions of Approval and Standard Requirements, the
project would not be detrimental to the citizens of san
Bernardino. A Negative Declaration is proposed for the
project.

1. In the event that this approval is legally challenged,
the City will promptly notify the applicant of any claim
or action and will cooperate fully in the defense of the
matter. Once notified, the applicant agrees to defend,
indemnify, and hold harmless the city, its officers,
agents and employees from any claim, action, or
proceeding against the City of San Bernardino. The
applicant further agrees to reimburse the City for any
curt costs and attorneys' fees which the City may be
required by a court to pay as a result of such action,
but such participation shall not relieve applicant of
his obligation under this condition.

1. .-L. C.U.P. 87-64 shall be in effect for a period of 12 months
from the d~te of approval. However, if no development has been initiated at
the end of the 12-month period, the application shall expire. Additional

Lighting levels on the exterior of building is to provide a minimum of one
(1) foot candle of "maintained" illumination on the parking surface from
dusk until the termination of business each operating day.

All exterior lighting devices are to be inaccessible to common reach or
climbing shall be protected by weather and vandalism-resistant and be

cast light onto adjoining properties.

Swinging exterior glass doors, wood or metal doors with glass panels, solid
wood or metal doors shall be constructed or protected as follows:
a. Wood doors shall be of solid core construction with a minimum thickness
of 1 3/4 inches.
b. Hollow metal doors shall be constructed of a minimum equivalent to six-
teen U. S. guage steel and have sufficient reenforcement to maintain
the designed thickness of the door when any locking device is installed
such as reenforcement being able to restrict collapsing of the door
around the locking device.
c. Except when double cylinder dead bolts are utilized, any glazing uti-
lized within 40' of any door locking mechanism shall be constructed or
protected as follows: Fully tempered glass or rated burglary resistant
glazing or iron or steel grills of at least 1/8" metal with the maximum
2" mesh secured. on the inside of the glazing may be utilized or the
gl azi ng shall be covered with 1 ron or steel bars of at least 1/2" round
or 1" x 1/4" flat metal, space not more than 5" apart and secured on
the inside of the glazing.

a. A single or double door shall be equipped with a double or single
cylinder dead bolt. The bolt shall have a minimum projection of 1" and
be constructed so as to repel cutting tool attack.
b. The dead bolt shall have an embedment of at least 3/4" into the strike
receiving the projected bolt. The Cylinder shall have a cylinder
guard, a minimum of five pin tumblers and shall be connected to the
inner portion of the lock by connecting screws of at least 1/4" in
diameter. The recommendation does not apply when panic hardware is
required or an equivalent device is approved by the Building Code.
DOuble doors shall be equipped as follows:
a. The active leaf of double doors shall be equipped with metal flush
bolts having a minimum embedment of 5/8" into the head and threshho1d
of the door frame. Double doors shall have an astragal constructed of
steel, a minimum of .125" thick which will cover the opening between
the doors. This astragal shall be a minimum of 2" wide and extended a
mi ni mum of 1" beyond the edge of the door to whi ch it is attached. The
astraga1 shall be attached to the outside of the active door by means
of we 1 di ng or wi th nonremovab 1 e bolts spaced apart on not more than 10"
centers. Hinges for outswinging doors shall be equipped with nonremo-
vab1e hinge pins or a mechanical inner lock to preclude removal of the
door from the exterior by removing the hinge pins. Strike plates shall
be a mi nimum of 3t" in length and secured to the jamb wi th screws a
mi ni mum of 2t" in 1 ength.
Wi ndows :
a. All moveable windows shall be equipped with a locking device and shall
be constructed in a fashion to restrict them from being lifted out of
its track when in closed posi tion.
Garage type doors; rolling overhead, solid overhead, swinging, sliding or
accordion style.
a. The above-described doors shall conform to the following standards:
(1) Wood doors shall have panelS. a minimum of five-sixteenths (5/16)
inch in thickness with the locking hardware being attached to the
support framing.
(2) Aluminum doors shall be a minimum thickness of .0215 inches and
riveted together a minimum of eighteen (18) inches on center along
the outside seams. There shall be a full width horizontal beam
attached to the main door structure which shall meet the pi lot, or
pedestri an access, door frami ng withi n three (3) inches of the
strike area of the pilot or pedestrian access door.

