Request to continue the Resolution approving Final Map for Tentative Tract No. 14112-
located northeasterly of the intersection of Foothill Drive and Sterling Avenue.
Backl!round:
On November 7. 1990, the Planning Commission approved Tentative Tract No. 14112, a 55-
lot single family residential subdivision.
On May 18, 1994, authorization was given to extend the time limit for approval of the tentative
map. An automatic two-year extension was granted according to the provisions of Section
66452.11 of the Subdivision Map Act, which extended the approval date to May 18, 1996. An
additional extension was granted according to the provisions of Section 66452.13 of the
Subdivision Map Act, extending the approval date to May 18, 1998. The Planning
Commission approved the final extension to May 18, 1999.
On May 17, 1999, the Mayor and Common Council approved a motion to continue this item to
August 16, 1999. On August 16, 1999, the Mayor and Common Council approved a motion
to continue this item to December 7, 1999. On December 7, 1999, the Mayor and Common
Council approved a motion to continue this item to March 6, 2000. On March 6, 2000, the
Mayor and Common Council approved a motion to continue this item to June 5, 2000. On
June 5, 2000, the Mayor and Common Council approved a motion to continue this item to
September 5, 2000. On September 5, 2000, the Mayor and Common Council approved a
motion to continue this item to December 4, 2000. On December 4, 2000, this item was
continued to March 5,2001. On March 5,2001, this item was continued to June 4,2001. On
June 4,2001, this item was continued to September 4,2001. On September 4,2001, this item
was continued to December 3, 2001.
The required improvement securities and certificates of insurance will be filed prior to March
4, 2002, and the prescribed fees will be paid prior to recordation of the final map.
Additionally, the improvement and grading plans have been prepared.
The Final Map has been reviewed and was found to be substantially in compliance with the
Tentative Map and the Subdivision Map Act. The Developer is requesting an additional
continuance to "complete the necessary preparation for recording of the final map", per the
attached letter. Therefore, we recommend that the matter be continued to March 4, 2002.
Financial ImDact:
There is no financial impact to the City.
Recommendation:

The purpose of this letter is to request a go-day extension of time in which
to post bonds and record the Final Map on the above-referenced property,
Due to our need to clarify and finalize City polic:y with regard to Assessment
District finandng, as well as other Issues, we are still attemptlng lD ftnallze
our limited liability company operating agreement with the landowners for
the joint ventufl! development of the property. Accordingly, additIOnal time Is
needed. .

As your records will reflect from earlier COlTespondcnce, we are the attorneys for and are acting
on behalf of the current owners of the property known as Sterling Heights. tentative tract number
14112.
The purpose oftbis letter is to supplement our correspondence of August 16, 2001 wherein we
requested a 90 day extension in which to post the necessary bonds and complete the final map for
the recording on tentative tract number 14112. The request for extension was subsequently
granted by the City Council to December 3,2001.
As noted in the earlier correspondence, we arc in continuing negotiations with Century Homes to
finalize our joint venture. As a result of the events of September 11,2001, and fears of a slow
down in the econODlY, negotiations stalled for a period oftime. This event, coDlbined with the
continuing delay in 4pproval of the Assessment District for the project has contributed to a slow-
down in finall7~on of this project CentuIy Homes is working to resolve the current areas of
concern with the City of San Bernardino. Centuty Homes and the Wldersigned are continuing to
work to fin~1i7p. the joint venture,
My clients have advanced substantial funds to Integra Engineering for improvement plans and
other items necessary for the fina1 map, Since our meeting with you and Y oun Kiln on May 31,
2001, we have been in contact with the principals at Integra Enaineering and believe we may
proceed with the fina1ization of the map once Century Hotnes has resolved any out..ort'1J'!tling
IIlatters that it has with the City of San Bernardino concerning the Assessment District.
Therefore, we find it necessary to again request a further 90 day extension in order to complete

