Synopsis of Previous Council action:
01-07-85 Confirmation granted that requirements of Federal Bridge
Replacement Program will be complied with, and allocation
of $31,000 approved for local agency share.
06-15-87 Resolutions No. 87-202 and 87-203 adopted authorizing'
execution of Program Supplements No. 44 & 45.
06-15-87 Projects referred to Environmental Review Committee.
07-06-87 Finding of need for health & safety reasons made, plans
approved, and authorization granted to advertise for bids.
09-08-87 Bids received on 8-11-87 rejected, and authorization
granted to re-ad~ertise for bids, subject to Caltrans'
approval of revised estimate of cost.
03-07-88 -- Plans approved and authorization granted to re-advertise
for bids.
Recommended motion:
1. That the transfer of $26,636 from Account No. 242-362-57385, "Signals -
Highland/Golden to Valencia," to Account No. 242-362-57359, "Oak Street
Bridge at Warm Creek," be approved.
2. That the transfer of $44,300, from Account No. 242-362-57382, "Signals -
Mt. Vernon Avenue/Rialto to Tenth," to 242-362-57371, "Valley Street
Bridge at Warm Creek," be approved.
3. Adopt Resolution.

The $12,000 is funds that were budgeted to correct a drain-
age problem along Oak Street. These funds are included, since
this work will be done under this contract. Supplemental funds
will, therefore, be needed in the amount of $26,636.00 to fully
finance the total estimated cost for Oak Street. .
The 1987/88 Street Construction Fund Budget contains an
amount of $32,000 in City Funds, under Account No. 242-362~57385,
for interconnecting traffic signals on Highland Avenue, from
Valencia Avenue to Golden Avenue. It is recommended that $26,636
of these City funds be transferred to Oak Street, since Federal-
Aid Urban funds have been secured to finance 100% of the cost.

Supplemental funds will, therefore, be needed in the amount
of $44,300 to fully finance the total estimated cost for Valley
Street.
A~ amount of $64,000 is included in the 1987/88 Street
Construction Fund Budget, under Account No. 242-362-57382, for
interconnecting the traffic signals on Mt. Vernon Avenue, from
Rialto Avenue to Tenth Street. It is recommended that $44,300
of these City funds be transferred to Oak Street, since Federal-
Aid Urban Funds have been secured to finance lOO% of the cost for
interconnecting these signals.
The bid documents were prepared to receive bids for both
Oak Street and Valley Street (Schedule "B"), and Oak Street
(Schedule "A") only. The low bid for Schedule "A" is $268,518.00.
This amount is $24,066 higher than the bid price for Oak Street in
Schedule "B".
Listed below is an estimate of the total project cost,
based upon the actual low bid price for Schedule "A".

Bids for this project were opened for the second time at
2:00 p.m., Tuesday, 4-12-88.
A total of 7 bids were received, ranging from $463,696.00
to $647,888.00. The low bid of $463,696.00 for Schedule "B" is
17.1% over the approved Engineer's Estimate of $396,200.00. This
Engineer's Estimate was determined by the Caltrans Bridge Depart.
ment, based upon their statewide computer cost estimating system.

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO KERSHAW CONSTRUCTION COMPANY FOR REPLACEMENT OF OAK
3 STREET AND VALLEY STREET BRIDGES OVER WARM CREEK.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Kershaw Construction Company is the lowest
6
responsible bidder for: Replacement of Oak Street and Valley
7
Street Bridges over Warm Creek, in accordance with Plan No. 6934,
8
for the total amount of $463,696.00, a contract for Schedule "B"
9
is awarded to said bidder accordingly, but such award shall be
10
effective only upon the contract being fully executed by the
11
parties; all other bids therefor are hereby rejected; and the
12
Mayor is hereby authorized and directed to execute said contract
13
on behalf of the City; a copy of the contract is attached hereto,
14
marked Exhibit "A" and incorporated herein by reference as fully
15
as though set forth at length.

SECTION 2. Execution and Amendments. This contract and
17
any amendments or modifications thereto shall not take effect or
18
become operative until fully signed and executed by the parties
19
and no party shall be obligated hereunder until the time of such
20
full execution.
No oral agreements, amendments, modifications or
21
waivers are intended or authorized and shall not be implied from
22
23
any act or course of conduct of any party.
I HEREBY CERTIFY that the foregoing resolution was duly

adopted by the Mayor and Common Council of the City of San
