BE IT RESOLVED BY THE MAYOR IINO COHi.10N COUNCIL OF THE CITYI BERNARDINO AS FOLLOWS: OF SAN SECTION 1. That the Mayor and Common Counci 1 of tile Ci ty of San Bernardino hereby declares its intention to order the vacation of that portion of Date Street located West of Victoria Avenue and Valaria Drive, in said City, which said portion is more particularly described as follows: That portion of Date Street lying between the Southerly prolongation of the East line of Tract 8604 as delineated on the Map of said Tract recorded in Book 126 of Maps, pages 91 and 92, Records of the County Recorder of San Bernardino County, State of California and the Northerly prolongation of the West line of that parcel described in the document to the San Bernardino County Flood Control District recorded June 21, 1941, in Book 1481, page 148, Official Records of said County. SECTION 2. That the Mayor and Common Council of the City of San Bernardino, in vacating the above described portion of said street, elects to proceed under and in accordance with the provisions of the "Public Streets Highways and Services Vacation Law", being Division 9, Part 3, of:the Streets and Highways Code I of the State of California. I , I SECTION 3. That the hour of 9:00 a.m., on the 18th day I of March, 1985, in the Council Chambers, City Hall, San Bernardinoj, Cal ifornia, be, and the same hereby is fixed as the time and I place when and where all persons interested in or Objecting to the proposed vacation may appear before the said Mayor and Common Council and offer evidence in relation thereto. For further particulars as to the proposed vacation of the hAr-ei~before 1 described portion of said street, reference is made to that certain map marked "Plan No. 6677" approved February 18, 1985, nn file in the office of the City Clerk of said City. SECTION 4. Nothing in this Resolution shall ~n any way affect or disturb any existing easements for sanitary sewer and 2 3 4 5 6 appurtenant facilities and for public utility purposes belonging either to the City of San Bernardino or to any public utility and there is hereby reserved for future general public utility purposes and for this City an easement reasonably necessary to locate such sanitary sewer and public utility facilities over, in, under, or across the hereinabove described street and to use, 7 8 9 10 11 ]2 maintain, repair, replace or renew such facilities. 13 SECTION 5. That the City Engineer of the City of San 14 Bernardino hereby is directed to cause Notices of Street Vacation 15 to be posted as required by the Public Streets, Highways and Services Vacation Law. 16 SECTION 6.
