HomeMy WebLinkAbout10587 Annex 262 (LAFC 932) r 1 RESOLUTION No/ll.S:r.f 7 A RESO~ION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF SAN BERNARDINO TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED ANNEXATION DISTRICT NO. 262 (LAFC 932), AND GIVING NOTICE OF THE PROPOSED ANNEXATION. 2 3 4 5,1 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 6 BERNARDINO AS FOLLOWS: 7 SECTION ONE: That pursuant to the provisions of the Annexation of S Uninhabited Territory Act of 1939, proceedings have been initiated by the 9 Council of the City of San Bernardino, on its own motion, to annex to the City 10 of San Bernardino all that uninhabited territory situate in the County of San 11 Bernardino, State of California, hereby designated as Annexation District No. 12 262 (LAFC 932), and described as follows: 13 14 15 Portion of Tract No. 2228 as per plat thereof recorded in Book 31 of Maps, Page 95 records of the County Recorder of San Bernardino County, State of California; a portion of Tract No. 2424 as per plat thereof recorded in Book 34 of Maps, Page 60 records of the County Recorder of said County; a portion of Lots 1 and 14, Block 55 and a portion of Lot 12 Block 72 Rancho San Bernardino as per plat thereof recorded in Book 7 of Maps, Page 2 records of the County Recorder of said County; and those portions of the adjoining Streets, described as follows: 16 17 lS 19 20 21 22 23 Beginning at point on the Present Corporate Limits of the City of San Bernardino, said point being on the centerline of Pioneer Road, a distance of 1600 feet more or less West of the centerline of Tippecanoe Avenue; thence Southwesterly along said City Limit Line being the centerline of the San Bernardino County Flood Control Channel as said centerline is delineated on the San Bernardino County Flood Control District Map, File No. 2-701, Drawing Number 8, dated May 17, 1960 in the office of the Chief Engineer of said District, a distance of 2400 feet more or less to the East line of Lot 6 of said Tract 2424; thence leaving said City Limit Line, North along the East line of said Lot 6 a dis- tance of 415 feet more or~less to the Northeast corner thereof; thence West along the North line of said Lot 6, a distance of 20 feet to the centerline of Emmet Way; thence North along the centerline of said Emmet Way, a distance of 1028 feet more or less to the center line of said Pioneer Road; thence East along said centerline of Pioneer Road, a distance of 650 feet more or less to the intersection with the Southerly prolongation of the West line of Lot 49 of said Tract 2228; thence North along said Southerly prolongation and said West line and the Northerly prolongation thereof, a distance of 595.41 feet more or less to the centerline of Norman Road; thence Easterly along said centerline of Norman Road, a distance of 1500 feet more or less to the Southerly prolongation of the Northwesterly line of the San Bernardino County Flood Control District Right of Way as delineated on San Bernardino County Flood Control District Map File No. 2-701, Drawing No.9, dated December 13, 1967 in the office of the Chief Engineer of said District, thence North- easterly along said Northwesterly line a distance of 1350 feet 24 25 26 27 28 29 30 I 31 32 I 'I II I, -1- I Ii , ii Ii Ii I 1,1 21 I , 3! 4 51 more or less to the centerline of said Tippecanoe Avenue, said point also being on the City Limit Line of said City; thence South along said centerline and said City Limit Line a distance of 430 feet more or less to an angle point in said City Limit Line and being the said centerline of the above mentioned Flood Control Channel; thence Southwesterly along said City Limit Line, and said centerline, a distance of 1800 feet more or less to the point of beginning. Containi~g 75 acres more or less. 6 7 That there are less than twelve qualified electors residing in said S territory, and that said territory is uninhabited as defined by said Act. 9\ I 1011 desires to annex said uninhabited territory to the City of San Bernardino for 11 I the following reasons: Said territory is contiguous to the City of San SECTION TWO: That the said council of the City of San Bernardino l2 Bernardino and its proposed annexation will contribute and facilitate the 13 I orderly growth and development of both the City of San Bernardino and the 14 territory proposed to be annexed, and will provide and facilitate propercpver-al1 15 planning and zoning of lands in said City and said uninhabited territory in a 16 manner most conducive to the welfare of said city and said uninhabited territory. 17 SECTION THREE: That upon the completion of said annexation of said lS territory, all of the propert~ included in said Annexation District No. 262 19 (LAFC 932), shall be taxed equally with the other property within the City of 20 San Bernardino to pay the bonded indebtedness and any and all general indebted- 21 ness of the City of San Bernardino contracted prior to or existing or outstanding 22 at the time of the aforesaid proposed annexation of said described property 23 as provided in said Act. 24 SECTION FOUR: That Monday, the 1st day of March, 1971, at the hour of 25 9:30 o'clock A. M. of said day in the Council Chambers located in the Garner 26 Building, 392 Court Street, San Bernardino, California, is hereby fixed as the 27 time and place when and where any person owning real property within the 28 uninhabited territory, above described and proposed to be annexed to the City 29 of San Bernardino, and having any objections to the proposed annexation may 30 I appear before the Council of the City of San Bernardino and show cause why 31 I such uninhabited territory should not be so annexed to the City of San 32 Bernardino. Such protest must be in writing, may be filed with the City Clerk -2- 10 11 25 26 27 I 28 29 I 30 I 31,1 32 I, I [I 1 at any time before the hour set for hearing objections to the proposed annexa- 2 tion, and shall state the name or names of the owner or owners of property 3 affected, and the description of such property in general terms. 4 51 SECTION FIVE: The City Clerk of the City of San Bernardino is hereby authorized and directed to cause a copy of this resolution to be published at 6 least twice but not oftener than once a week in the San Bernardino Free Press, 7 a newspaper of general circulation published in the City of San Bernardino, 8 the city to which it is proposed to annex the aforesaid territory, and also in 9 the Highland Messenger, a newspaper of general circulation published outside the City of San Bernardino but in the County of San Bernardino, California, the county in which is located the territory proposed to be annexed to the 12 City of San Bernardino, said publication to be complete at least twenty (20) 13 days prior to the date set for hearing; 14 The said City Clerk is further authorized and directed to cause 15 written notice of such proposed annexation to be mailed to each person to 16 whom lands within the territory proposed to be annexed is assessed in the last 17 equalized county assessment roll available to said clerk on the date the abo~e 18 said proceedings were initiated, at the addresses shown on said assessment roll, or known to said ~lerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with said Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation; 23 And in the event that any land within the territory proposed to be 24 annexed is owned by a county, the said City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such county, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation; And in the event there is upon the land proposed to be annexed a structural improvement owned, being acquired or leased by a county fire protec- tion district, the said City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first public hearing -3- 24 25 26 27 28 29 30 31 32 1 upon such proposed annexation; 2 And the City Clerk is directed to cause written notice to be given 3 to such other persons as may be legally entitled thereto, in the manner required 4 5 by law.
