THE CITY OF SAN BERNARDINO AUTHORIZING MAYOR TO AMENDMENT TO PARKING LICENSE, CENTRAL CITY 3 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY i OF SAN BERNARDINO AS FOLLOWS: 5 6 SECTION 1. The Mayor of the City of San Bernardino is 7 hereby authorized and directed to execute, for and on behalf of 8 the City of San Bernardino, a consent to an amendment to the !parking license and easement with option rights among the II Community Development Commission of the City of San Bernardino, California and Central City Commerce Center, consent to which by 9 10 11 12 the City of San Bernardino is required. I. RECITALS. 15 16 The parties hereto desire to amend that certain parking 17 license and easement with option rights heretofore entered into 18 on the 21st day of April, 1983, to provide that responsibility for payments for parking spaces at the rate of $20.00 per month per space for each of the parking spaces covered by the agreement shall be excused until such time as the rehabilitated Woolworth 19 Building is first occupied. The parties recognize that Center has made reasonable efforts to find tenants for the building, and that, until the building is occupied, the public is receiving the benefit of the availability and use of the parking spaces. In I all other respects, the agreement is to I effect according to its present terms. II. IMPLEMENTATION. remain in full force and 24 25 26 27 28 1 Paragraph 2.5 is added to the parking license and easement 2 with option rights, to read as follows: 3 "2.5 Notwithstanding the provisions of Section 2.3 above, 4 payments by Central City Commerce Center, as Licensee, for the 5 monthly parking space charges shall be postponed until the 6 rehabilitated Woolworth Building is first occupied by any tenant, 7 at which time the monthly charges shall begin to be due and to be 8 paid by Center to Agency. All sums accrued and past due for 9 monthly parking space charges are hereby excused, and shall not 10 become due. Upon occupancy of the Woolworth Building by its 11 first te~ant, Licensee shall forthwith commence monthly payments 12 at the rate of $20.00 per month per space for each of the parking 13 spaces included in the "J" Building and for each of the parking 14 spaces covered by this agreement in the parking structure. This amendment shall have no effect whatsoever upon payments of the $13,000.00 annually involving reimbursement for the cost of establishing parking spaces in the "J" Building, and the monthly per space charge shall be subject to adjustment periodically as provided for in Section 2.3." In all other respects, the parking license and easement with option rights as entered into on the 21st day of April, 1983, shall remain in full effect. Under the terms of the lease, the owners of the Woolworth Building pay to the Agency $13,000 per year for five years, for a total of *65,000 to reimburse the Agency for the cost of construction of the 45 spaces on the ground level (referred to as th MJ" site). On 2-18-85 Staff presented a request from the Lessee for an amendment to the Lease to provide that payments not start until first occupancy of the Woolworth Building. The Commission, recognizing the difficulties encountered, approved the request in concept and instructed Agency Counsel to prepare the Amendment. The Amendment is attached.
