Recommended motion:
That the request by the Central City Company for encroachment permit to allow
construction for exterior facade enhancement of the main enterance, in accord-
ance with the on going refurbishing plan on the south side of Central City Mall
main entrance be approved in principle and the City Attorney directed to prepare
the necessary license agreement to authorize the requested encroachment.
That the request for city participation of the interior refurbishing plan in the
public areas of Central City Mall be approved as a joint effort with Central
City Mall being the lead agency and.the City funding be limO to he amount
approved in F/Y 88-89 capital improvement for ch items.

STAFF REPORT
A request was received from the Central City Company by
letter dated May 31, 1988 for an encroachment permit for the
main entrance and the exterior facade enhancement. This is
in accordance with certain agreements between Central City
Company, City of San Bernardino and the Redevelopment Agency
(Reference Central City Mall letter dated 10-4-85, subject:
-Store Front Encroachment Permit, Central City Mall- (attaCh-
ment 11) Central City Company letter dated January 22, 1981,
subject: -Encroachment Permit King's Table Restaurant,
Central City Mall, (attachment 12) Central City Company
letter dated May 31, 1988, subject -Request for Encroachment
Permit Main Entrance Area Presentation of Modernization Plan
(attachment 13). Modernization plan was presented to the
Legislative Review Committee on June 6, 1988.
The Central City Company, at the instructions of the City and
ROA, entered into an agreement dated March 13, 1986 to
diligently proceed to comply with its requirement by prepar-
ing a modernization plan of the enclosed mall, reference
Resolution No. 86-59, dated February 24, 1986.
In cooperation with the City, Central City Company has worked
toward developing a partial plan complete with engineering
and architectural drawing. This plan calls for an estimated
expenditure of Central City Company for approximately
$2,250,000.
Much more is needed to be done, including the up grading of
parking lot lighting. However, due to the large capital
cost, it must be phased over a number of years. This plan
ties to items in the city capital improvement budget as part
of the city's cooperation efforts to this project.

excitement in the downtown area, activity in the evening and

Presentation of Modernization Plan
Dear Roger:
In accordance with that certain agreement between Central City
Company, the City of San Bernardino and the Redevelopment Agency of
the City of San Bernardino dated March 13, 1986, Central City Company
has diligently proceeded to comply with its requirements by preparing
a modernization plan for the enclosed Mall.
We have over the past year, in cooperation with the city, worked
towards developing a partial modernization plan, complete with
engineered, architectural drawings and oolor boards produced at our
cost. The estimated expenditure by Central city Company to implement
the plan is $2,250,000. Much more needs to be done, including the
upgrading of the parking lot lighting, but due to the large capital
cost, must be phased over a number of years as part of an ongoing
refurbishment plan.
The first step in implementing this modernization effort is the
approval of an encroachment permit for the main entrance enhancement
and the exterior facade enhancement.
This plan ties to items that are before you in this year's capital
budget as part of the City's cooperative effort in this project.
Please note that a large portion of our expenditures will be made in
City/Redevelopment Agency areas as part of our cooperative effort.

Dear Roger:
Over the past several years I have had more than one discussion with Wayne Overstreet
regarding the possibility of bringing the Mall storefronts out flush with the front
of the columns that support the public portion of the Mall.

During the course of our discussions, we determined that there were advantages to
this concept to both the City and the merchants in the Mall that warranted
~ further exploration.
The concept is as follows:
A. Over a period of time as leases renew and remodels occur, we will require that
storefronts will be built flush with the front edge of the columns. The
storefronts are now built to our property line, which is recessed 28" behind
the columns. The signs on the storefronts will need to project 5" into the
airspace in front of the columns..
B. Advantages to the City are:
1. A reduction of maintenance in having to clean around all the columns, which
is time consuming. The cleaning could be done in a straight line, saving
time. Also, there would be an estimated 10,743 sq. ft. less of floor
area to clean, when all stores have been phased in, saving both time and
materials.
2. Improved security by el iminating "hiding" places behind the columns.
3. The Mall will have a more modern state-of-the-art look as stores are
placed into this program. The stores will be closer to customer traffic
and visible for a much greater distance down the Mall. This will result
in higher,; sal es and increased sales tax revenue, and 1 icense fees and area
tax revenue to the City.
4. An eventual, reduction of 10,743 sq. ft. of liability exposure.

C. Advantages to the Mall are:
1. A more modern looking convenient place to shop, resulting in greater
customer satisfaction.
2. Better visibility and merchandising area closer to the customer,
resulting in improved sales and greater profit to the merchant.
I believe this is a win/win situation for all concerned. Central City Company
would assume the maintenance responsibility and the liability within the encroach-
ment area and pass those on to each individual store through their lease.
I would like to start the process necessary to acquire a blanket encroachment
permit for all stores that abut the public areas of the Mall. We will acquire most
of the upper level portion of the Woolworth store shortly after the end of the
year and convert that area into 4 to 7 smaller stores.
We also have 6 stores that have leases expiring at the end of this year. In a
short period of time we could have a number of stores in the program.
Please advise me of any thoughts you may have and any further steps I should take.

King's Table Restaurant
Central city Mall
Dear Mayor and Council:
Central city Company has succeeded in attracting a major new
restaurant to the downtown area. King's Table has agreed to take
approximately 10,500 sq. ft. on the upper level of Central city Mall
near the main arcade entrance. I know that this is something that the
City has been interested in for sometime, i.e., the addition of
restaurants in the downtown area that would be open at night and
increase evening activity downtown. King's Table is an excellent
buffet style restaurant that has a national reputation. It should be
a major addition to the Mall and to the downtown area, particularly in
its draw for dinner traffic in the evening.
King's Table has indicated an interest in improving the facade
treatment on its south elevation as it faces the City parking lot.
The facade would provide mainly decorative features that would enhance
the appearance of the Mall and the appearance of the restaurant. The
facade treatment requires a minor encroachment onto the sidewalk area
for a decorative column and planter treatment, framing the windows and
doors of the restaurant. There will also be an encroachment into air
space for the entrance canopy and a decorative awning above the
windows and doors. The specific details of the encroachment are shown
on the enclosed plan. I have personally 'examined the plan and the
area of encroachment and see no interference whatsoever with Mall
traffic and no restriction of pedestrian traffic or deliveries along
the sidewalk. '
I think that this will be a good aesthetic improvement to the Mall as
well as a draw for evening trade. Of course, Central City Company and
King's Table will agree to maintain the structures that encroach upon
the City/Agency area~ for the life of the structures and would further
agree to assume the'liability for said encroachments as we have done
in the past. We would also agree to pay the City's cost of processing
this encroachment permit.

I have also enclosed for your immediate attention three copies of the
encroachment plan. We would like to complete this modernization
effort in time for the Christmas season and, therefore, must move
rapidly to begin construction. In order to meet the construction
schedule, we will need approval of an encroachment permit at the next
Council meeting.
The Council has already approved phase one of the exterior
encroachment in February of 1987 on the King's Table side of the main
entrance. Phase two will extend this decorative metal and lighting
treatment all along the main entrance facade. It will also include a
major improvement of the main entrance by popping it out and raising
it up to give a grand entry effect. The approval of the phase two
encroachment permit is the important first step to the commencement of
the modernization plan.
I am hoping to be able to meet with and brief with each Counci1person
regarding this project prior to the Council meeting. Please call me
