Request to Schedule Joint Public Hearinl! - RDA Amendment for
Central Citv/Meadowbrook
BACKGROUND
In July of 2000, the Community Development Commission directed staff to initiate amendments
to several redevelopment project areas in which powers of eminent domain had lapsed or were
about to lapse. The purpose of the amendments would be to reinstate the power of eminent
domain over those properties that are non-residential land uses under the General Plan or are
currently being used for non-residential purposes. These proposed amendments would not
affect residential property. Central City South and Mt. Vernon Corridor were the first eminent
domain amendments to be processed and were adopted at the September 4 and September 17,
2001 joint CDCIMCC meetings, respectively. This amendment for Meadowbrook/Central City,
along with Central City East (to be heard on November 19th, 2001) make up the second group of
amendments to be processed.
CURRENT ISSUE
Prior to holding a public hearing on the Meadowbrook/Central City Project Area Amendment,
the Community Development Commission must formally schedule a joint public hearing with
the Mayor and Common Council. Staff recommends that the joint hearing be scheduled for
December 3,2001 at 2:00 p.m.
ENVIRONMENTAL
The action requested is "exempt" under CEQA.
FISCAL IMPACT
Based on contracts entered into with consultants for this amendment, the costs will total $16,735.
Funds for this activity have been approved and budgeted.

BACKGROUND
In July of 2000, the Community Development Commission directed staff to initiate amendments to

lapse. The purpose of the amendments would be to reinstate the power of eminent domain over those
properties that are non-residential land uses under the General Plan or are currently being used for non-
residential purposes. These proposed amendments would not affect residential property. Central City
South and Mt. Vernon Corridor were the first eminent domain amendments to be processed and were
adopted at the September 4 and September 17, 2001 joint CDC/MCC meetings, respectively. These
amendments for Meadowbrook/Central City and Central City South are the second group of amendments
to be processed.

Project Area Amendments, the Community Development Commission must formally schedule a joint
public hearing with the Mayor and Common Council. Staff recommends that the joint hearing be
scheduled for November 19,2001 at 2pm.

Based on contracts entered into with consultants for these two amendments, the costs will be $33,470 for
both Central CitylMeadowbrook and Central City East, which have already been approved and budgeted.
RECOMMENDATION
That the Community Development Commission and Mayor and Common Council adopt the attached
Resolutions scheduling a joint public hearing between the Community Development Commission and the
Mayor and ommon uncil for November 5, 2001 for amendments to the Central CitylMeadowbrook

COUNCIL OF THE CITY OF SAN BERNARDINO TO CONSIDER AN
AMENDMENT TO THE REDEVELOPMENT PLAN TO RESTORE

WHEREAS, the Mayor and Cornmon Council have previously adopted Ordinance Nos.
2233 and 2649, dated July 21, 1958, and February 23, 1965, respectively, which approved the
Redevelopment Plans for the Meadowbrook/Central City Redevelopment Project (the
"Redevelopment Plan") in accordance with the applicable provisions of the Community
Redevelopment Law (Health and Safety Code Section 33000 et SeQ.); and
WHEREAS, the Redevelopment Plan has subsequently been amended by Ordinance No.
3059, dated March 16, 1970, and the redevelopment project areas of the Central City
Redevelopment Project and the Meadowbrook Redevelopment Project were merged for
financial purposes and further amended by Ordinance No. 3683, dated November 7,1977; and
concurrently with the 1977 amendment the Mayor and Cornmon Council certified a Final
Environmental Improvement Report (the "1976 FEIR - Meadowbrook/Central City") for the
Redevelopment Plan as amended in accordance with the California Environmental Quality Act

of 1970, as amended ("CEQA"); and
WHEREAS, the Redevelopment Plan was further amended after 1977 by Ordinance No.
33470, dated 1983, by Ordinance Nos. MC-558 and 559, each dated December 8,1986, by
Ordinance No. MC-723, dated April 2, 1990 and further amended by Ordinance No. MC-916,
dated December 20,1994; and

