Synopsis of Previous Council action:
10/13/83 -- Resolution No. 83-333 adopted noticing a public hearing for the
formation of an underground utility district in the Government Center
area, and setting the date of November 7, 1983 for said hearing.
11/07/83 -- Resolution No. 83-361 adopted, creating Underground Utility District
No.9, between 3rd street and 5th street and between Arrowhead Avenue
and Sierra Way.
04/04/88 -- Resolution No. 88-102 adopted for Underground Utility District No.
13, contained an assessment for the assessment roll for Underground
Utility District No.9.
05/02/88 -- Public hearing was closed. Assessment # 1 was agreed upon to be
reduced to 1/2 of the original assessment.

STAFF REPORT
The Government Center Area Underground Utility District No.9, was established by
Resolution No. 63-361, adopted on November 7, 1963, as authorized under Chapter
13.36, "Underground Utilities", of the San Bernardino Municipal Code. This
resolution stated that the undergrounding was to be completed by May 1, 1964.
Edison had conduits and vaults installed to replace their aerial facilities. This
work included stubbing out a conduit to each parcel. Each property owner is
responsible for conversion of the electrical service from aerial to underground,
and extending a conduit to join the one stubbed out by Edison.
Property owners within the district were notified by the following transmittals,
as provided in Sub-section 13.36.090, of the need to convert their services:
1. Letter dated October 16, 1963, with copy of Resolution No. 63-333,
giving notice of the public hearing.
2. Letter dated June 20, 1965, giving notice to convert by
1966.

The majority of the property owners had the work done. However, it was necessary
for the City to have the work accomplished for those parcels which owners had
failed to do.
On April 4, 1968, Resolution No. 88-102 was adopted, confirming the assessment
roll for Underground Utility District No. 13. Assessment No. 32 of that roll, was
not actually in that district and should have gone on assessment roll for
Underground Utility District No.9, which is hereby attached as Exhibit "A" of
the attached resolution.

WHEREAS, pursuant to the provisions of Chapter 13.36 of the Son
5 Bernar'dino Municipal Code, the Mayor and Co.on Council of the City of San
6 Bernardino did adopt Resolution No. 83-361 on the 8th day of November, 1983,
7 creating Undergound Utility District No.9, generally located between 3rd
8 street and 5th street and between Arrowhead Avenue and Sierra Way, and
9 ordered t.he construction of underground facilities b~ owners of certain
10 properties within said Under'gound Uti lity District No.9. which said
11 construction W')S to be completr~d by May 1, 1984, and which date was extended
12 to July 21, 1986.
13 WHEREAS, the said construction was not cornplf.'ied by said date and the
14 Director of Public Works/City Engineer caused said work to be done.
15 WHEREAS, an assessment roll has been prepared, totaling $362,50, which
16 ,,>is torth the indhidual assessments to be levied on each of the parcels of
17 land lying within said Underground Utility District No. 9.

NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COHMON COUNCIL Of 'l1lE
CTTY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That th,. Mayor and Common Counci 1 do herehy find and

within Undr,rground Utility District No.9, designated as Exhibit. "A" and

SECTION 3. That pursuant to Chapter 13.36 of the San Bernardino
Municipal Code, the Director of Publ ic Works/City Engineer is directed to
canse a copy of this Resolution and a list of the unpaid assessments to be
tnillsmitted to the office of the Auditor-Controller for the County of San
Bernar-dino with the request that the individual assessments be placed on the
subject property tax bills for collection together with all other property
taxes.
