NOTICE INVITING BIDS
NOTICE IS HEREBY GIVEN that the City of San Bernardino will
receive bids or oroposals for:
THE IMPROVEMENT OF CITRUS STREET FROM VICTORIA
AVENUE TO BANGOR AVENUE, IN ACCORDANCE WITH
SPECIAL PROVISIONS NO. 4161, ON FILE IN THE OFFICE
OF THE CITY ADMINISTRATOR, ROOM 201, CITY HALL.
Deliver all bids to the City Administrator's Office, Room 201,
City Hall, 363 North "E" Street, San Bernardino, California,
with the specification title and number clearly marked on the
outside of the envelope.
Said bids or orooosals will be received up to the hour of
2:00'p.m., Tuesday, January 5, 1971 , at which time all
of said bids or oroposals will be publiclv ooened, examined
and declared in the Council Chambers, 392 Court Street, San
Bernardino, California.
No bid will be received unless it is made on a proposal form
furnished by the City. All bids or oroposals shall be sianed,
sealed and accompanied bv cash, cashier's check, certified check
or bid bond made payable to the City of San Bernardino, in
the amount of ten per cent (10%) of the bid. Such cash,
check or bond shall be given as a guarantee that the bidder
will enter into the contract if awarded to him. In the event
the bidder refuses to execute said contract, the use bv the
public of the improvements will be delaved, and the public
will suffer great damage. ~rom the nature of the case, it
would be extreme Iv difficult and impractical to fix said amount
of damage. Therefore, the Citv and the bidderaaree that the
above sum of 10% shall be paid to the Citv uoon the condition
above set forth as liquidated damages and not as a forfeiture.
All bonds furnished pursuant to this notice must be under-
written bv a surety company having a rating in Best's most
recent Insurance Guide of "A" or better.
Pursuant to law, the Mavor and Common Council of the Citv of
San Bernardino, bv Resolution No. 5718 and anv and all .
amendments thereto which are herebv referred to and made a
part hereof bv reference as fully as though set forth at
length herein, have ascertained and determined the aeneral
orevailina rate of oer diem waaes, and of oer diem waaes for
legal holidavs and overtime work for each craft or tvpe of
workma~ needed in the execution of contracts under jurisdiction
of said Mayor and Common Council.
Said prevailing rates of wages shall conform to "Wage Scales
for the Six Basic Trades", filed in the Office of the City
Clerk, and "Sub-Trades Hourly Wage - Rates of Buildina and
Construction Trade Council of San Bernardino and Riverside.

Counties", filed in the Office of the City Clerk, which are
made a part of said Resolution No. 5718 and amendments there-
to.
It shall be mandatory upon the contractor to whom the contract
is awarded and 'upon any sub-contractor under him, to pav not
less than said specified rates to all laborers, workmen, and
mechanics employed by them in the execution of the contract,
and to prevent discrimination in the employment of persons
because of race, creed, color, or national oriain, as set
forth in the provisions of Resolution No. 7414 of the Mayor
and Common Council of the City of San Bernardino.
No bid will be accepted from a contractor who is not
licensed in accordance with the provisions of Chapter 9,
Division III of the Business and Professional Code.
The City of San Bernardino reserves the right to reject any
and all bids.,
Plans and specifications may be obtained from the Citv Admin-
istrator's Office, Room 201, City Hall, 363 North "E" Street,
San Bernardino, Caiifornia 92401, upon a non-refundable payment of
$5.00 for each set.

The undersigned declares that he has carefully examined the
location of the proposed work,that he has examined the plans and read
the accompanying instructions to bidders and hereby proposes to furnish
any and all required labor, materials, transportation and service for the
improvement of CITRUS STREET FROM VICTORIA AVENUE TO B,~,GOR AVENUE, in
strict conformity with Plan and Special Provisions No. 4161, City of
San Bernardino, Department of Engineering, and also in accordance with
Standard Specifications No. 2271, City of San Bernardino, Department
of Engineering, revised October 1966 and he proposes and agrees if this
proposal is accepted, that he will contract with the City of San Ber-
nardino, in the form of the copy of the contract annexed hereto, to
provide all necessary machinery, tools, apparatus and other means of
construction, and to do all the work and furnish all the materials speci-
fied in the contract, in the manner and time therein prescribed, and that
he will take in full payment therefor the following unit prices or lump

SPECIAL PROVISIONS
SECTION I
GENERAL
1.01 General -- The work embodied herein shall be done in accordance with
the Standard Specifications No. 2271, revised October 1966, of the City of San
Bernardino, Department of Engineering insofar as the same may apply, and as
modified and in accordance with the following special provisions.
1.02 Conflicts -- In case of conflict between the Standard Specifications
and these special provisions, the special provisions shall take precedence over
and be used in lieu of such conflicting portions.
SECTION II
DESCRIPTION OF WORK
2.01 General -- The work to be done consists, in general, of performing
earthwork for roadway, placing asphalt concrete, constructing concrete curbs,
gutters, all as shown on plans.
2.02 Maintaining Traffic -- During construction Citrus Street may be closed
to through traffic.
2.03 Public Convenience and Safety -- The contractor shall so conduct his
operations as to cause the least possible obstruction and inconvenience to public
traffic. Placement of all traffic control devises shall be reviewed by the City
Engineer and approved prior to any work.
Residents along the road or street shall be provided passage as far as
practicable. If passage cannot be provided the residents effected shall be
notified in advance. Convenient access to driveways, houses and buildings along
the road or street shall be maintained and temporary crossings shall be provided
and maintained in good condition.
The Contractor shall furnish, erect and maintain such signs, flashers, lights,
barricades, temporary sidewalks, flagmen, and all other necessary safety devices,
as conditions require to properly safeguard life and property.
All signs shall be provided in accordance with the standards established
by the State Uniform Sign Chart of the California State Division of Highways.
Any exceptions to these standards must be approved by the City Traffic Engineer
prior to installation.
The Contractor shall provide the City Engineer and the City Police Depart-
ment with the name, address, and telephone number of the person or persons who
will be available at all times to perform such work as deemed necessary by the
Engineer to properly safeguard life and property.

