GLENN, AND THE CITY OF SAN BERNARDINO RELATING TO THE ASSIGNMENT OF A LEASE FOR PREMISES LOCATED AT l700 WEST HIGHLAND 4 AVENUE, SAN BERNARDINO, CALIFORNIA. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 6 7 SECTION l. The Mayor of the City of San Bernardino is 8 hereby authorized and directed to execute on behalf of said City 9 an agreement among Highland Land Company, William B. Glenn, and 10 the City of San Bernardino relating to the assignment of a lease II for premises located at l700 West Highland Avenue, San Bernardino, 12 California, a copy of which is attached hereto, marked Exhibit 13 "Au and incorporated herein by reference as fully as though 14 set forth at length. 15 I HEREBY CERTIFY that the foregoing resolution was duly 16 adopted by the Mayor and Common Council of the City of San 17 Bernardino at on the :3d a 11101" Of! GLENN, an individual, l3273 Mariposa Road, Victorville, 6 California 92392, referred to as "Assignee", and the CITY OF SAN 7 BERNARDINO, a municipal corporation, referred to as "Lessee". 8 1. Recitals. 9 (a) Assignor and Lessee entered into a lease on April 10 25, 1978, relating to the lease of certain premises located at 11 1700 West Highland Avenue, San Bernardino, California. 12 (b) Assignor and Lessee extended the term of the 13 lease by a First Amendment to Lease dated October 8, 1979, and 14 Second Amendment to Lease dated October 8, 1979. A Third Amend- 15 ment to Lease was authorized by the Mayor and Common Council on 16 February 6, 1980, by Resolution No. 80-5l. The lease and these 17 amendments are referred to as "the lease". 18 (c) The lease is by its terms assignable, sUbject to 19 the consent of the Lessee, and Assignee desires to acquire 20 the rights and is willing to assume the obligations of Assignor. 21 (d) Lessee consents to the assignment. 22 2. Assignment. Assignor assigns to Assignee all of its 23 interest in the lease, as amended. 24 3. Performance of All Obligations.
