HomeMy WebLinkAbout1985-125 1 RESOLUTION NO. 85-125 RESOLUTION OF THE CITY OF SAN BERNARDINO IMPOSING LIENS ON CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE COSTS OF THE ABATEMENT OF A PUBLIC NUISANCE (947 WEST 6TH STREET, 1238 NORTH D STREET, 876 SOUTH LINCOLN): AND REPEALING RESOLUTION NO. 85-92. 2 3 4 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 6 7 SECTION 1. The City of San Bernardino, pursuant to its 8 authority under San Bernardino Municipal Code Section 3.68.020 and 9 San Bernardino Municipal Code Chapters 8.18, 8.27, 8.30, 8.33 and 10 15.28 and other laws, did lawfully cause public nuisance 11 abatements on the real property described in Exhibit "A", attached 12 hereto and incorporated by reference as though fully set forth. 13 The last known owners of record as to each such parcel are also 14 specified in Exhibit "A". 15 Due notice was given to the person or persons having an 16 interest in said property and a hearing was held by the Board of 18 said abatements on said property. The Board of Building ofl I 17 Building Commissioners to hear protests and to assess the costs 19 Commissioners has entered its order determining the costs to be 20 reasonable and proper and imposing a lien upon the land involved. 21 Notice of the right of appeal to the Mayor and Common Council has 22 been issued to all affected property holders. The Board of 23 Building Commissioners now requests that the Mayor and Common 24 Council confirm the imposition of the lien. 25 SECTION 2. The matter having now come before the Mayor and 26 Common Council for confirmation of the imposition of the lien 27 imposed, the following costs are found to have been duly incurred 28 by the City pursuant to proceedings under said provisions of the 1 San Bernardino Municipal Code and the final statements of costs on 2 file with the City Clerk are hereby confirmed and adopted as 3 special assessments: 4 Assessment Assessor's Address Amount of No. No. Assessment 1 138-141-09 947 West 6th Street $ 2,227.10 2 145-242-32 1238 North D Street $ 2,902.32 3 136-411-08 876 South Lincoln $ 620.00 5 6 7 8 The legal description of each parcel is detailed on Exhibit "An. 9 SECTION 3. If said sum is not fully paid to the City Clerk, 10 City Hall, San Bernardino, within five (5) days after the adoption 11 of this resolution as to any such individual parcel, then said sum 12 shall be and become a lien on said property pursuant to said 13 Municipal Code provisions and applicable laws and shall be 14 collected as a special assessment thereon. 15 SECTION 4. In the event said sum is not paid as hereinabove 16 provided, the City Clerk is hereby directed to file a certified 17 copy of this resolution with the Auditor of the County of San 18 Bernardino, State of California, directing that said sum be 19 entered as lien charges against said property as it appears on the 20 current assessment rolls, to be collected at the same time and in 21 the same manner, subject to the same penalties and interest upon 22 delinquencies, as the general taxes for the City of San Bernardino 23 are collected. The City Clerk shall also present for recording 24 appropriate notices of the imposition of these liens with the 25 County Recorder. 26 SECTION 5.
