RESOLUTION NO. 85-85
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO, CALIFORNIA, ACCEPTING A
CERTAIN 1984 HOUSING REPQRT OF THE CITY OF SAN
BERNARDINO AND REDEVELOPMENT AGENCY OF THE CITY
OF SAN BERNARDINO AND AUTHORIZING THE PUBLICATION
THEREOF
WHEREAS, the City of San Bernardino, California (the
"City"), has previously submitted an application to the Mortgage
Bond Allocation Committee for an allocation for the issuance by the
City or the Redevelopment Agency of the City of San Bernardino (the
"Agency") of qualified mortgage bonds during calendar year 1985; and
WHEREAS, the Tax Reform Act of 1984 amends Section 103A of
the Internal Revenue Code of 1954, as amended (the "Code"), and Code
Section 103A(j)(5)(B) requires the preparation and consideration of
a report which shall include a statement of policies regarding the
issuance of qualified mortgage bonds and housing, development and
low-income housing assistance programs of the City and the Agency
and certain other matters (the "Report"); and
WHEREAS, Code Section 103A(j)(5)(A) requires that the City
and the Agency submit a copy of the Report to the Secretary of the
United States Department of the Treasury on or before the last day
of the year preceding the year in which qualified mortgage bonds are
issued; and

WHEREAS, on December 11, 1984, the United States Treasury
Department published its T.D. 7995, temporary regulations on
information reporting for qualified mortgage bonds and the
preparation of the Report (the _"Temporary Regulations") in the
Federal Reqister; and
WHEREAS, the Temporary Regulations contain certain
provisions pertaining to the information which must be included in
the Report and the applicable procedures for the consideration and
approval of the Report by the City and the Agency; and
WHEREAS, the City Staff and the Agency Staff have
previously submitted to the City Clerk a copy of a draft of the
Report, in accordance with the Temporary Regulations; and
WHEREAS, the City Clerk has published notice setting a
joint public hearing of the Mayor and Common Council of the City
(the "Council") with the Community Development Commission of the
City of San .Bernardino (the "Commission") for the review and
consideration of the Report in accordance with Code
Section 103A(j)(5) and the Temporary Regulations; and
WHEREAS, Code Section 103(j) (5) requires that the
applicable elected representative of the issuer of qualified
mortgage bonds shall publish the Report following the public hearing
thereon; and

WHEREAS, it is appropriate at this time for the Council to
consider acceptance of the Report and authorize the publication
thereof in accordance with Code Section 103A(j)(5) and the Temporary
Regulations.
NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO DO HEREBY FIND, RESOLVE, DETERMINE AND ORDER AS
FOLLOWS:
Section 1. The notice of the joint public hearing of
the Council and the Commission as required pursuant to Code Section
103A(j)(5)(B) has been duly published as prescribed by said Section.
Section 2. The Council has considered all oral and
written comments at the joint public hearing held on this date for
the consideration and receipt of the Report by the Council and the
Agency.
Section 3. The Council hereby approves the Report and
accepts the receipt thereof. A copy of the Report is attached
hereto as Exhibit "A" and incorporated herein by this reference.
The Council hereby authorizes and directs the City Staff and the
Agency Staff to prepare a summary of the public comments and
testimony which have been received by the City in connect ion wi th
the preparation, review and approval of the Report and to include
such summary in the Report as shall be published by the City Clerk

and the Agency Secretary on behalf of the Mayor in accordance with
Section 5 of this Resolution.
Section 4. The council- hereby accepts the request of
the Agency to designate and appoint the Mayor to act as the
applicable elected representative of the Agency in connection with
the publication of the Report following a duly noticed public
hearing of the Agency. The Council constitutes the elected
legislative body of the City and the Mayor of the City is hereby
appointed as the applicable elected representative of both the City
and the Agency, and shall cause to be published the Report, in
cooperation with the City Clerk and the Agency Secretary, as
required pursuant to Code Section 103A(j)(5)(B) on behalf of both
the City and the Agency and as provided in .Section 5 of this
Resolution.
Section 5. The City Clerk in cooperation with the
Agency Secretary on behalf of the Mayor of the City, is hereby
authorized and, directed to cause the Report to be published in The
Sun, a newspaper of general circulation in the City of San
Bernardino as soon as practicable after adoption of this
Resolution. The City Clerk in cooperation with the Agency Secretary
is further authorized and directed to submit a true and correct copy
of the Report to the Secretary of the United States Department of
the Treasury and to verify that said Report has been received by the
Secretary on or before March 11, 1985.

Section 6.
This Resolution shall take effect upon
adoption.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at an adiourned reaular meeting thereof, held on the
7th day of March , 1985, by the following vote, to
wit:
