CITY OF SAN BERNODINO - REQUEST FeJ' COUNCIL ACTION
STAFF REPORT
Hear protests, if any, and adopt the Resolution Ordering the Engineer to
proceed under the 1913 Act for street construction. in the Central City
South Area.
This action is the result of a request of the Redevelopment Agency to
establ i sh an assessment di stri ct for the 1 mprovement of the Central Cl ty
South area and of many meetings with City Staff, Redevelopment Agency
staff, the Assessment Engineer, Bond Counsel, Underwriter and property
owners.
On May 3, 1988, the Resolution of Intention was passed, which set up the
protest hearing date of June 6, 1988. As required by Chapter 12.90 of
the Municipal Code, the portions of the streets within the proposed
district were posted by the Real Property Section on May 9, 1988; a
notice of improvement was mailed to each of the property owners in the
proposed district; and on May 10,1988, the Resolution of Intention was
published in the Sun Newspaper. To date, we have received no protests.
The Resolution Ordering the work is attached for your action.

2 A RESOLUTION OF THE CITY OF SAN BERNAROINO FINOING
AND DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY
3 REQUIRE THE FORMATION OF AN IMPROVEMENT DISTRICT IN THE
CENTRAL CITY SOUTH AREA TO COVER THE COSTS OF SAID
4 IMPROVEMENTS, KNOWN AS ASSESSMENT DISTRICT NO. 9B3, AND
ORDERING THE ENGINEER TO PROCEED UNDER THE MUNICIPAL
5 IMPROVEMENT ACT OF 1913.
6 WHEREAS, the Mayor and Common Council of' the City of
7 San Bernardino have preliminarily found that the public
8 interest, convenience and necessity require the formation of
9 Assessment District No. 983 under the provisions of the
10 Municipal Improvement Act of 1913 for the improvement of
11 certain streets in a portion of the City, as more fully
12 hereinafter described, and the appurtenances and appurtenant
13 w 0 r k and i n c ide n tal c 0 s t san d e x pen s e sin con nee t ion
14 therewith, that the project is feasible, and that the lands
15 to be assessed wi 11 be able to carry the burden of the
16
17 and
proposed
assessments to pay the costs and expenses thereof;
18 WHEREAS, the Mayor and Common Council of the City of
19 San Bernardino have. on the 3rd day of May, 1988, passed and
20 adopted Resolution No. 88-134 entitled:

which said resolution duly and legally was published and
notice of improvement has been given in the manner required by
Chapter 12.90 of the San Bernardino Municipal Code; and
written objections and protests to the formation of the
proposed district, the work to be done or the extent of the
district to be assessed were heard and considered.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND
COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That a full and fair public hearing
having been held, as stated in the recitals herein, and the
Mayor and Common Counci 1, havi ng heard and consi de red any and
all comments received thereon and being fully advised in the
premises, hereby overrules any and all protests received.
SECTION 2. That the public convenience and
necessity require, and the Mayor and Common Council of the
City of San Bernardino hereby declares by not less that a
4/5th vote as defined in Section 12.90.0400 of the San
B ern a r din 0 M u n i c i pal Code, t hat the pub 1 i c i n t ere s t ,
convenience and necessity requires and hereby orders, the
formation of Assessment District No. 9B3 under the provisions
of the MUl)icipal Improvement Act of 1913; the work described
in said Resolution No. 88-134 to be done in portions of "G"
Street between Rialto Avenue and Mill Street, portions of "F"
Street between Rialto Avenue and "G" Street, portions of "E"
Street between Rialto Avenue and Mill Street, portions of
Rial to Avenue between the Interstate 215 Freeway and liE"

Dear Ms. Clark:
Thank you for the notification on the proposed assessment district,
as outlined in your notification dated May 9. 1988.
AS a property owner in the Central City South area of San bernardino,
I wish to protest al':'linst the proposed assessment district. My
experience with assessment districts is that, regardless of good
intentions, the net result is a large debt liability against the property
which far exceeds any potential appreciation or increase in value.
Please accept my objection to the assessment district in this written
form, as I am unable to travel to California to discuss it personally with
the Mayor and Common Council of San Bernardino.

