COUNCIL ACTION STAFF REPORT --, Page 1 of 2 Bids for this project were opened for the second time at 2:00 p.m., Tuesday, 4-11-88. A total of 3 bids were received, ranging from $53,559.58 to $78,677.58. The low bid of $53,559.58 is 39.4% over the Engineer's Estimate of $38,424.00. The bid documents were prepared to solicit a Basic Bid for Perris Hill Park, and Additive Alternate "A" (Install swim pool lifter). For Blair Park, eight Additive Alternates were listed in the Bid Schedule. The City reserved the right to award a contract for the Basic Bid only, or the Basic Bid plus any or all of the Additive Alternates. This procedure was used to allow the contract to be formulated, on the basis of the actual low bid prices, to make the best use of available funds. After reviewing the low bid, it has been determined that a contract can be awarded for the Basic Bid and Additive Alternate "A," for Perris Hill Park and Additive Alternate No.4 for Blair Park. Copies of the Bid Schedule are attached for reference. Items of work included in the other Additive Alternates can be done at a later date as funds are provided. However, the Department of Parks and Recreation has identified $663 that could be transferred from various park projects. In the event that contingency funds are needed, they will be transferred from the available balance ($6,707) in the Park Construction Account Reserve. FOR CONSTRUCTION OF HANDICAP 3 ACCESSlBILITY AT CITY PARKS. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 5 SECTION 1. Redlands Paving, Inc. is the lowest 6 responsible bidder for: Construction of Handicap Accessibility 7 8 at City Parks, in accordance with Plan No. 7226, for the total amount of $40,7l2.58, a contract for the Basic Bid and Additive 9 Alternate for Perris Hill Park, and Additive Alternate No.4 for Blair Park is awarded to said bidder accordingly, but such award shall be effective only upon the contract being fully executed by the parties; all other bids therefor are hereby rejected; and the Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. SECTION 2. Execution and Amendments. This contract and any amendments or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. Allor a portion of the funds to be expended in the construction of the project are provided by the United States Department of Housing and Urban Development (HUD). This contract and any amendments or modifications thereto shall not 4/25/88 1 take effect or become operative until fully signed and executed by the parties in the manner required by the applicable HUD regulations and no party shall be obligated hereunder until the time of such full execution.
