Synopsis of Previous Council Action:
7/9/01 Allocation of $405,000 in the 2001/02 Capital Improvement Program (CIP) for University Parkway
from Kendall Drive to Northpark Blvd, Base Line Street from California Street to Medical Center Drive,
and the intersection of Little Mountain Drive and 48th Street. (Account No. 135-378-5504-7220).
Recommended Motion:
I. Adopt Resolution.
2. That the Mayor and Common Council authorize the Director of Finance to transfer $241,000 from
Account No. 135-378-5504-7222 (Highland Ave., Waterman Ave., Foxcroft Way) to Account No.
135.378.5504-7220 (University Pkwy, Baseline St., 48th St.), and amend the FY 2001/02 Budget

STAFF REPORT
Subject:
Resolution awarding contract to E.G. Holmes Co. for pavement rehabilitation on University
Parkway from Kendall Drive to Northpark Blvd, Base Line Street from California Street to
Medical Center Drive, and the intersection of Little Mountain Drive and 48th Street, per Plan No.
10295 and authorization for the Director of Finance to amend the FY 2001/02 Budget.
Background:
This proj ect consists of the removal and replacement of asphalt concrete and aggregate base, and
striping the street section on University Parkway from Kendall Drive to Northpark Blvd., and the
intersection of Little Mountain Drive and 48th Street. Originally, it was planned to overlay these
streets. After a detailed examination during the design of the project, due to the poor condition of
the street, the City's consultant, AEI CASC, recommended that asphalt concrete and aggregate
base be removed and replaced. By removing and replacing these streets the cost of this project
has increased. Funding for the additional construction cost of this project will come from
savings on pavement rehabilitation project, (Highland Ave., Waterman Ave., Foxcroft Way and
9th St). This section of road on University Parkway from Kendall Drive to Northpark Blvd.,
Baseline Street from California Street to Medical Center Drive, and the intersection of Little
Mountain Drive and 48th Street, experiences significant vehicular traffic and the original
pavement sections have deteriorated. It is currently in very poor condition, which is why staff is
proposing to move forward with this project as soon as possible.
Plan and specifications for this project are complete. The project is ready to be awarded. The
estimated project costs are as follows:
Construction Cost $ 555,586.00
Contingencies $ 20,000.00
Design, Inspection, and Contract Administration $ 70,414.00
Total $ 646,000.00
This project was advertised locally in the San Bernardino County Sun Newspaper, Construction
Trend Newspaper, the City's web site, and with the San Bernardino Area Chamber of
Commerce. The following eight companies responded:

STAFF REPORT
Based on review of the sealed competitive bids received, staff has determined that E.G. Holmes Co.
the apparent low bidder, has met the minimum requirements of the specifications and bid
guidelines, and therefore recommends that the Mayor and Common Council award the referenced
contract accordingly.
Financial Impact:
Funding for this project, in the amount of $405,000, has been budgeted for FY 01-02 from AB
2928 Funds, Account No. 135-378-5504-7220. An additional $241,000 is needed and is available
from project 135-378-5504-7222 (Highland Ave., Waterman Ave., Foxcroft Way), due to project
savmgs.
Recommendation:
That the Mayor and Common Council authorize the Director of Finance to amend the FY
2001/02 budget to increase the budget in Account No. 135-378-5504-7220 by $241,000 and
reflect the associated reduction in Account No. 135-378-5504-7222 and adopt resolution.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. E.G. Holmes Co. is the lowest responsible bidder for pavement
rehabilitation on University Parkway from Kendall Drive to Northpark Blvd., Base Line Street
from California Street to Medical Center Drive, and the intersection of Little Mountain Drive
12 and 48'h Street, per plan no. 10295. A contract is awarded accordingly to said bidder in a total

amount of $555,586.00 with a contingency amount of $20,000.00 but such award shall be
14
effective only upon being fully executed by both parties. All other bids, therefore, are hereby
15
16 rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of
17 the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein
18
by reference as fully as though set forth at length.

SECTION 2. This contract and any amendment or modifications thereto shall not take
21 effect or become operative until fully signed and executed by the parties and no party shall be
22 obligated hereunder until the time of such full execution. No oral agreements, amendments,
23

modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.

SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
