3 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING A FEE
SCHEDULE FOR THE USE OF PUBLIC RECREATION BUILDINGS, FACILITIES,
4 AND SWIMMING POOLS; AND REPEALING RESOLUTION NO. 13161.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Pursuant to City Ordinance No. 3326, Section 9,

a fee schedule for the use of public and recreation buildings,
9
facilities, and swimming pools is hereby established.

SECTION 2. Policy: Public parks and recreation buildings
II and swimming pools, under the jurisdiction of the Park and
12 Recreation Department are public property and as such are
13 available for use by any person or persons in accordance with the
14 following specifications and as deemed appropriate by the
15
Director.

SECTION 3. Procedure: The facilities and equipment shall
17 be used only for those meetings and activities pursuant to City
18 Ordinance No. 3326. Any person, persons, or groups of persons
19 desiring the use of any facilities or equipment shall make
20 application on forms provided by the Park and Recreation Depart-
21 ment and shall provide such additional information as may be
22 required to assure compliance with City Ordinance No. 3326.

SECTION 4. Cancellations: Cancellations of meetings and
24 activities may occur twenty-four (24) hours prior to scheduled
25 use of facilities or equipment without forfeiting any fees and/or
26 deposits collected by the Department. In the event of cancella-
27 tion by the Department, notice will be given as far in advance
28 of the scheduled use as is possible under the circumstances.
SECTION 5. Priority of Use: The priorities of use shall
2 ,be in the following order:
3 (a) Park and Recreation Department sponsored activities.
4 (b) Park and Recreation Department co-sponsored activities
5 and tax-supported groups.
6 (c) civic and social groups (resident or non-profit).
7 (d) civic and social groups (non-resident or commercial).
8 SECTION 6. Classification of Groups and Fee Structure:
9 For the purpose of assessing fees, all individuals or groups shall
10 be classified pursuant to the herein listed classifications:
11 (a) Department sponsored groups and/or activities are
12 those groups and activities organized and conducted by the Park
13 and Recreation Department. Groups or activities under this
14 classification shall pay no fee for the use of facilities.
15 (Examples: girls' and women's softball, teen splash nites, dance~
16 youth clubs, senior citizens, slim and trim, etc.)
17 (b) Departmental co-sponsored groups and activities are
18 those community groups and activities self governed, privately
J9 organized and of a recreational nature which may be brought under
20 the sponsorship of the Park and Recreation Department; e.g., tap
21 and ballet, guitar lessons, singing sixties, etc.; and
22 tax-supported groups and activities are those organized and
23 conducted by the school district and governmental agencies; e.g.,
24 adult education, lip reading, County Agricultural Extension
25 Service, etc. Groups in this classification shall pay no fee.
26 (c) Civic and social groups which are non-profit
27 organizations or corporations and can clearly demonstrate their
28 non-profit status and whose membership is made up of at least

fifty-one percent (51%) of City residents shall pay a fee equal to

fifty percent (50%) of the stated rate.
(Examples: Women's Club,
3 Navy Mothers, Friendship Club, Lens & Shutter Club, Chess Club,
4 AARP, YWCA, YMCA, etc.)

(d) Civic and social groups which are commercial in
6 nature and do not have non-profit corporation or organization
7 status or have a membership of less than fifty-one percent (51%)
8 of City residents, shall be assessed fees equal to one-hundred
9 percent (100%) of the rate.

(e) Rates and fees determined in accordance with (a), (b),
11 (c) and (d) hereinabove shall include all charges including those
12 made for additional personnel costs provided for herein. The
13 percentage factor, if any, shall be applied to the total rate.

SECTION 7. Refundable Deposit: Refundable deposits held
27 pursuant to this resolution may be refunded in full or in part
28 within fourteen (14) days after completion of the use period.

a signed building inspection and release form from the appropriatel

facility manager, and delivered this executed release form to the i
4 Park and Recreation Department. Deductions for any damages to

5 the facility or for clean up and repairs shall be made from the
6 said deposit by City,

SECTION 8. Utilization of City Employees: During any
8 event when a City employee or employees are required to be presen
9 for the purposes of clean up, monitoring, etc., a fee shall be
10 paid equivalent to the total cost of said employees.

SECTION 9. Resolution No. 13161 is hereby repealed.
