A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE FILING OF AN AMENDATORY APPLICA- TION WITH THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, UNI!:ED STA TES OF AMERICA FOR AN AMENDATORY CODE ENFORCEMENT GRANT UNDER THE TERMS OF PUBLIC LAW 89-117. 2 3 4 5 6 WHEREAS Section 117 of the Housing Act of 1949, as amended, authorizes 7 the Department of Housing and Urban Development to make grants to municipalities 8 and counties to assist them in carrying out programs of concentrated code enforcement 9 in deteriorated or deteriorating areas in which such enforcement, together with certain 10 public improvements to be provided by the locality, may be expected to arrest the 11 decline of the areas; and 12 WHEREAS it has been found and determined by this body that there exists 13 14 in this locality a deteriorated area known as Delmann Heights for which a program of 15 concentrated code enforcement, combined with certain public improvements, is 16 arresting the decline of the area; and 17 WHEREAS the Department of Housing and Urban Development has pre- 18 viously executed Contract No. Calif. E-5(0) w;ith the City of San Bernardino to 19 institute a program of concentrated code enforcement in the Delmann Heights area of 20 21 San Bernardino and it has been found that an amendatory contract is necessary to 22 reflect certain changes for carrying out effectively the program of concentrated code 23 enforcement in this area; and 24 WHEREAS it is recognized that the grant of amendatory funds pursuant to 25 Section 117 will impose certain obligations and responsibilities upon the City of San 26 Bernardino, among which is the obligation to assure that any persons who may be 27 displaced as a result of the code enforcement and public improvements programs are 28 relocated into decent, safe and sanitary housing in accordance with the regulations 29 of the Department of Housing and Urban Development; and 30 31 32 -",-""." I 1 WHEREAS TitleJVI of the Civil Rights Act of 1964, and the regulations 2 of the Department of Housing and Urban Development effectuating that Title, provide 3 that no person shall, on the ground of race, color, or national origin, be excluded 4 from participation in, be denied the benefits of, or be subjected to discrimination in 5 6 the undertaking and carrying out of any program or activity receiving Federal finan- 7 cial assistance under Title I of the Housing Act of 1949, as amended: 8 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 9 COUNCIL OF THE CITY OF SAN BERNARDINO: 10 1. That an application be filed with the Department of Housing and Urban 11 Development on behalf of the City of San Bernardino for an amendatory code enforce- 12 ment grant under Section 117 of the Housing Act of 1949, as amended, of two-thirds 13 14 of the cost of undertaking and carrying out a code enforcement program, which cost 15 is now estimated to be $945,436, in an area or areas to be designated and specifically 16 described in such application, and that the Mayor of the City of San Bernardino is 17 hereby authorized and directed to execute and file such application, to provide such 18 additional information and furnish such documents as may be required by the 19 Department of Housing and Urban Development, to execute such contract or contracts 20 as may be necessary for the grant applied for, to execute and file requisitions for 21 22 funds, and to act as the authorized representative of the City of San Bernardino in 23 the accomplishment of the code enforcement program. 24 2. That during the period of the contract for the code enforcement 25 grant the City of San Bernardino will maintain a level of expenditures for code 26 enforcement activities, exclusive of expenditures in any federally assisted code 27 enforcement or Title I urban renewal project areas, that is not less than the average 28 yearly expenditure for such activities throughout the locality for the two full fiscal 29 years immediately preceding the filing of the application. 30 31 32 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 1 3. That the locality has a program for and will provide in a timely 2 manner all necessary public improvements for the code enforcement area. 3 4. That there exists in the locality an adequate amount of decent, safe, 4 and sanitary housing which is available to persons displaced as a result of the code 5 enforcement and related public improvements programs, at prices which are within 6 7 their financial means and which are not generally less desirable in regard to public 8 utilities and public and commercial facilities than the dwellings of the displaced 9 individuals and families, and it is the sense of this body that such displacoo1;l, if any, 10 will be relocated in accordance with applicable regulations of the Department of 11 Housing and Urban Development. 12 5. That the United States of America and the Secretary of the Department 13 of Housing and Urban Development be, and they hereby are, assured of full compli- 14 ance by the City of San Bernardino with regulations of the Department of Housing and Urban Development effectuating Title VI of the Civil Rights Act of 1964.
