2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AGREEMENTS FOR FINANCIAL ASSISTANCE FOR FISCAL YEAR
3 1985-1986 WITH FRAZEE COMMUNITY CENTER, MERRI-MIXERS, ROLLING
START, INC., FAMILY SERVICE AGENCY, CASA RAMONA, INC., AND BOYS
4 CLUB OF SAN BERNARDINO, INC.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

7 SECTION 1. The Mayor of the City of San Bernardino is
8 hereby authorized and directed to execute on behalf of said City
9 various agree~ents relating to financial assistance for fiscal
10 year 1985-1986, with Frazee Community Center, Merri-Mixers,
11 Rolling Start, Inc., Family Service Agency, Cas a Ramona, Inc.,
12 and Boys Club of San Bernardino, Inc. A copy of each such
13 contract is attached hereto and incorporated herein by reference,
14 each being marked respectively with the following exhibit
15 numbers: Exhibit A - Frazee Community Center, Exhibit B - Merri-
16 Mixers, Exhibit C - Rolling Start, Inc., Exhibit D - Family
17 Service Agency, Exhibit E - Casa Ramona, Inc. (Support Services),
18 Exhibit F - Cas a Ramona, Inc. (Senior Citizens), Exhibit G - Casa
19 Ramona, Inc. (Food and Medical Program), Exhibit H - Boys Club of
20 San Bernardino Inc.

2 (Community Service Organization)
3 THIS AGREEMENT is entered into effective as of October 1,
4 1985, at San Bernardino, California, between the City of San
5 Bernardino, a municipal corporation, referred to as "City", and
6 BOYS' CLUB OF SAN BERNARDINO, a nonprofit community services
7 organization, referred to as "Service Organization".
8 City and Service Organization agree as follows:
~ 1. Recitals.
10 (a) Service Organization has requested financial
11 assistance from City for the fiscal year 1985-1986.
12 (b) Service Organization represents that the
13 expenditure authorized by this agreement is for a valid
14 municipal public purpose. The purpose is to provide space for
15 programs benefiting the youth of the community.
16 2. Payment. City shall pay to Service Organization the
17 total sum of TWELVE THOUSAND THREE HUNDRED FIVE DOLLARS AND FIFTY
18 CENTS ($12,305.50) for the term of this agreement, payable in
19 eight monthly installments of ONE THOUSAND THREE HUNDRED SIXTY-
20 SEVEN DOLLARS AND TWENTY-SEVEN CENTS ($1,367.27), and one final
21 installment of ONE THOUSAND THREE HUNDRED SIXTY-SEVEN DOLLARS AND
22 THIRTY-FOUR CENTS ($1,367.34). Monthly payments for the months
23 of October, November and December shall be payable upon execution
24 of this agreement, and all subsequent payments shall be paid
25 on or before the 5th day of each succeeding month.
26 3. Term. This agreement shall cover the period from
27 October 1, 1985, through June 30, 1986.
28 4. Use of Funds. The funds paid to Service Organization
1 shall be used by it solely for the purpose set forth in Paragraph
2 1(b) of this agreement and in accordance with the budget
3 submitted to the City. A variation in the itemization of costs,
4 as set forth in the proposed budget, not to exceed ten percent
5 (10%), shall be allowed, provided the prior written approval of
6 the Director of Parks, Recreation and Community Services of City
7 is obtained. At the end of the term, all unexpended funds shall
8 be returned to City by Service Organization.
9 5. Accounting. Prior to the final payment under this
10 agreement, and at such other times as may be requested by the
11 City Administrator or Director of Finance of City, the Service
12 Organization shall submit to the City Administrator, with a copy
13 to the Director of Finance, an accounting of the proposed and
14 actual expenditures of all revenues accruing to the organization
15 for the fiscal year ending June 30, 1986. Financial records
16 shall be maintained by Service Organization in accordance with
17 generally accepted accounting principles, in a manner which
18 permits City to trace the expenditures of the funds. All books
19 and records of Service Organization are to be kept open for
20 inspection at any time during the business day by the City or its
21 officers or agents.
22 6. Services Available to Residents. The services of
23 Service Organization shall be made available to residents and
24 inhabitants of the City of San Bernardino. No person shall be
25 denied service because of race, color, creed, or sex. Service
26 Organization shall have and comply with Affirmative Action
27 guidelines in its employment practices.
28 7. Approval of City of any Charges. City reserves the

