HomeMy WebLinkAbout1985-080 1 RESOLUTION NO. 85-80 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF A LEASE WITH ROBERT WHITESIDE FOR PREMISES LOCATED AT 3 4222 NORTH SIERRA WAY FOR USE AS A POLICE COMMUNITY SERVICE OFFICE OR OTHER LAWFUL PURPOSE. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 5 SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. The Mayor of the City of San Bernardino is hereby 7 authorized and directed to execute on behalf of said City a 8 Lease with Robert Whiteside for premises located at 4222 North 9 Sierra Way for use a a police community service office or other 10 lawful purpose, a copy of which is attached hereto, marked Exhibit 11 "A" and incorporated herein by reference as fully as though set 12 forth at length. 13 I HEREBY CERTIFY that the foregoing resolution was duly 14 adopted by the Mayor and Common Council of the City of San 15 Bernardino at a meeting thereof, held on reqular 16 the 18th day of February , 1985, by the following vote, 17 to wi t: 19 20 21 22 23 24 25 26 27 28 18 Council Members Castaneda. Approved as to form: /~ ;. 0 /~ / y/~ C-?/ City A torney 1 LEASE 2 (Community Police Center) 3 THIS LEASE is made and entered into effective April I, 1985, 4 by and between ROBERT WHITESIDE ("Landlord") and the CITY OF SAN 5 BERNARDINO ("City"), a municipal corporation. 6 Landlord and City agree as follows: 7 1. Recitals. 8 A. Landlord is the owner of the premises described as 9 4222 North Sierra Way in the City of San Bernardino and desires to 10 lease said premises to City for use as a community service office 11 by the Police Department of the City of San Bernardino, and for 12 other lawful purposes as determined by the City. 13 B. City desires to lease the premises from Landlord 14 pursuant to the provisions stated herein. 15 2. Description of Premises. Landlord leases to City, and 16 City lets from Landlord, as herein provided, the premises located 17 at 4222 North Sierra Way, City of San Bernardino, County of San 18 Bernardino, State of California, and appurtenant rights. City 19 shall have full and unimpaired access to the premises at all times 20 and the nonexclusive right to use common areas, including parking 21 areas. 22 23 April 1, 1985, and ending March 31, 1986. 3. Term. The term of this lease is one year, beginning 24 4. Rent. The total rent of this lease is the sum of TWO 25 THOUSAND NINE HUNDRED AND FORTY DOLLARS ($2,940.00). City agrees 26 to pay Landlord said amount in installments of Two Hundred and 27 Forty-five Dollars ($245.00) per month. City shall not be liable 28 for any other costs or expenses except as agreed to herein. --..~~~~~-. 1 Monthly rental payments shall be made at 4214 North Sierra Way, 2 San Bernardino, California 92407. 3 5. Use of Premises. The premises are leased to be used as 4 and for a community police center or for any other lawful public 5 purposes. 6 6. Payment of Utilities. City shall pay for all utilities 7 furnished the premises for the term of this lease, including 8 electricity, gas, water, rubbish removal and telephone service. 9 7. Duty to Maintain and Repair Premises. City shall 10 maintain all internal portions of the premises in good condition 11 and shall keep windows and doors in good repair. The Landlord 12 shall be responsible for the exterior of the building, except 13 windows and doors. City shall be liable for any damage to windows 14 and doors and for any damage above ordinary wear and tear to the 15 interior of the premises resulting from the act or omission of the 16 City or its authorized representatives, but not from other 17 persons. 18 8. Fixtures. City shall have the right to install such 19 fixtures as are necessary for the proposed use of the premises, 20 and such fixtures shall not become a part of the real property. 21 9. Alterations of Premises. City may make such repairs and 22 improvements as are required to fit the premises for the proposed 23 use. 24 10. Option to Renew. Landlord grants City an option to 25 renew this lease for a period of one year after the expiration of 26 its original term, on the same terms as this lease. City shall 27 give Landlord written notice of its election to renew at least 28 thirty days prior to the expiration of this lease. -2- 1 11. Fire Insurance. Landlord agrees to procure and maintain 2 in force during the term of this lease and any extension thereof, 3 at its expense, fire insurance on the real property in an amount 4 sufficient to protect Landlord's interests. 5 12. Signs. City may erect or display, on the leased 6 premises, any sign or advertising matter depicting the public use 7 of the premises. 8 13. Office Furniture, etc. All office furniture and 9 equipment, listed on the attached addendum, Exhibit 1 hereto, 10 shall be included in the lease at no additional cost to City. 11 Maintenance of the office furniture and equipment shall be at the 12 expense of the City. 13 14. Hold Harmless. City shall hold Landlord harmless from 14 all damages arising out of any injury to any person or property 15 occurring in, on or about the premises, except the Landlord shall 16 be liable to City for damage resulting from the acts or omissions 17 of Landlord or his authorized representatives, and Landlord shall 18 hold City harmless from all damages arising out of any damage 19 caused by him or his authorized representatives. 20 15. Termination. City shall have the right to terminate 21 this lease for any reason by giving two weeks' advance written 22 notice to Landlord, and this lease shall terminate two weeks 23 thereafter. 24 16. Amendment. This lease may be amended or modified only 25 by written agreement signed by both parties and failure on the 26 part of either party to enforce any provision of this lease shall 27 not be construed as a waiver of the right to compel enforcement of 28 such provision or provisions, nor act to release any surety from -3- 22 23 24 25 26 27 28 1 its obligations under this lease. 2 17. Notices.
