RESOLUTION NO. 85-l90
2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONTINUING THE
TEMPORARY CLOSING OF A CUL DE SAC ON FIFTH STREET BETWEEN
3 MERIDIAN AVENUE AND THE PRESENT TERMINUS OF FIFTH STREET 325 FEET
TO THE EAST PURSUANT TO SECTION 21l0l OF VEHICLE CODE.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:

SECTION l. Findin~s. The Mayor and Common Council of the
7 City of San Bernardino make the following findings:

A. Fifth Street, between Meridian Avenue and the present
9 terminus of Fifth Street approximately 325 feet to the east in
10 the City of San Bernardino, is a cul de sac providing access only
11 to an apartment complex and is not currently needed for public
12 vehicular traffic.

B. The section of street designated in this resolution is
14 frequently used as an access route for illegal activities,
15 including burglaries, assaults, and drug trafficking, perpetrated
16 on the adjacent residential community.

C. Subsection (a) of the California Vehicle Code Section
18 2ll0l authorizes local authorities to adopt rules and regulations
19 by ordinance or resolution to temporarily close any highway to
20 vehicular traffic when the highway is no longer needed for
21 vehicular traffic.

D. The closing of said cul de sac has promoted and will
23 continue to promote public health, safety, welfare and morals.

SECTION 2. Closin~. Pursuant to Subsection (a) of Section
25 21101 of the California Vehicle Code, the following street will
26 continue to be temporarily closed:
27 Fifth Street between Meridian Avenue and the present
28 terminus of Fifth Street approximately 325 feet to the east of
29 Meridian Avenue in the City of San Bernardino.

SECTION 3. Barricades. The owner of the adjoining property
2 is authorized to continue to maintain appropriate facilities
3 including fencing and guard facilities, to control access to this
4 portion of Fifth Street, in accordance with requirements of the
5 Director of Public Works/City Engineer and at no cost to the
6 City.

SECTION 4. Termination. The temporary closing of this
8 portion of Fifth Street shall be in effect for a period of one
9 year from the date of this resolution, except that the closing
10 can be terminated at any time upon 15 days written notice by the
II City or the owner of the adjoining property.