RESOLUTION OF THE CITY OF SAN BERNARDINO PRELIMINARILY

6 WHEREAS, the City of San Bernardino (hereinafter called
7 "City") as an exercise of its municipal affairs powers has
8 enacted an Assessment District Ordinance (Municipal Code
9 Chapter 12.90) to provide for the procedure for the formation
10 of assessment districts within the City; and
11 WHEREAS, it has now become necessary to consider the
12 formation of an improvement assessment district under the
13 Municipal Improvement Act of 1913 within the City, to be known
14 as "Assessment District No. 983"; and
15 WHEREAS, as a further exercise of the powers vested in
16 the City by virtue of Section 19, Article XVI, California
17 Consti tuti on, the Ci ty intends to conduct a heari n9 and hear
18 protests, if any, as to why the district should not be formed
19 and the acquisitions and improvements completed under the
20 provisions of the Improvement Act of 1913;

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO THAT:
SECTION 1.
Pursuant to Chapter 12.90 of the San

3 1913, the boundaries of which are generally, as follows:
4 generally bounded on the West by the Interstate 215 Freeway; on
5 the East generally by "E" Street; on the South by Mill Street
6 and on the North by Rialto Avenue which District is divided
7 into zones according to benefit.

SECTION 2.
It is the intention of said Mayor and
9 Common Council to order improvements within the district under
10 said Municipal Improvement Act of 1913 which improvements
11 consist of, but are not limited to, the the construction and/or
12 reconstruction of curbs, gutters, paving, sidewallc, landscaping
13 and/or undergrounding of utilities in portions of "G" Street
141 between Rial to Avenue and Mi II Street, portions of "F" Street
15 between Rial to Avenue and "G" Street, portions of "E" Street
16 between Rialto Avenue and Mill Street, portions of Rialto
17 Avenue between the Interstate 215 Freeway and "E" Street, and
18 portions of Mill Street between "G" Street and "E" Street.
19 The estimated cost of said improvements, including
20 i nci denta 1 costs is $7,741,24B.

SECTION 3. Said contemplated work and improvements is
22 of more than local or ordinary public benefit, and that said
231 14ayor and Common Council do hereby make the expense of such
24 work and improvement chargeable upon the district, which dis-
25 trict is hereby declared to be the district benefited by said

shown on the last equalized assessment roll as the owners of

By this letter we protest and do not support the
assessment proposed to finance the public works improvements.
As we understand, the proposal is to finance the placement
of street landscaping, street furniture and a triffic signal.
At an assessment of $2.00 per sq. ft. our parcel would be
charged $34,500. We have owned the land for 11 years. During
that time the property's value has not increased. We agree
with the Redevelopment Agency's report that the proposed
improvements will not increase the property values.
Several years ago the City created an assessment district
to construct street improvements on Stoddard Avenue. The
improvements were placed on the west side of the street only
and had no effect on the value of our properties.
Approximately 20 years ago the redevelopment effort on
South "E" Street was stopped. It was assumed that the area
would redevelop itself since it was between the two malls in a
high-traffic area. That rebuilding has not taken place. The
major difficulties with revitalizing the street are the
continued deterioration of old and vacant buildings, and small
parcels of land. Your limited proposal to enhance the street
will create a more attractive throughfare for people traveling
between the malls but does little to actually improve the
properties along "E" Street.

We have seen several proposals to develope the area
between "E" Street and the freeway. The most recent newspaper
article now suggests a sports arena. There seems to be a lack
of a Comprehensive Plan on the part of the City for the area.
When the City is committed to a single proposal which will
truly benefit our property you shall have our support.

Dear Mayor Wilcox,
I am a general partner of the limited partnership that owns the
recently remodeled retail center, in which Wherehouse
Entertainment and Radio Shack are located, at 168 South "E"
Street. I attended the meeting on April 6, 1988 in which I was
given the Property Owner Informational Package. In reviewing this
document and discussing the proposal with other owners along "E"
Street, I must vehemently oppose the above referenced assessment
district, if it includes "E" Street. First, the previously
mentioned Informational Package, prepared for and distributed by
the City of San Bernardino, clearly points out that there are
virtually no monetary benefits (land appreciation) to be gained by
"E" Street property owners. It is grossly unfair of the City to
ask us to "invest" tax dollars for no return. The City would not
do it. Why should we? Second, the proposed improvements will do
little, if anything, to increase traffic flow along "E" Street,
which would directly benefit businesses there.
Mayor Wilcox, I beleive in the future of Downtown San Bernardino.
However, I will not support this assessment district in its
present form. "E" Street should not be asked to pay for
improvements that only benefit landowners to the west. "E" Street
should not be included in this proposed project.