1 right to require Service Organization to obtain the prior written
2 approval of City of any charges or fees to be charged by Service
3 Organization, and of any rules and regulations governing the
4 services.
5 8. Application for Other Funding. Service Organization
6 must apply for funds from other sources. Evidence of the
7 application shall be made available to City prior to any
8 consideration for further funds for the next fiscal year.
9 Receipt of any revenue from such other sources during this fiscal
10 year must be reported immediately to the Director of Parks,
11 Recreation and Community Services.
12 9. Temporary Withholding. The Director of Parks,
13 Recreation and Community Services, with the concurrence of the
14 Mayor and Common Council, is authorized to temporarily withhold
15 or terminate the payment of funds to Service Organization when
16 the Director determines that any violation of the agreement has
17 occurred. Funds shall be withheld until the violation is
18 corrected to the satisfaction of the Director and Mayor and
19 Common Council.
20 10. Hold Harmless. Service Organization agrees to
21 indemnify and save harmless the City and its employees and agents
22 from all liabilities and charges, expenses (including counsel
23 fees), suits or losses, however occurring, or damages arising or
24 growing out of the use or receipt of funds paid under this
25 agreement, and all operations under this agreement. Payments
26 under this agreement are made with the understanding that the
27 City is not involved in the performance of services or other
28 activities of Service Organization. Service Organization and its

1 employees and agents are independent contractors and not
2 employees or agents of City.

11. Standards. Service Organization agrees to comply with
4 the provisions of "Section 1. Recommendations", of a portion of a
5 report entitled "Report of the Special Council Subcommittee for
6 Social Service Funds" dated and adopted on February 18, 1975, and
7 on file in the Office of the City Clerk of City, a copy of which
8 has previously been provided to Service Organization.

12. Termination. City shall have the right to terminate
10 this agreement and any funding of Service Organization for any
11 reason by mailing a ten day written notice to Service
12 Organization and this agreement shall terminate ten days after
13 the mailing of such notice.

13. Amendment. This agreement may be amended or modified
15 only by written agreement signed by both parties and failure on
16 the part of either party to enforce any provision of this
17 agreement shall not be construed as a waiver of the right to
18 compel enforcement of any provision or provisions.
19
14. Assignment. This agreement shall not be assigned by
20 Service Organization without the prior written consent of City.
21
15. Notices. All notices herein required shall be in
22 writing and delivered in person or sent by certified mail,
23 postage prepaid, addressed as follows:

THIS AGREEMENT is entered into effective as of October 1,
1985, at San Bernardino, California, between the City of San
Bernardino, a municipal corporation, referred to as "City", and
MERRI-MIXERS, a nonprofit community service organization,
referred to as "Service Organization".
City and Service Organization agree as follows:
1. Recitals.
(a) Service Organization has requested financial
assistance from City for the fiscal year 1985-1986.
(b) Service Organization represents that the
expenditures authorized by this agreement are for valid municipal
public purposes. The purposes are to provide transportation for
the ambulatory developmentally disabled adult with growth
promoting experiences designed to achieve normalization and to
develop each individual's capacity through community interaction,
development of motor skills and social awareness, and
administration of the program.
2. Payment. City shall pay to Service Organization the
total sum of TWO THOUSAND TWO HUNDRED TWENTY-FIVE DOLLARS AND
TWENTY-FIVE CENTS ($2,225.25) for the term of this agreement,
payable in nine monthly installments of TWO HUNDRED FORTY-SEVEN
DOLLARS AND TWENTY-FIVE CENTS ($247.25). Monthly payments for
the months of October, November and December shall be payable
upon execution of this agreement, and all subsequent payments
shall be paid on or before the 5th day of each succeeding month.
3. Term. This agreement shall cover the per iod from
1 October 1, 1985, through June 30, 1986.

FRAZEE COMMUNITY CENTER, a nonprofit community services
organization, referred to as "Service Organization".
Ci ty and Service Organization agree as follows:
1. Recitals.
(a) Service Organization hasrequesbed financial
assistance from City for the fiscal year 1985-1986."
(b) Service Organization represents that the
expenditures authorized by this agreement are for valid municipal
publ ic purposes. The purpose' is to provide emergency ass istance
of food, clothing, medical and referrals to individuals in dire
need.
2. Payment. City shall pay to Service Organization the
total sum of FIVE THOUSAND TWO HUNDRED FIFTY DOLLARS AND ONE CENT
($5,250.01), for the term of this agreement, payable in eight
monthly installments of FIVE HUNDRED EIGHTY-THREE DOLLARS AND
THIRTY-THREE CENTS ($583.33), and one final installment of FIVE
HUNDRED EIGHTY~THREE DOLLARS AND THIRTY-SEVEN CENTS ($583.37).
Monthly payments for the months of October, November and December
shall be payable upon execution of this agreement, and all
subsequent payments shall be paid on or before the 5th day of
each succeeding month.

3 THIS AGREEMENT is entered into effective as of October 1,

6 ROLLING START, INC., a nonprofit community services organization,
7 referred to as "Service Organization".
8 City and Service Organization agree as follows:
9 1. Recitals.

(a) Service Organization has requested financial
11 assistance from City for the fiscal year 1985-1986.

(b) Service Organization represents that the
13 expenditures authorized by this agreement are for valid municipal
14 public purposes. The purposes is to provide the following
15 services to the deaf: a relay service, information and a
16 referral service, with up to date information; training on use of
17 T.D.D. and use of sign language.
18 2. Payment. City shall pay to Service Organization the
19 total sum of FIVE THOUSAND SIX HUNDRED NINETY-FIVE DOLLARS AND
20 FIFTY-ONE CENTS ($5,695.51), for the term of this agreement,
21 payable in eight monthly installments of SIX HUNDRED THIRTY-TWO
22 DOLLARS AND EIGHTY-THREE CENTS ($632.83), and one final
23 installment of SIX HUNDRED THIRTY-TWO DOLLARS AND EIGHTY-SEVEN
24 CENTS ($632.87). Monthly payments for the months of October,
25 November and December shall be payable upon execution of this
26 agreement, and all subsequent payments shall be paid on or before
27 the 5th day of each succeeding month.

assistance from City for the fiscal year 1985-1986.
(b) Service Organization represents that the
expenditures authorized by this agreement are for a valid
mcnicipal public purpose. The purpose _is to inform senior
citizens of the benefits and services available to them and to
provide a center where they may meet to participate in
recreation, educational and other programs.
2. Payment. City shall pay to Service Organization the
total,sum of SIX THOUSAND ONE HUNDRED FIFTY-SIX DOLLARS AND
SEVENTY-SIX CENTS ($6,156.76), for the term of this agreement,
payable in eight monthly installments of SIX HUNDRED EIGHTY-FOUR
DOLLARS AND EIGHT CENTS ($684.08), and one final installment of
OF SIX HUNDRED EIGHTY-FOUR DOLLARS AND TWELVE CENTS ($684.12).
Monthly payments for the months of October, November and December
shall be payable upon execution of this agreement, and all
subsequent payments shall be paid on or before the 5th day of
each succeeding month.
3. Term. This agreement shall cover the period from

14 9. Temporary Withholding. The Director of Parks,
15 Recreation and Community Services, with the concurrence of the
16 Mayor and Common Council, is authorized to temporarily withhold
17 or terminate the payment of funds to Service Organization when
18 the Director determines that any violation of the agreement has
19 occurred. Funds shall be withheld until the violation is
20 corrected to the satisfaction of the Director and Mayor and
21 Common Council.
22 10. Hold Harmless. Service Organization agrees to
23 indemnify and save harmless the City and its employees and agents
24 from all liabilities and charges, expenses (including counsel
25 fees), suits or losses, however occurring, or damages arising or
26 growing out of the use or receipt of funds paid under this
27 agreement, and all operations under this agreement. Payments
28 under this agreement are made with the understanding that the

A G R E E MEN T
(Community Service Organization)
3 THIS AGREEMENT is entered into effective as of October 1,
4 1985, at San Bernardino, California, between the City of San
5 Bernardino, a municipal corporation, referred to as "City"-, and
6 CASA RAMONA, INC., a nonprofit community service organization,
7 referred to as "Service Organization".
8 City and Service Organization agree as follows:
9 1. Recitals.

