RESOLUTION NO.
RESOLUTION OF THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO,
CALIFORNIA, CALLING FOR SEALED PRO-
POSALS FOR THE INSTALLATION OF
PROPOSED IMPROVEMENT
(ASSESSMENT DISTRICT NO. 5861)
WHEREAS, this Mayor and Common Council have
adopted a Resolution of intention, Resolution No.!o~,
on Octo~er 6, 1980, declaring their intention to order
the acquisition and installation of a proposed improvement
as more particularly described and set forth in said
Resolution of Intention; and
WHEREAS, as authorized and directed in said
Resolution of Intention, the Engineer of Work has duly
prepared and presented an Engineer's Report in the form
and manner required by the Municipal Improvement Act of
1913, Division 12 of the Streets and Highways Code; and
WHEREAS, it is in the public interest that bids
for said works and improvements be taken at such time as
specified herein.
NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED
AND ORDERED BY THE l-iAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO, AS FOLLOWS:

Section 1. The City Clerk is hereby directed
to publish once a week for two (2) weeks in the San
Bernardino Sun-Telegram, a newspaper of general circulation,
published in the City, a notice inviting sealed proposals
or bids for the installation of said improvements and
referring to the plans and specifications on file in the
office of the City Clerk, the first publication of such
notice shall be at least fourteen (14) days prior to the
time fixed for the opening of bids.
Section 2. Said notice shall require that all
proposals or bids shall be accompanied by a cashier's check
or a certified check amounting to ten percent (10%) of the
bid, payable to the order of the City Clerk, or by a bond
for that amount and so payable, signed by the bidder and
two sureties, who shall justify before any officer competent
to administer an oath, in double that amount and over and
above all statutory exemptions or by a corporate surety
bond to the satisfaction and approval of the superintendent
of streets. The amounts so posted shall be forfeited to
the City in case the bidder depositing the same does not,
within two (2) days after written notice that the contract
has been awarded to him, enter into a contract with the
City.

Section 3. Said sealed proposals or bids shall
be delivered to the Engineer of Work on or before 11:00
O'clock A.M. on the 21st day of November, 1980, at which
time said bids will be publicly opened, examined and
declared. Said bids will be referred to and considered
by this Mayor and Common Council at their meeting at
2:30 O'clock P.M. on December 1, 1980.
