Po - --f/.,j/i'" A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN EASEMENT FORM FOR DEDICATION OF SEWERS IN TRACT 11,537, AT STERLING SCHOOL SITE. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Authorization is hereby granted to execute, on behalf of the City, an Easement Form for Dedication of Sewers in Tract 11,537, at the Sterling School Site, to the East San Bernardino County Water District, a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length herein. SECTION 2. The City of San Bernardino agrees to hold the State of California harmless from any liability which may result in the event the right of way is not clear as certified, the City of San Bernardino agrees that, at the request of the State, it will assume full responsibi- lity for the conduct of the defense or provide such assistance as the State and all costs in connection with the defense. WITNESSETH FIRST: That the Owner for and In consideration of the acceptance by the County Board of Supervisors, of the public rights of way offered for dedica~ tion in Tract No. 11537 , hereby agrees, at his (its) own cost and expense, to furnish al I equipment, labor, and material necessary, and before the expira- tion of two years from the date hereof, to perform and complete in a good and ~ workman I ike manner al I work and improvements, In said tract, according to Plans and Profi les approved /0 .. IS -8'0 and Standard Drawings and Specifications, , and to do al I the work incidental thereto, which said Plans, Profi les, Standard Drawings and Specifications are on fi Ie in the office of the County Engineer and are hereby made a part of this agreement. That said work and improvements shal I be done under the supervision of, and to the satisfaction of said County Engineer and shal I not be deemed complete unti I approved and accepted as completed by the Board of Supervisors of the County. That the estimated cost of said work and improvements is the sum of SIXTY FIVE THOUSAND AND NO/IOO----------------- Dollars ($ 65,000.00 ). SECOND: The County, the County Engineer and al I officers and employees of the County Transportation Department shall not be answerable or accountable in any manner for any loss or damage that may happen to the work or any part thereof; for any of the materials or other things used or employed in performing the work; or for any injury to any person or persons, either workmen or anyone employed by him; against al I of which injuries or damages to persons and property of the Owner or his contractor having control over such work must properly guard. -1- RB 6/16/76 . ~ .. f' THIRD: The Owner shal I indemnify and save harmless the County, the \ County Engineer and al I officers and employees of the County Transportation Department from al I suits or actions of every name, kind, or description brought for, or on account of any injuries or damages received or sustained by any person or persons, by or from the Owner, his contractor or agents or employees of them, in the performance of the work required hereunder. FOURTH: It is further agreed that said Owner wi I I at al I times from the acceptance by the Board of Supervisors of the public rights of way offered for dedication in said Tract, up to the completion and acceptance of said work and improvements by said Board, give good and adequate warning to the traveling public of each and every defective or dangerous condition existent on said rights of way and wi I I protect the traveling public from such defective or dangerous conditions, That it is understood and agreed that unti I the completion of al I the improvements herein agreed to be performed, any proposed road rights of way not accepted as improved shall not be accepted into the County Maintained Road System and said Owner may, with approval of the County Engineer, close al I or a portion of any street whenever it is deemed necessary to protect the traveling public during the making of the improvements herein agreed to be made. And the Owner hereby agrees to pay for such inspection of the work and improvements as may be required by the County. FIFTH: It is further agreed by the parties hereto, that the Owner wi I I furnish two good and sufficient bonds in accordance with Section 11612, Business and Professions Code, State of California. Such bonds may be in one or more of the fol lowing forms: (I) a cash deposit, (2) a bond by one or more duly authorized corporate sureties, or (3) an instrument of credit from one or more financial institutions subject to regulation by the state or federal government, pledging that the funds necessary to meet the performance are on deposit and guaranteed for payment, and agreeing that the funds designated by the instrument shal I become trust funds for the purposes as above set forth. -2- RB 6/16/76 , " . ^ " . .~ Said bonds shal I be in the amounts and for the fol lowing purposes: (a) an amount equal to the total estimated cost of the improvement, conditioned upon the faithful performance of the agreement, and (b) an additional amount equal to one-half the total estimated cost of the improvement securing payment to the contractor, his subcontractors, and to persons renting equipment or furnishing labor or materials to them for the improvements. Should the sureties on said bond, or either of them become insufficient, said Owner agrees to renew said bond with good and sufficient sureties, within ten days after receiving notice that said sureties are insufficient. Bonds as herein required shal I remain in full force and effect unti I al I work is completed and accepted by the County. SIXTH: It is further agreed by and between the parties hereto, including the surety or sureties on the bonds attached to this agreement, that in the event it is deemed necessary to extend the time of completion of the work contemplated to be done under this agreement, said extension may be granted by the Board of Supervisors and shal I in no way effect the validity of this agreement or release the surety or sureties on the bonds attached hereto. It is understood, in the event of such extension of time of completion of the work required hereunder, that the County may re-estimate the value of uncompleted work based upon the current estimate unit prices and if deemed necessary, to adjust bond amounts accordingly.
