RESOLUTION NO. 85-70
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION
OF AN AGREEMENT WITH LEONARD LINDBERG FOR THE RENTAL OF AN OFFICE LOCATED AT
880 EAS1 MiLL STREET, SUITE 203, SAN BERNARDINO, CALIFORNIA.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN

SECTION 1. The Mayor of the City of San Bernardino is hereby
authorized and directed to execute on behalf of said City an agreement with

Leonard Lindberg for the rental of an office located at 880 East Mill Street,
8
Suite 203, San Bernardino, California, a copy of which is attached hereto,
9
marked Exhibit "A" and incorporated herein by reference as fully as though set
10
forth at length.

Landlord, and The City of San Bernardino, a

municipal corporation, hereinafter called "Tenants".

WIT N E SSE T H
9 WHEREAS, Landlord is the Owner of certain real property
10 which has situated thereon business and office building, and said
11 roperty is located at 88D East Mill Street, Suite 203, San
12 Bernardino, California; and
13 WHEREAS, while said office space is vacant, and
14 WHEREAS, Tenants desire to occupy and rent said office
15 space in accordance with said terms and conditions.

NOWTHEREFORE, in consideration of the mutual terms,
17 ovenants, provisions and detrimonts herein contained, it is
18 greed as foll ows:

Property - Landlord hereby rents to Tenants the

I 80 East Mill Street, Suite 203, in San Bernardino, California.
I 2. Term The term of this agreement shall be on a

term of this agreement and the period of time that Tenants are in

possession of the premises. Tenant agrees to bear the cost for

telephone service.

5. Access to premi ses
Landlord shall have access to

~etermine compliance with this agreement by Tenants.

6. Maintenance
Landlord shall be responsible for

aintaining the premises in a secure condition during the periOd

f this agreement and shall protect the premises from all damage

~ervices shall be provided daily by the Landlord.

7.
Subletting
The rights of the Tenants hereunder

B. Tenants shall not make any improvements to the

premises without the prior written consent of Landlord first

o b ta i n e d .

9. Liens
Tenants agree to keep the premises free and
5

clear of all mechanic's liens that might arise out of making
repairs or improvements on said premises.

Tenants shall comply with all sanitary laws,
8
ordinances and rules and all orders of the Board of Health or
9
other authorities affecting the cleanliness, occupancy and
10
preservation of the premises and the sidewalk connected thereto
11
during the term of this agreement.

11. Landlord shall keep the fixtures in the buildings or
13
on or about the premises in good order and repair; keep the
14
faucets in repair; keep the premises clean; keep any electrical
15
valves in order; and, at their own expense, shall make all re-
16
,quired repairs to the plumbing,
heating and cooling
range,
17
apparatus and electrical and gas fixtures. Tenants also agree
Ithat no signs shall be placed or painting done on or about the
jpremises without the prior written consent of Landlord.
I 12. At all times hereunder Landlord, or its agent, shall

Ihave the privilege of placing "for sale" signs on the premises and

premises hereby demised in as good state and condition as they

were in at the commencement of the occupancy by Tenants pursuant

jto the provisions hereunder, reasonable use and wear thereof and
,ldamageS by the elements excepted.
II In the event the premi ses or any part thereof are damaged
by fire or other casualty, then Landlord's responsibility to

IITenants under this agreement is terminated forthwith.

14. Should Tenants default in any of their obligations
7 hereunder or in the performance of any other covenants and

lagreements herein contained, this agreement, and the relation of
Illandlord and Tenants, at the option of Landlord shall wholly cease

liand terminate and Landlord may re-enter the premises and remove

II 15. Either party may terminate this month-to-month
lagreement at any time by giving written notices of termination to

18. The covenants and conditions herein contained shall
apply to and bind the heirs, executors, and legal representatives
of the parties hereto and all covenants are to be construed as
conditions.