If the Contractor fails to replace, repair, or add to the safety devices
after being notified of a dangerous condition by the City Traffic Engineer or
City Police Devartment, the City will install the necessary devices to properly
safeguard life and property. The Contractor will ,be billed for all costs thereof
including a daily rental. Said costs will be deducted from the final payment.
The Contractor shall provide additional safety devices of his own to take care
of the conditions previously mentioned, at the earliest possible time, and
return forthwith, the City's safety devices as directed. The City assumes no
responsibility and the Contractor is relieved of no responsibility by the
provisions of this paragraph.
Hydrants under pressure, valve pipe covers, valve boxes, fire or police
call boxes, or other utility controls shall be left unobstructed and accessible
during construction.
, Payment for this item of work shall be included in the various other items
of work and no separate payment will be made therefor.
SECTION III
CONSTRUCTION DETAILS
3.01 Clearing and Grubbing shall be performed in accordance with the Standard
Specifications.
3.02 Earthwork -- Earthwork shall conform to the prov~s~ons of Section II of
the Standard Specifications except as modified by these special provisions. Earth-
work shall include asphalt and/or concrete removal.
Surplus excavated material if any shall become the property of the contractor
and be disposed of outside the street right of way.
Import material if necessary shall be furnished by the contractor.
Payment for Roadway Excavation shall be on a lump sum basis as provided in
the contract which price shall include full compensation for furnishing all labor,
materials, tools, equipment and incidentals, furnishing import, and for doing all
the work involved in excavating, loading, hauling, depositing, spreading and
compacting, including furnishing and applying water and disposing of surplus
materials, all as shown on the plans.
3.03 Asphalt Concrete Type "B" asphalt concrete shall conform to the
provisions of Section 15 of the Standard Specifications and these special provisions.
Paving asphalt to be mixed with the mineral aggregate shall be a steam-refined
asphalt having a penetration of 60-70, 85-100, 120-150, or 200-300, the range of
penetration to be designated by the Engineer.

A prime coat and/or paint binder shall be furnished and applied as directed
by the Engineer, and full compensation for furnishing and applying this material
shall be considered as included in the prices paid per ton for asphalt concrete
and no additional compensation will be allowed therefor.
3.04 Finishing Roadway -- Finishing roadway shall conform to Section 16 of
the Standard Specifications.
Compensation for finishing roadway shall be considered as included in the
prices paid for the various contract items of work and no additiona1,compensation
will be allowed therefor.
3.05 Curbs, Gutters, Sidewalks -- This work shall confprm to Section 18
of the Standard,Specifications.
Full compensation for excavation and backfill required in connection with
curb~ gutter, and driveway construction shall be considered as included in contract
price paid per cubic yard for Portland cement concrete (curbs, gutters, and drive-
~ays) and no additional compensation will be allowed therefor.
3.06 Miscellaneous Work shall be performed as indicated on the plans.
Payment for this item of work shall be considered as included in the various bid
items and no additional compensation will be allowed therefor.

AGREEMENT

Article I - Witnesseth, That for and in consideration of payments and agree-
ments hereinafter mentioned, to be made and performed by the said party of the
first part, and under the conditions expressed in the two bonds, bearing even date
with these presents, and hereunto annexed, said party of the second part agrees
with the said party of the first part, at his own proper cost and expense to do
all the work and furnish all the materials, except such as are mentioned in the
Special Provisions to be furnished by said party of the first part, necessary to
complete in good workmanlike and substantial manner the improvement of CITRUS
STREET FROM VICTORIA AVENUE TO BANGOR AVENUE, in strict conformity with the
Plans and Special Provisions No. 4161, on file in the Office of the City Engineer,
and also in accordance with Standard Specifications No. 2271, City of San Ber-
nardino, Department of Engineering, revised October 1966, which said Plans,
Special Provisions and Standard Specifications are hereby specially referred to
and by such reference made a part hereof.
Article II - And the said contractor agrees to receive and accept the follow-
ing prices as full compensation for furnishing all materials and doing all the work
contemplated and embraced in this agreement; also for all loss or damage arising
out of the nature of the work aforesaid, or from the acts of the elements, or from
any unforeseen difficulties or obstructions which may arise or be encountered in'
the prosecution of the work until its acceptance by the City of San Bernardino and
for all risks of every description connected with the work; also for all expenses
incurred, by or in consequence of the suspension or discontinuance of work, and for
well and faithfully completing the work, and the whole thereof, in the manner and
according to the Plans and Special Provisions, and requirements of the Engineer
under them, to-wit:

Article III The said party of the first part hereby promises and agrees

to provide the materials and to do the work according to the terms and conditions
herein contained and referred to, fOl' the prices aforesaid, and hereby contracts
to pay the same at the time, in the manner, and upon the conditi ons above set forth;
and the said parties for themselves, their heirs, executors, administrators, success-
ors, and assigns, do hereby agree to the full performance of the covenants herein
contained.
Article IV - It is further expressly agreed by and betvleen the parties hereto
that should there be any conflict between the terms of this instrument and the
bi~ or proposal of said contractor, then this instrument shall control and nothing
herein shall be considered as an acceptance of the said terms' of said proposal