As you records will reflect from earlier correspondence, we me the attorneys fot and arc acting
on behalf of the current owners of the property known as Sterling Heights, tentative tract number
14112. .
The purpose of this letter is to B11PPlement our correspondence of May 14, 2001 to Michael
Grubbs, along with our meeting held with Youn Kim and you on May 31, 2001, wherein we
requested a 90 day extension in which to post the necessary bonds and complete the final map
for the recording on tentative tract number 14112. The request for extension was subsequently
granted by the City Council to September 4, 2001.
As we pointed out in our previous correspondence and at this meeting, we were in continuing
negotiations with Century Homes to fina1ize our joint venture. In the interim since that meeting,
additional problems seem to have arisen concerning the proposed Assessment District fot the
project. Century Homes is working to resolve the current areas of concern with the City of San
Bernardino. This unexpected problem bas delayed our lin.1i'7Ation of the joint venture.
We are Continuing to work toward a final resolution ofproblems with the City and with Century
Homes, My elients have advanced substllntial funds to Integra Engineering for improvements
plans and other items necessary for the final map. A follow-up to Integra Engineering and its
principals indicates that we will be able to finalize the map with their assistance once Century
Homes ,bas resolved any outBtanding matters that it has with the City of San BemmdiIlo
concerning the Assessment District, Therefore, we find it necessary to again request a further
90 day extension in order to complete such matters. Century Homes will also be submitting its
request for the extension by separate letter,

Dear Mr, Grubbs:
As your records will reflect from earlier correspondence, we are
attorneys for and are acting on behalf of the current owners of
property known as Sterling Heights, Tentative Tract No. 14112.
The purpose of this letter is to supplement our correspondence of
February 12, 2001, wherein we requested a 90 day extension in which
to post the necessary bonds and complete the final map for
recording on tentative tract number 1411:1. The request of
extension was granted at that time through June 5, 2001.
As in the previous correspondence, there have been continuing
delays in finalizing the proposed joint venture with Century Bomes.
We believe we are very close to reaching agreement on the project.
Therefore, we find it necessary to again request a further 90 day
extension in order to complete such matters.

Request to continue the Resolution approving final Map for Tentative Tract No. 14112-
located northeasterly of the intersection of foothill Drive and Sterling A venue.
Backl!round:
On November 7, 1990, the Planning Commission approved Tentative Tract No. 14112, a 55-
lot single family residential subdivision.
On May 18, 1994, authorization was given to extend the time limit for approval of the tentative
map. An automatic two-year extension was granted according to the provisions of Section
66452.11 of the Subdivision Map Act, which extended the approval date to May 18, 1996. An
additional extension was granted according to the provisions of Section 66452.13 of the
Subdivision Map Act, extending the approval date to May 18, 1998. The Planning
Commission approved the final extension to May 18, 1999.
On May 17, 1999, the Mayor and Common Council approved a motion to continue this item to
August 16, 1999. On August 16, 1999, the Mayor and Common Council approved a motion
to continue this item to December 7, 1999. On December 7, 1999, the Mayor and Common
Council approved a motion to continue this item to March 6, 2000. On March 6, 2000, the
Mayor and Common Council approved a motion to continue this item to June 5, 2000. On
June 5, 2000, the Mayor and Common Council approved a motion to continue this item to
September, 5, 2000. On September 5, 2000, the Mayor and Common Council approved a
motion to continue this item to December 4, 2000. On December 4, 2000, this item was
continued to March 5,2001.
The required improvement securities and certificates of insurance will be filed prior to June 4,
2001, and the prescribed fees will be paid prior to recordation of the final map. Additionally,
the improvement and grading plans have been prepared.
The final Map has been reviewed and was found to be substantially in compliance with the
Tentative Map and the Subdivision Map Act. The Developer is requesting an additional
continuance to "complete the necessary preparation for recording of the final map", per the
attached letter. Therefore, we recommend that the matter be continued to June 4, 2001. Staff
is further recommending that this be the last continuance for this project given the extreme
delay in processing the Final Map, and given Council discussion regarding this issue at the
December 4 meeting.
Financial Imoact:
There is no financial impact to the City.
Recommendation:

Staff recommends that the Mayor and Common Council continue this item to the meeting of

Dear Mr. Grubbs:
As I believe your recorda reflect from earlier correspondence, we
are attorneys for ana are acting on behalf of the current owners of
the property known as Sterling Heights, Tentative Tract 14112.
The purpose of this letter is to supplement our correspondence of
May 17, 2000, wherein we requested a 90 day extension in which to
post the necessary bonds and complete the final map for recording
on Tentative Tract No. 14112, The request for extension was
granted at that time through September 6, 2000.
All a result of continuing delays in finalizing the proposed
assessment ailltrict ana the joint venture with Century Homes, we
find it necessary to ask for a further 90 day extension in order to
complete such matters.
My clients have advanced substantia~ funds to Integra Engineering
for improvement plans and other items necessary for the final map.
It appears that we are quite close to consulllll1ating this matter and
hope that the City Council will again grant the extension requested
above, Century will also be submitting its request for extension
by separate letter,
