Synopsis of Previous Council Action:
7/9/01 Allocation of $50,000 in the 2001/02 Capital Improvement Program (CIP) for 13th Street and
"0" Street Cross Outter and Improvements (Account No. 248-368-5504-7204).
10/15/01 Reject all bids submitted for the installation of cross gutter & improvements at 13'" Street &
"0:' Street, revise plans and specifications, and re-advertise for bids.
Recommended Motion:
I) Adopt Resolution.
2) That the Mayor and Common Council authorize the Director of Finance to amend the FY 2001102
budget to transfer $15,000 from Account No. 248-368-5504-7257 (Town Creek Tunnel Storm Drain
Repair) to Account No. 248-368-5504-7204 by (13th Street and "0" Street C~Outter and

STAFF REPORT
Subject:
Resolution awarding contract to Malton Construction for street and storm drain improvements
at 131h Street and "G" Street, per Plan No. 10220-A and authorization for the Director of
Finance to amend the FY 2001/02 budget.
Background:
This project consists of removal, repair, and installation of the street sections and cross gutter
on 13th Street and "G" Street at the intersection. This section of road experiences significant
vehicular traffic and the original pavement sections have deteriorated. A new cross gutter is
needed to allow a greater volume of storm water to cross this intersection and improve the
cross slope. This intersection is currently in poor condition, which is why staff is proposing to
move forward with this project as soon as possible.
This project was initially designed to include the reconstruction of adjacent ramps to meet
current Americans with Disabilities Act standards. The project was bid and the apparent low
bid far exceeded the construction cost budgeted for the project, which was developed based
only on the cross gutter and intersection improvements.
Subsequently, staff recommended, and the Council approved, rejecting all bids and redesigning
and rebidding the project to more closely meet the project budget constraints. The current
apparent low bid falls reasonably close to the original estimated construction cost. However,
the design, contract administration, inspection costs, and the costs associated with rebidding
the project necessitate an intrafund budget transfer of $15,000.
Plan and specifications for this project are complete and the project is ready to be awarded.
The estimated project costs are as follows:
Construction Cost $44,330.00

Total $65,000.00
* Includes preliminary design costs expended in FY 00/01 in the approximate
amount 0[$10,200.

STAFF REPORT
This project was advertised locally in the San Bernardino County Sun Newspaper, Construction
Trend Newspaper, the City's web site, and with the San Bernardino Area Chamber of
Commerce. The following eight companies responded:

Based on review of the sealed competitive bids received, staff has determined that Malton
Construction, the apparent lowest bidder, has met the minimum requirements of the specifications
and bid guidelines, and therefore recommends that the Mayor and Common Council award the
referenced contract accordingly.
Financial Impact:
Funding for this project, in the amount of $50,000 was original budget in FY 2000/01 in the
Storm Drain Construction Fund. Approximately $10,200 of the funds were expended in FY
2000/01 and the remaining $39,800 was carried over into FY 2001/02. It is now estimated
$54,800 will be needed in FY2001/02 to complete this project so a budget amendment in the
amount of $15,000 is needed. In order to accommodate the design, construction, inspection,
and contract administration, staff recommends that an additional $15,000 be transferred from
Account No. 248-368-5504-7257 (Town Creek Tunnel Storm Drain Repair) to Account No.
248-368-5504-7204. Staff is still researching alternative design methodologies for repair of the
Town Creek Storm Drain, but it is estimated that the budget remaining will accommodate the
associated FY 2001/02 design costs. All costs incurred for this project will be charged to
Account No. 248-368-5504-7204 (13th Street and "G" Street cross gutter and improvements).
Recommendation:
Adopt Resolution.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
6 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Malton Construction, is the lowest responsible bidder for street
improvements at J3'h Street and "G" Street, per Plan No. 10220-A. A contract is awarded
9
10 accordingly to said bidder in a total amount of $44,330 with a contingency amount of $6.000
11 but such award shall be effective only upon being fully executed by both parties. All other
12 bids, therefore. are hereby rejected. The Mayor is hereby authorized and directed to execute
13
said contract on behalf of the City; a copy of the contract is on file in the office of the City
14
Clerk and incorporated herein by reference as fully as though set forth at length.

SECTION 2. This contract and any amendment or modifications thereto shall not take
16
17 effect or become operative until fully signed and executed by the parties and no party shall be
18
19
obligated hereunder until the time of such full execution. No oral agreements. amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
20
course of conduct of any party.

22 SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
23 within sixty (60) days of passage of the resolution.