I am the owner of the property located at 480 South "E" Street, in the

owner of a nearby parcel of land, parcel number 0136-171-41-0000, on Mill
Street which has no structures, therefore no street number. Both properties
are with the proposed assessment district.
I request permission to appear at the June 6th, 1988 meeting to protest
against the proposed improvements and the extent of the district to be
assessed for the following reasons:
1. I recently opened a new Food Service business at 480 South "E" Street,
San Bernardino and the gross income is minimal which incurs great
difficulty in paying increased property taxes and assessment fees in
the future.
2. There are no specific plans to assure me that the construction and
modification of the curbs, gutters, paving and landscaping will not
make the ingress and egress from the business for the patrons difficult
or restrictive. Restricted or difficult entry or exit from the business
premises will decrease the number of patrons which will in.turn reduce
my business income.

Dear Mayor wilcox:
Please consider this as a formal protest to the inclusion of
the "E" Street zone int.o the overall assessment district. It
is our opinion that there will be minimum, if any, benefits
derived by the "E" Street merchants and property owners from
this project. It would appear that the only benefit will be
to the City of San Bernardino in helping fund the project.
The proposed construction or reconstruction of curbs, gutters,
paving, landscaping and traffic signal updating will have little
effect toward increasing existing property values for property
owners, and will have a negative impact for the merchants who
hold triple net leases and are responsible for all taxes and
assessments levied. The extension of "F" Street and the re-
working of "G" Street may also have the negative effect of
reducing traffic on "E" Street.
The monetary effects of this program on the "E" Street mer-
chants is debilitating to the profitability of our operations,
especially with competitive situations being as they are today.
It is our opinion that "E" Street should be removed from the
project.

FROM: Norman and Evelyn Gibson, Owners of Lot #307 (E Street)
RE: The Central City South Improvement District
As property owners of Lot #307 on the east side of E Street, we
would like to voice our opposition to the proposed plan for the
"improvements" of the area between the malls. The plan will only
help those properties within the district and not those on the
perimeter of the district. The cost is much too expensive for
the minimal improvements planned for E Street.
The plan was devised with only token imput from owners of the
district. We are making reference to the two property owners
meetings in which the gripes and concerns of owners fell on deaf
ears of very unsure and seemingly ill-informed planners.
Please give our voice of opposition your sincere concern.

Attention: Mayor of San Bernardino and City Council Members
Re: Our answer to the "Notice of Improvement" Resolution #88-134, dated
May 2, 1988 and May 3, 1988 with regards to the properties on the
east side of "E" Street between Rialto Avenue and Athol; lots
#0136121220000, #136121090000, 9136121130000, #136121370000,
#136121210000, #136121100000, and #136121360000.
We, David M. Cohn and Michael D. Cohn, as the owners of the above prop-
erties are against the assessment of our property for a majority of Un-
provement of property two to four blocks away - mainly the "G" Street
area.
Y~ars ago when re-development was started for the development of the
City of San Jernardino, where the existing Central City Mall is today,
they took in only the east section of "E" Street only down to Athol and
it was our understanding at that tUne that "E" Street was to be widened
from the Central City Mall to Mill Street, with plants and trees lining
the street making a new wide street to connect the Central City Mall
and the Inland Center Mall. This improvement has never been made.
After having bought the above property from the Re-development Agency,
we had to give the City of San Bernardino approximately ten feet of
foot frontage on the east side of "E" Street down to Athol for the pur-
pose of widening "E" Street with no financial compensation for our loss
of property from the Re-development Agency. In the present Resolution
#88-134 we find that there is no widening of "E" Street from Athol to
Mill Street and do not see what advantage or benefit there will be for
any business along "E" Street. We also do not see any major improve-
_nt of the buildings from Athol to Mill Street on "E" Street being
provided for.
To pose a question, in a few years fran now, what is to keep us from
again being assessed for improvement of land on the east side of "E"
Street bordering upon Mill Street and "E" Street and Athol and Arrow-
head Avenue? Is "E" Street going to be widened the ten to fifteen feet
from Athol to Mill Street so it will be uniform in width as to the

As long-time residents of San Bernardino, approximately fifty years,
we are not against the improvements that the city makes. But we do
feel some of these projects that have been started never seem to be
completed. As stated before, we are opposed to this type of assess-
ment.