(a) Service Organization has requested financial
11 assistance from City for the fiscal year 1985-1986.
12
(b) Service Organization represents that the
13 expenditures authorized by this agreement are for a valid
14 municipal public purpose. The purpose is to operate and maintain
15 an emergency food and medical program.
16 2. Payment. City shall pay to Service Organization the
17 total sum of FIVE THOUSAND EIGHT HUNDRED NINETY-THREE DOLLARS AND
18 FIFTY CENTS ($5,893.50), for the term of this agreement, payable
19 in eight monthly installments of SIX HUNDRED FIFTY-FOUR DOLLARS
20 AND EIGHTY-THREE CENTS ($654.83), and one final installment of
21 SIX HUNDRED FIFTY-FOUR DOLLARS AND EIGHTY-SIX CENTS ($654.86).
22 Monthly payments for the months of October, November and December
23 shall be payable upon execution of this agreement, and all
24 subsequent payments shall be paid on or before the 5th day of
25 each succeeding month.
26 3. Term. This agreement shall cover the period from
27 October 1, 1985, through June 30, 1986.
28 4. Use of Funds. The funds paid to Service Organization
1 shall be used by it solely for the purpose set forth in Paragraph
2 1(b) of this agreement and in accordance with the budget
3 submitted to the City. A variation in the itemization of costs,
4 as set forth in the proposed budget, not to exceed ten percent
5 (10%), shall be allowed, provided the prior written approval of
6 the Director of Parks, Recreation and Community Services of City
7 is obtained. At the end of the term, all unexpended funds shall
8 be returned to City by Service Organization.
9 5. Accounting. Prior to the final payment under this
10 agreement, and at such other times as may be requested by the
11 City Administrator or Director of Finance of City, the Service
12 Organization shall submit to the City Administrator, with a copy
13 to the Director of Finance, an accounting of the proposed and
14 actual expenditures of all revenues accruing to the organization
15 for the fiscal year ending June 30, 1986. Financial records
16 shall be maintained by Service Organization in accordance with
17 generally accepted accounting principles, in a manner which
18 permits City to trace the expenditures of the funds. All books
19 and records of Service Organization are to be kept open for
20 inspection at any time during the business day by the City or its
21 officers or agents.
22 6. Services Available to Residents. The services of
23 Service Organization shall be made available to residents and
24 inhabitants of the City of San Bernardino. No person shall be
25 denied service because of race, color, creed, or sex. Service
26 Organization shall have and comply with Affirmative Action
27 guidelines in its employment practices.

5 report entitled "Report of the Special Council Subcommittee for
6 Social Service Funds" dated and adopted on February 18, 1975, and
7 on file in the Office of the City Clerk of City, a copy of which
8 has previously been provided to Service Organization.

12. Termination. City shall have the right to terminate
10 this agreement and any funding of Service Organization for any
11 reason by mailing a ten day written notice to Service
12 Organization and this agreement shall terminate ten days after
13 the mailing of such notice.

13. Amendment. This agreement may be amended or modified
15 only by written agreement signed by both parties and failure on
16 the part of either party to enforce any provision of this
17 agreement shall not be construed as a waiver of the right to
18 compel enforcement of any provision or provisions.
19
14. Assignment. This agreement shall not be assigned by
20 Service Organization without the prior written consent of City.
21
15. Notices. All notices herein required shall be in
22 writing and delivered in person or sent by certified mail,
23 postage prepaid, addressed as follows:

19 total sum of SIXTEEN THOUSAND EIGHT HUNDRED THIRTY-ONE DOLLARS
20 AND EIGHTY-TWO CENTS ($16,832.82), for the term of this
21 agreement, payable in eight monthly installments of ONE THOUSAND
22 EIGHT HUNDRED SEVENTY DOLLARS AND TWENTY CENTS ($1,870.20), and
23 one final installment of ONE THOUSAND EIGHT HUNDRED SEVENTY
24 DOLLARS AND TWENTY TWO CENTS ($1,872.22). Monthly payments for
