RESOLUTION NO. to -1/-9'7
A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF A PORTION OF WALNUT AVENUE BETWEEN OHIO AVENUE AND
THE NORTH LINE OF THE RANCHO MUSCUPIABE,

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
5 SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. That the Mayor and Common Council of the Ci ty of
7 San Bernardino hereby declares its intention to order the vacation of
8 a portion of Walnut Avenue between Ohio Avenue and the North line of the
9 Rancho Muscupiabe, in said City, which said portion more particularly
10 is descri bed as fo 11 ows :
11 That portion of Walnut Avenue lying between Block 54 and
Block 48 of the Irvington Land and Water Company Subdivision
12 as'de1ineated on the Map thereof recorded in Book 1 of
Records of Survey, page 32, records of the County Recorder,
13 County of San Bernardino, State of California, more parti-
cularly described as follows:

Commencing at the Southeast corner of said Block 54; thence
North a distance of 4.00 feet to a point in a line which
is parallel with and 44.00 feet North of and measured at
right angles to the centerline of Ohio Avenue, said point
being also the North line of Ohio Avenue; thence West
along said parallel line a distance of 2.00 feet to a
point in a line which is parallel with and 32.00 feet West
of and measured at right angles to the centerline of
Walnut Avenue, said point being the True Point of Beginning;
thence North along said parallel line to the Northerly line
of the Rancho Muscupiabe as shown on said Record of Survey;
thence Southeasterly along said North line a distance of
62 feet, more or less, to the Northwest corner of said
B'ock 48; thence South along the West line of said Block
48; thence South along the West line of said Block 48 to
a point in a line which is parallel with and 44.00 feet
North of and measured at right angles to the centerline
of said Ohio Avenue; thence West along said parallel
line a distance of 62 feet, more or less, to the True Point
of Beginning.

Containing 1.68 acres, more or less.

SECTION 2. That the Mayor and Common Council of the City of

San Bernardino, in vacating the above described portion of said
street, elects to proceed under and in accordance with the the pro-
28
visions of the "Street Vacation Act of 1941," being Division 9, Part
2 3, of the Streets and Highways Code of the State of California.

SECTION 3. That the hour of 2:30 p.m., on the 17th day of November,
4 1980, in the Council Chamber of the City Hall, San Bernardino,
5 California, be, and the same hereby is fixed as the time and place
6 when and where all persons interested in or objecting to the proposed
7 vacation may appear before the said Mayor and Common Council and offer
8 evidence in relation thereto. For further particulars as to the pro-
9 posed vacation of the hereinbefore described portion vacation of the
10 hereinbefore described portion of said street, reference is made to
II that certain map marked "Plan No. 5868" approved October 27, 1980, on
12 file in the office of the City Clerk of said City.

Section 4. That the City Engineer of the City of San Bernardino
hereby is directed to cause Notices of Street Vacation to be posted
as required by the Street Vacation Act of 1941.
SECTION 5. That the City Clerk shall certify to the adoption
of this Resolution of Intention and shall cause the same to be published

for 3 successive days in The San Bernardino Sun Telegram, a newspaper
published and circulated in the City of San Bernardino, prior to the
date of the above public hearing.
I HEREBY CERTIFY that the foregoing resolution was duly adopted
by the Mayor and Common Council of the City of San Bernardino at