with guide tracks which shall be designed so that the door cannot be

c. Doors that exceed sixteen (16) feet in wi dth shall have two (2) lock
receiving points; or, if the door does not exceed nineteen (19) feet, a
single bolt may be used if placed in the center of the door with the
locking point located either in the floor or door frame header.
d. Overhead doors shall be equipped with slide bolts which shall be
capable of utilizing padlockS with a minimum nine-thirty-seconds (9/32)
inch shackle.
(1) Slide bolt assemblies shall have a frame a minimum of .120 inches
in thickness, a bolt diameter a minimum of one-half (i) inch and
protrude at least one and one-half (Ii) inches into the receiving
guide. A bolt diameter of three-eights (3/8) inch may be used in a
residential building.
(2) Slide bolt assemblies shall be attached to the door with bolts
which are nonremovab1e from the exterior. Rivets shall not be used
to attach such assemblies.
e. Padlocks used with exterior mounted slide bolts shall have a hardel1ed
steel shackle a minimum of nine-thirty-seconds (9/32) inch in diameter
wi th hee 1 and toe 1 ocki ng and a mi ni mum five (5) pi n tumbler operati on.
The key shall be nonremovable when in an unlocked operation.
f. Doors utilizing a cylinder lock shall have a minimum five (5) pin
tumbler operation with the bolt or locking bar extending into the

1.0 INTRODUCTION
This report is provided by the City of San Bernardino as
an Initial Study for the proposed three story, SO-unit
retirement care center for the elderly located
approximately 200 feet south of Highland Avenue on the
westerly side of Medical Center Drive.
As stated in Section 15063 of the
Environmental Quality Act (CEQA)
purposes of an Initial Study are to:
1. Provide the Lead Agency with information to use as
the basis for deciding whether to prepare an EIR or
a Negative Declarationl

2.0 EXECUTIVE SUMMARY
2.1 Proposed Project
The request is for approval to construct a three
story/SO-unit retirement center for the elderly. The
project is to have a frontage of 305.89 feet on the
westerly side of Medical Center Drive. The concept
from plans submitted by the applicant include five
buildings totaling 56,145 square feet. The proposal
is for four 3-story buildings to house the elderly
with an accompanying recreation and laundry facility,
(also three stories) centrally located within the
project. Parking for the complex is to be located to
the rear (or west) of the project with one central
drive aisle and one row of parking stalls on either
side.
2.2 Project Impacts

3.0 PROJECT DESCRIPTION

4.0 ENVIRONMENTAL ASSESSMENT
4.1 Environmental Setting
The subject site is developed to the north, south and
west. To the north of the subject site is an
automobile repair facility: a mobile home park is
located to the west: while a commercial bakery is
positioned to the south. East of the proposal is a
vacant field with an accompanying fire station complex
located further south.
The subject site is zoned C-3A, Limited General
Commercial, on the northerly portion of said parcel
and C-M, Commercial Manufacturing on the southerly
section of the lot. The surrounding zoning is as
follows: to the north and west of the project is C 3A,
Limited General Commercial zoning, to the east of the
site, across Medical Center Drive is R-l, Single
Family Residential, while zoning to the south is C-M,
Commercial-Manufacturing, and R-l, Single Family
Residential.
4.2 Environmental Effects
The Environmental Impact Checklist. mentions two areas
of concern on this project. These four concerns are
presented:
Changes in absorption rates, drainage patterns, or the
rate and amount of surface runoff due to impermeable
surfaces.
The concept would cover the site with five buildings
totaling approximately 56,145 square feet; in
addition, the improved parking area would add to the
runoff. The site plan of the project does delimit a
drainage ribbon throughout the parking area to
mitigate the above impact.

The Fire Station located across Medical Center nrive
is an intermittant noise generator due to sirens being
utilized on emergency vehicles. Since the noise level
might exceed acceptable noise levels a noise study was
requested of the applicant, (see Exhibit .C.). The
recommended mitigation measures include the follo.ing
for the project:
Provide an additional layer of 5/8. gypsum board
on the interior face of the exterior wall. This
results in an interior wall construction of t.o
layers of 5/8. gypsum board over 2X4 wood studs
with insulation in the cavity and 7/8. stucco on
the exterior of the wall.
Utilize windows meeting the transmission loss
requirements as specified above.
The units requiring this construction include the
units bordering Medical Center Drive and one adjacent
type 0 unit and one adjacent type A unit at each end
of the building. All exterior faces of these. units
require this construction with the exception of the
west face. Figure I indicates the construction
affected.
Expose people to potential health/safety hazards?
With the introduction of a six foot high perimeter
wall, (and a three foot high berm, and a three foot
wrought iron fence along the eastern property line)
additional safety shall be provided for all.
An increase in traffic that is greater than the land
use designated on the General Plan? Medical Center
Drive is classified as a .Minor Arterial,. the average
daily traffic count at that point is 6,200, a number
of additional 'trips generated by the project should
not affect traffic or circulation since street
capacity is approximately 24,000 at said location.
This project will generate approxi~ately 400 more
trips, not sufficient enough to impact Medical Center
Drive.
The revised location of parking provides a higher
level of safety due to sight visibility from Medical
Center Dr lYe.. In add i tion, electr ic secur i ty gates
shall be provided at both access points to the
project.

