Subject
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
submittal of applications for the certification of City operated recyclable beverage container
collection programs and the periodic renewals of certification.
Background
The City of San Bernardino currently operates a residential curbside program and a commercial
program for the collection of commingled recyclables. As California Redemption Value (CRY)
beverage containers are accepted in both programs, the California Department of Conservation
(DOC) requires that both be certified by the DOC in order to document the amount of beverage
containers being collected, and receive the CR V payment above the scrap value paid by the
City's contracted materials processor. If future programs are established, these too may require
authorization to apply for certification, These certifications must be renewed periodically,
Financial Impact
The City's contracted materials processor calculates the monthly payment for CRV materials
based on a percent waste characterization of the total tons received as witnessed and approved by
Public Services, As the total tons received varies from month to month, the actual revenue
received may vary as well. Burrtec processed the first loads in February 200 I with the first full
month in March 2001. From March 2001 through September 2001, both collection programs
generated a total of$108,000 CRV payments with an average of$15,400 per month. Revised and
more accurate waste characterizations performed in July and August have demonstrated a lower
overall amount of CRV materials actually collected and associated payments. In September,
2001, the residential curbside collection program generated approximately $10,400 from CRV
payment and the commercial collection program generated approximately $1,600, for a total of
$12,000, September's numbers reflect the revised characterizations.

FOR THE CERTIFICATION OF CITY OPERATED RECYCLABLE BEVERAGE
CONTAINER COLLECTION PROGRAMS AND THE PERIODIC RENEWALS OF
CERTIFICATION,
WHEREAS the California Solid Waste Reuse and Recycling Access Act of 1991
mandates cities and counties to divert fifty percent (50%) of all solid waste through source
reduction, recycling, and composting activities; and.
WHEREAS the Legislature also found that diverting fifty percent requires the
participation of the residential. commercial, industrial, and public sectors; and.
WHEREAS the City of San Bernardino Public Services Department established a
residential commingled curbside collection program in 1992 and a commercial commingled

collection program in 1996: and.

WHEREAS the California Beverage Container Recycling and Litter Reduction Act
provides for the reimbursement ofa California Redemption Value (CRV) for approved types of
beverage containers recovered for recycling; and.
WHEREAS the California Department of Conservation (DOC) requires each program
to be cel1ified in order to document CR V beverage containers recovered and in order for the
City to receive CRV revenue above the scrap value of these materials; and,
WHEREAS the application for the initial certification and subsequent applications for
renewal of the commercial commingled recycling program as a government operated Beverage
Container Collection Program requires a resolution of authorization from the governing board;

WHEREAS the renewal of the residential Curbside Collection Program requires the

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the submittal of the initial applications for certification of City operated
recyclable beverage container collection programs to the 'California Department of Conservation
be authorized, and;
SECTION 2. That subsequent periodic 'applications for renewal of certification of City
operated beverage contained collection programs are hereby authorized, and;
SECTION 3, That the Mayor or her designee is hereby authorized to execute said
certifications for the City of San Bernardino.
