S?tl- ~~ 2 RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING THE EXISTENCE OF A PUBLIC NUISANCE FOR 1980 WEED ABATEMENT. 3 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 4 OF SAN BERNARDINO AS FOLLOWS: 5 SECTION l. That there now exists in the City of San 6 Bernardino, on the lots and parcels of property herein described, 7 a public nuisance consisting of the existence of weeds, dry grass, 8 dead trees, tin cans, abandoned asphalt or concrete, rubbish, 9 refuse, and waste materials, being situated upon sidewalks, vacant 10 II 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I lots, parkways and other property, and that the existence of said : I nuisance creates an unhealthy and unsanitary condition and a fire hazard to the inhabitants of said City, and the removal thereof is necessary to protect the health and safety of the inhabitants of said City. SECTION 2. That the Street Superintendent shall cause a notice to be given in regard to all property on which or in front of which said nuisance exists which notice shall be substantially in the form prescribed in Section Five of Ordinance No. 2022. sucH I ! Inotices shall be addresses appear mailed to the property owners as their names and on the last equalized assessment roll of the County of San Bernardino, or as they may be known to the Street Superintendent. As an alternative to mailing the notices in the manner and form prescribed above, such notices may be COnSPiCUOUSl~ posted on or in front of the property on which, or in front of which, said nuisance exists. Said notices shall be posted or mailed at least ten (lO) days prior to the time for hearing or objections by the Mayor and Common Council of the City of San Bernardino, and the date of said hearing of said objections is I I :. r 1 hereby set for the 7th day of April, 1980, at the hour of 2:00 p.m. 2 in the Council Chambers of City Hall located at 300 North "D" 3 Street, San Bernardino, California. 4 SECTION 3. That any property owner shall have the right to 5 have any such nuisance removed at his own expense, provided the 6 same is done within ten (lO) days after the posting or mailing of 7 the "Notice to Clean Premises", and to the satisfaction of the 8 Chief Engineer and Street Superintendent. 9 SECTION 4. Upon the conclusion of said hearing, the Common 10 Council may, by resolution, order the Street Superintendent to 11 abate said nuisance, and the entire cost of abating assessed 12 against each lot or portion of the lot, all of which said assess- 13 ments shall constitute special assessments, and under the pro- 14 .visions of Ordinance No. 2022 of said City shall entitle said City i ,to a lien thereon until paid. 15 16 SECTION 5.
