The Council at their October 5, 1987 meeting adopted Resolu-
tion No. 87-360 authorizing the execution of an agreement
with Yohko Kobayashi-Arnett relating to the lease of ten (10)
spaces in this downtown parking lot. This request is to
amend the parking agreement in order to lease a total of
fourteen (14) spaces.
The Parking Place Commission previously adopted a policy
guideline which authorized the lease of parking spaces in the
downtown parking district lots to businesses located in the
district, provided that they keep current all special assess-
ments and business licenses, etc. This policy was adopted in
order to accommodate the parking needs of building tenants
within the downtown area. The Commission has determined that
approval of the request would be consistent with this policy
and recommend approval by the Mayor and Common Council for
the following consideration and conditions.
Under the terms of the agreement, the lessee will pay the
City (downtown parking district) the sum of $22.34 per month,
per space, semi-annually, in advance, and this sum will be
adjusted annually based on changes in the Los Angeles/Long
Beach consumer price index limited to a maximum of 10%
annually, upon acceptance of this agreement. The city or
lessee could terminate the agreement without cause upon a
thirty (30) calendar days written notice from either party.
Maintenance and security would be provided at the same time
and manner as all other parking areas owned by the City in
the same general area.
Adoption of the resolution is recommended.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH YOHKO KOBAYASHI-ARNETT AMENDING
THE LEASE OF PARKING@ACES IN DOWNTOWN PARKING DISTRICT LOT #3
TO ADD FOUR ADDITIONAL SPACES THERETO.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is
hereby authorized and directed to execute for and on behalf of
said City a First Amendment to the Parking Agreement (Downtown
Parking District Lot #3) with Yohko Kobayashi-Arnett as approved
by Resolution No. 87-360, a copy of which is attached hereto as
Exhibit "A" and incorporated herein by this reference as though
fully set forth at length.

FIRST AMENDMENT TO LEASE AGREEMENT (DOWNTOWN PARKING
DISTRICT LOT #3) WITH YOHKO KOBAYASHI-ARNETT
1) This First Amehdment to Lease Agreement is entered into
by and between the City of San Bernardino, a municipal corporatio
("City"), and Yohko Kobayashi-Arnett, an individual (referred to
as "Lessee") and amends that Lease Agreement between the parties
as approved by Resolution Number 87-360 of the City of San
Bernardino, in the following respects only:
A. Paragraph lIB) of the Agreement is
amended to read: Lessee has requested the
designation of fourteen (14) spaces in
Parking District Lot #3 for use by employees,
tenants and invitees of the owners of the
Beckwith Building.
B. Section 3, commencing at page 3 of
the Lease Agreement, is amended to read:
City agrees to assign and allocate fourteen
(14) spaces located in Parking Lot #3 for use
by officers, employees, tenants and invitees
of the Beckwith Building. The designated spaces
are illustrated on Exhibit "I - Amendment #1"
incorporated herein by reference.
2) In all other respects, the Lease Agreement between
the City and Lessee shall continue in full force and effect.
