7/9/01 Allocation of $3,000,000 in the 2001102 Capital Improvement Program (CIP) for

Staff Report
SUBJECT:
Resolution awarding contract to Janus Corporation for Lead-Based Paint and Asbestos
Abatement and Clean Up (phase II) at the Santa Fe Depot, per Plan No. 10328.
BACKGROUND:
This project consists of lead-based paint and asbestos abatement which includes dismantling
sash windows, removing lead-based paint from windows and doors, removing lead-based paint
from eaves, removing damaged and/or loose asbestos containing glazing from windows, and
sandblasting plaster ceilings and walls to prepare them to receive new plaster.
This project is being completed separate from the overall Depot Restoration project in order to
reduce the need for specialty contracting in the reconstruction phase(s) to follow; reducing the
number of "unforeseen changes " in that larger project and thereby reducing overall project
cost. The reconstruction phase of the project is scheduled to begin in MarchI April of 2002 and
should be completed within 18 - 24 months thereafter.
Plan and specifications for this project are complete. The project is ready to be awarded. The
estimated project costs are as follows:
Construction Cost $ 894,601.68
Contingencies $ 50,000.00
Design, Inspection, and Contract Administration $ 20,398.32
Total $ 965,000.00
This project was advertised locally in the San Bernardino County Sun Newspaper, Construction
Trend Newspaper, the City's web site, and with the San Bernardino Area Chamber of
Commerce. The following five companies responded:

Staff Report
After the bid opening, Action Environmental was the apparent lowest bidder in the amount of
$473,052.30. However, after staffs review of the submitted bid documents, the contractor did
not bid on four significant items. According to the contractor, he does not have the expertise
to accomplish these items and he could not find any subcontractors to perform this work.
Therefore, in Staffs opinion, Action Environmental was not a responsive bidder. The
apparent lowest responsible bidder is Janus Corporation. Janus Corporation satisfactorily
completed phase I of the environmental clean up.
Based on review of the sealed competitive bids received, staff has determined that Janus
Corporation, the lowest responsible bidder, has met the minimum requirements ofthe specifications
and bid guidelines, and therefore, recommends that the Mayor and Common Council award the
referenced contract accordingly.
FINANCIAL IMPACT:
Only those funds deemed necessary for contract payments this fiscal year were budgeted in the
FY 2001/02 Budget and adequate funds are available for this phase of the project. All costs
incurred for this project are charged to Account No. 123-558-5504-7178 (Restoration of the
San Bernardino Santa Fe Depot).
RECOMMENDATION:
Adopt Resolution.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN

SANTA FE DEPOT, PER PLAN NO. 10328.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Janus Corporation is the lowest responsible bidder for Lead-Based Paint

and Asbestos Abatement and Clean Up (phase II) at the Santa Fe Depot, per Plan Drawing No.

10328. A contract is awarded accordingly to said bidder in a total amount of $894,601.68,
11 with a contingency amount of $50,000, but such award shall be effective only upon being fully
12 executed by bDth parties. All other bids, therefore, are hereby rejected. The Mayor is hereby
13
authorized and directed to execute said contract on behalf of the City; a copy of the contract is
14
on file in the office of the City Clerk and incorporated herein by reference as fully as though
15
16 set forth at length.
17 SECTION 2. This contract and any amendment or modifications thereto shall not take
18 effect or become operative until fully signed and executed by the parties and no party shall be
19

obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
22 course of conduct of any party.
23 SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
24 within sixty (60) days of passage of the resolution.
