STAFF REPORT
SUBJECT
Resolution of the City of San Bernardino rescinding authorization to execute a contract in the
amount of $391,207 with ICI Solutions of Chandler, Arizona to provide upgraded hardware and
replacement software for the Police Department's document imaging system.
BACKGROUND
On 11-21-01, the Mayor and Common Council ratified Resolution No. 2001-351, which
authorized the Mayor to execute a contract in the amount of $391,207 with ICI Solutions of
Chandler, Arizona to provide upgraded hardware and replacement software for the Police
Department's document imaging system. Following this action, the proposed contract was
mailed to ICI Solutions for their final review and signing. As of 12-18-01, to the best of our
knowledge, this contract has not been signed by either ICI Solutions or the City of San
Bernardino to become executed.
On 12-10-01, Matt Wiseman, Account Manager with ICI Solutions, called Public Safety
Programmer Michael Eckley. Mr. Wiseman advised Eckley that ICI Solutions' parent company,
Law Cypress, had filed bankruptcy earlier that day. Mr. Eckley was informed that Mr. Wiseman
and other ICI Solutions employees had been laid off and were now unemployed.
Representatives from the Police Department, Information Services, and the City Attorney's
Office have discussed the impact of Law Cypress filing bankruptcy would have on the City's
proposed contract with ICI Solutions. The outcome was a decision to protect the City's best
interests by not executing the contract approved in Resolution No. 2001-351 and moving forward
at the earliest possible date to have the Mayor and Common Council rescind this authorization.
On 12-11-01, Public Safety Programmer Eckley faxed notification to Donald Jones, Vice
President and General Manager of ICI Solutions informing them that the City had cancelled all
negotiations with ICI Solutions for the purchase of a document imaging system. This
notification was mailed to them on 12-12-01 and Mr. Eckley also provided oral notice to Mr.
Wiseman that same day.
FINANCIAL IMPACT
The rescinding of authorization to execute a contract with ICI Solutions will have no impact on
the City's General Fund. This action will free up police grant and General Fund monies to make
them available to fund a replacement document imaging system with another vendor.
RECOMMENDATION
Adopt resolution.
