Resolution No. 88-140 of the Mayor and CamDn Council

ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING CHAPTER 3.26
TO THE 'SAN BERNARDINO MUNICIPAL CODE TO ESTABLISH A TRAFFIC
SYSTEMS FUND AND TO IMPOSE A TRAFFIC SYSTEMS FEE.
SECTION 1. RECITALS. WHEREAS, because of new
development and the change in use of existing development, there
exists a need in the City of San Bernardino for additional
traffic control devices, traffic related improvements and
upgrades of the existing transportation system, and
WHEREAS, the new systems and improvements to meet s'uch
needs are set forth in the Five Year Capital Improvement
Plan, the Regional Transportation Improvement Program (RTIP),
and the State Transportation Improvement Program (STIP), and,
\~IEREAS, the Public Works Department has completed a study
supporting the need for such additional 'transportation systems,
traffic control devices and traffic system improvements and
determining the cost thereof, and
WHEREAS, this need is created by: growth throughout the
City, increases in vehicle loading of the existing systems,
and a public demand for safer, more effective transportation
network~,
NOW, THEREFORE, the Mayor and Common Council do ordain
as follows:
SECTION 2. Chapter 3.26 is added to the San Bernardino
Municipal Code to read as follows:
3.26.010. All public streets and highways under
jurisdiction of the City of San Bernardino and all traffic
control devices thereon are hereby declared to be a single
transportation network. This includes all dedicated streets

either existing or planned.
3.26.020 Fund Established
A Traffic Systems Fund is hereby established. The
Traffic Systems Fund is a fund for payment of the actual or
estimated costs of the design, upgrading or improvement of
the traffic network.
3.26.030 Traffic Systems Fee
A. There is hereby imposed a Traffic Systems Fee on all
new development and any substantial improvement, which results
in a net increase in the number of vehicle trips generated by
a development as determined by a traffic study or by average
trip estimates as published in the "Trip Generation", An
Information Report (Current Edition) of the Institute of
Transportation Engineers and accepted by the Director of Public
Works/City Engineer. The amount of said fee shall be as
established by Resolution of the Mayor and Common Council;
however, in no event shall such fee exceed the pro-rata share
of such development for the cost of any traffic system
improvements to which such fee shall be applied. All Traffic
Systems Fees collected shall be deposited in the Traffic
Systems Fund.

B. The number of vehicle trips shall be calculated based ~

on the total square foot area of the development or
substantial improvement in accordance with the average trip
rate as contained in the publication "Trip Generation"
(Current Edition) An Information Report, as prepared by the
Institute of Transportation Engineers.

C. Capture rates or reductions in the number of trips
shall not be applied towards a reduction in the Traffic Systems
Fee to be paid.
3.26.040 Disposition of Funds
A. All monies in the Traffic Systems Fund not immediately
required for construction of traffic system improvements shall
be invested in a manner provided by law of the State of
California, and all interest paid on such investment shall
accrue to said fund. These monies shall thereafter be
accounted for as required by California Government Code
Section 66001 subsections (c) (d) and (e).

STAFF REPORT
Many agencies throughout California have established a fee
to help mitigate the impact of additional traffic from new develop-
ments. The City of San Bernardino has experienced significant in-
creases in traffic volumes as a result of development activity,
with reductions in level of service provided on our streets.

The proposed Traffic Systems Fee, of $12.00 per trip, will
be used to finance the cost of new traffic control devices through-
out the City, since the traffic generated by a development impacts
the entire City, and beyond. Also, up to 50% of the fees collected
may be used to cover the costs incurred by the Traffic Engineering
personnel in reviewing plans, traffic studies, and other activities
in connection with new developments.
While payment of fees can be considered a mitigation
measure, the proposed fee is to be considered as alleviation for
the additional traffic throughout the City. Therefore, develop-
ments will generally have to mitigate identified environmental
impacts within the proximity of their sites, in addition to paying
the Traffic Systems Fee.
About 10 trips are generated each day by a single family
residence, which means that the Traffic Systems Fee would be $120
per house. We estimate that the amount collected per year would
be about $300,000.
The Ways and Means Committee during review of the proposed
fee and in consideration of objections raised by the development
community, recommended that traffic systems fees be credited to
the cost of traffic related improvements, to the initial developer,
for commercial and industrial developments. This recommendation
is included in the text of the ordinance and resolution.
It is envisioned that the Traffic System Fee would be
collected at time of issuance of the building permit, by the
Building and Safety Department. The number of trips to be generated
by the development will be determined by our Traffic Engineer, based
upon standard generation rates or in approved Traffic Studies.
We recommend that the Traffic Systems Fee be approved.

1. COLTON STORM DRAINAGE PROBLEM - The Committee recom-
mended acceptance of the proposed joint Colton - San Bernar-
dino storm drainage solution of Phase I, Mill Street problem.
The attached recommendations were reached after considerable
discussion regarding liability and the options available.
Colton representatives agreed to .upfront. engineering costs
recognizing that San Bernardino has not included this project
in the budget. uppermost in the recommendation was consider-
ation for the safety and welfare of the citizens in the Phase
I area.
2. TRAFFIC SYSTEMS FEE - $12 PER TRIP, GENERATED BY NEW
DEVELOPMENT OR REDEVELOPMENT The Committee recommended
approval of the resolution establishing a Fee and Traffic
Systems Fund. They also recommended a public hearing be set
for March 21 and asked that the Deputy City Administrator for
Development send a letter attaching the resolution and asking
for comment from the Building Industry Association. The Com-
mittee asked staff to .fine tune. the resolution specifying
what the fee would be used for in keeping with the intent of
AB600.

WAYS & MEANS COMMITTEE RECOMMENDATIONS
The Ways & Means Committee hereby makes the following
recommendation to the Mayor and Common Council regarding the
joint Colton and San Bernardino drainage problem. It is hereby
recommended with respect to the drainage problem occurring
within the area indicated in Exhibit -A- as Phase I-Mill Street
attached hereto and made a part hereof, that the following
actions be taken:
1. That the City of San Bernardino agree to pay not more
than $211,000 over a two-year period to correct said
problem.
2. Such payment shall be made only upon the condition that
the duly authorized representatives of the City of Colton
agree to hold the City of San Bernardino harmless and
indemnify and agree to defend the City of San Bernardino
from any and all claims presently existing, or which may
hereafter arise as to this drainage problem.
3. This agreement shall not be construed as and does not in
fact constitute an admission of liability on the part of
the City of San Bernardino or any of its officers or
employers.

4. The remaining drainage problems contained in Project
'3-6 are determined to be regional and beyond the
jurisdiction of the two cities to resolve.
