EXECUTION OF AN AGREEMENT WITH THE UNITED STATES POSTAL SERVICE

SECTION l. The City Administrator of the City of San

Bernardino is hereby authorized and directed to execute on

behalf of said City an agreement with the United States Postal

Service relating to the operation of a postal contract station,

a copy of which is attached hereto, marked Exhibit "An and

incorporated herein by reference as fully as though set forth

at length.

used to provide service, usually in small communities. .....hen service by a
manned postal facility has been discontinued or otherwise been deemed
impractical. Community post offices usually assume the identity of the
community in which they are located for address purposes.
1. LABOR LA W
(a) The provisions requiring specified hourly rate of pay contained in the Fair
Labor Standards Act of 1938 as amended are in most instances variously
applicable to employees of the contractor and any subcontractors under this
senice contract. Generally, such employees must be paid the minimum wages
pro..ided for by section 6(a){ I) or (b) of tile J-'air Labor Standards Act of 1938.
(b) It'is the policy of the Postal Service that non-exempt contractors receive no less
that the Fair labor Standard.. Act minimum .....age for work they perfonn. The
Postal Senice will reject any offer by a non-exempt offeror which does nO!
pro\'ide for compensation at or above the minimum wage for the num~r of
hours of postal service .....ork to~ performed.
(c) The minimum hourly .....age rales required by the Fair labor Standards Act are

(a) Offerors are expected to examine the Specifications. Schedule, and all
instructions. Failure to do so .....ill be at the offerors risk.
(b) Each offeror shall furnish the information required by the solicitation and shall
sign the offer. Erasures IX other changes must be initialed by the person signing
the offer. Offers signed by an agent are to be accompanied by evidence of his
authorily. unless such evidence has been previously furnished to the issuing

4. EXPLANATION TO OFFERORS

(a) Offers and modifications of offers or withdrawals thereof received at lhe office

(c) Notwilhslanding the abovt, a modificalion of 019' otherwise successful offel
which makes its tenus more fa..orable to the Postal Service will be considered
at any time it is received and may be accepted. if

9. AWARD OF CONTRACT

the successful offeror within the time for acceptance specified in the offer shall

10. PROTESTS
Protests will be considered only .....hen submined in ac.:ordance .....ith the procedures
and time limitations set forth in the Postal Contracting Manual. paragraph
2-407.8.

General information regarding the requirements of the Walsh-Healy Public
Conlracts Act (41 C,S.c. 35-45). the Contract Work Hours and Safet)" Standards

information should include the solicilation number, the name and address of the

In the e\'Cnl of an inconsistency between provisions of this solicitation, the
inconsislency shall be resoh'ed by giving precedence in the following order:
(a) Solicitalion Instructions and Conditions; (b) General Provisions; (c) other
provisions of the contract, whether incorporated by reference or other.....ise; and (d)
the specifications.