Fire Engine Siren Acoustical Impact
Dear Terry:
This report summarizes our analysis of the acoustical impact of the fire
engine siren upon the proposed senior citizen retirement center project. The
project is located across the street from the fire station. Our analysis
investigates the resulting interior noise level when the fire engine siren is
in operation.
The interior noise level due to an exterior noise source is dependent upon
the exterior noise level produced by the source, the building construction
separating the interior space from the noise source, and the interior
acoustical environment. The exterior noise level produced by a typical
emergency siren product ranges between 98 and 110 decibels. This information
was provided by the Dunbar-Nunn Corporation which is one of San Bernardino's
primary sources of such devices. In a telephone~conversation with Eric Kohn of
Dunbar-Nunn, it was stated that the frequency spectrum of the siren was
consistent in level from 500 to 1750 hertz. This frequency spectrum ~Ias used
in the prediction of the interior noise level, and the total exterior noise
level used in the calculation was 110 decibels.
The building construction separating the exterior noise source from the
interior residential space consists of 7/8" stucco over 2" by 4" wood studs
with 3-1/2 inch batt insulation between the studs and a layer of 5/8" gypsum
board on the ins i de face of the wall. The typi ca 1 exteri or wa 11 also has a 4'
by 6' operable window. This construction was used in the calculation along
with the finish materials of the proposed bedrooms which makes up the interior
acoustical environment.

The resulting interior noise level for the proposed retirement center
bedrooms was approximately 70 decibels. In order to reduce this noise level to
the 65 decibel level required by the City of San Bernardino, it is necessary to
add another layer of gypsum board to the interior face of the exterior wall and
utilize a window with transmission loss (TL) values meeting or exceeding the
values of the table below:

Sample calculations for the resulting interior noise level are included in
the appendix of this report. Window manufacturers which provide a double
window meeting this specification include Rolleze, Inc. and California Window,
Inc.
With the above .recommendations implemented, the interior noise level
during operation of the fire siren will meet the 65 decibel criteria. These
recommendations are repeated here for clarification:
I). Provide an additional layer of 5/S" gypsum board on the interior face
of the exterior wall. This results in an interior wall construction
of 2 layers of 5/8" gypsum board over 2 x 4 wood studs with
insulation in the cavity add 7/8" stucco on the exterior of the wall.
2). Utilize windows meeting the transmission loss
requirements as specified above.
The units requiring this construction include the units bordering Medical
Center Drive and one adjacent type D unit and one adjacent type A unit at each
end of the building. All exterior faces of these units require this
construction with the exception of the west face. Figure 1 indicates the
construction affected.

The Planning Department is reviewing for possible approval a pro-
posed senior citizen Apartment Project (C.U.P. 87-64). This pro-
ject is proposed to be located on Medical Center Drive and in the
Northwest Redevelopment Project. As an advisory body to the City
and Redevelopment Agency, we reques t an oral presentation by a .
representative from your department for PAC review at our next
regular meeting.
At this time we understand that this proposed project is a three-
story, eighty unit apartment complex specifically for senior citi-
zens. The PAC would like more information in regard to this pro-
j ect, so that the Planning CODlIIIission can have at its review local
citizen input.
We want to ensure that any concerns possibly raised by Sixth Ward
interests toward this project be made hopefully first through the
PAC. W'natever concerns raised through the PAC can then be for-
warded to the Planning CODlIIIission for their deliberation as to the
flesibility of this project.

Crawford's proposal to the City to build an 80 unit, Senior Citizen
Congregate Care Facility at 21$t Medical Center Drive, San Bernar-
dino with 24 hour staffing and security provided.
We feel that such a facility is an effort to stablize and to address
the economic living conditions of our aged and low-income seniors in

We, the undersigned. are citizens of the City of San Bernardino and live
within the Wests ide Community. We want to express our support for the
proposed Senior Citizen Retirement Center located 200 feet South of High-
land Avenue on the West Side of Medical Center Drive. As our elected
representatives. we want your support for this needed facility.
I t is our understanding that this project is a Retirement Center. for active
Senior Citizens. that will provide meals. housekeeping, planned activities
211 hour staff and van transportation to medical appointments and shopping
centers. The structure is to be three stories with an elevator and large
recreation building. We welcome this project to our community.