WHEREAS, the Redevelopment Plan as amended in 1986 authorized the
Redevelopment Agency of the City of San Bernardino (the "Agency") to acquire property
within the redevelopment project area of the Meadowbrook/Central City Redevelopment Project
for community redevelopment purposes by grant, donation, negotiated purchase or lease or by
exercise of eminent domain, which power to acquire land by eminent domain however, lapsed
in 1999 under applicable provisions of the Community Redevelopment Law; and
WHEREAS, conditions of blight stilI persist in the redevelopment project area of the
Meadowbrook/Central City Redevelopment Project, and the resources available to the Agency
to implement the Redevelopment Plan, as amended and eliminate and reduce the spread of
blight from the redevelopment project area will be enhanced and strengthened if the Agency's
power to acquire property by exercise of eminent domain is restored; and
WHEREAS, it is appropriate for the Community Development Commission of the City
of San Bernardino (the "Cornmission") as the governing board of the Agency to take certain
action as provided in this Resolution with respect to the implementation of appropriate action to
prevent and eliminate spread blight in the redevelopment project area of the
Meadowbrook/Central City Redevelopment Project.
NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION OF
THE CITY OF SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND
ORDER AS FOLLOWS:
Section I. The recital paragraphs of this Resolution are true and correct.
Section 2. The Community Development Commission acknowledges receipt of a staff
report dated November 5, 2001, prepared by the Agency, which indicates that the restoration of
the power of the Agency to acquire property in the redevelopment project area of the
Meadowbrook/Central City Redevelopment Project by exercise of eminent domain Will foster
and promote the elimination and prevention of the spread of blight in the redevelopment project

area. The Cornmunity Development Commission further acknowledge receipt from the Agency
of a list of properties (identified by assessor parcel number) in the redevelopment project area of
the Meadowbrook/Central City Redevelopment Project, which the Agency recornmends for the
restoration of eminent domain acquisition powers (the "Eminent Domain Restoration Listing").
The Community Development Commission is further informed by the Agency that none of the
properties identified on the Eminent Domain Restoration Listing is believed to be used or
occupied for residential dwelling purposes at the time of adoption of this resolution.
Section 3 The Cornmunity Development Cornmission hereby acknowledges the receipt
and approval of a draft, each dated November 5,2001, of the text of the proposed amendments
to the applicable section of the Redevelopment Plan, as previously amended (one section
amends the property acquisition procedures for the "Meadowbrook" area of the redevelopment
project area, and the other section amends the property acquisition procedures for the "Central
City" area of the redevelopment project area), which, if finally adopted, shall reinstate the
power of the Agency to acquire certain non-residential use and/or occupied properties in the
project area for twelve (12) years following the adoption of an ordinance of the Mayor and
t 6 Cornmon Council approving such an amendment.
17 Section 4. The Cornmunity Development Cornmission hereby finds and determines that
18 the proposed amendment to the Redevelopment Plan, as amended, to restore the Agency's
19 power to acquire property by eminent domain shall not result in the residential displacement of
20 any low-income persons or household nor in the residential displacement of any moderate-
21 income person or household for the reason that the proposed amendment shall expressly limit
22 the Agency's power to acquire property for cornmunity redevelopment purposes to property
23 which is not residentially used or occupied. In view of this finding, the Community
24 Development Commission hereby determine in accordance with Health and Safety Code
C 25. Section 33385 that further consideration of the proposed amendment to the Redevelopment Plan

shall not require the formation or consultation with a project area committee, as no low-or-
moderate income person or household shall be displaced by any project which may be
undertaken by the Agency on property hereafter acquired by eminent domain.
Section 5. The Cornmunity Development Cornmission hereby acknowledges receipt of
an Initial Study, dated November 5, 2001, as prepared in accordance with CEQA with respect to
the proposed amendment to the Redevelopment Plan to restore eminent domain power of the
Agency to acquire non-residentially used or occupied properties in the redevelopment project
area of the Meadowbrook/Central City Redevelopment Project. The Initial Study indicates that
an addendum to the 1975 FEIR - Meadowbrook/Central City, shall be prepared in connection
with the consideration by the Community Development Commission of the City of San
Bernardino and the Mayor and Cornmon Council at a public hearing of the proposed
amendment to the Redevelopment Plan, as amended. The Agency staff are hereby authorized
and directed to complete the addendum to the 1975 FEIR - Meadowbrook/Central City for
consideration by the Cornmunity Development Cornmission at the time and date of the public
t5 hearing scheduled in Section 6 of this Resolution.
Section 6. The Community Development Cornmission hereby authorizes and consents
to conducting a joint public hearing with the Mayor and Cornmon Council of the City of San
Bernardino, on December 3, 2001 at the hour of 2:00 PM, or as soon thereafter as may .be
practicable, for the purpose of considering an amendment to the Redevelopment Plan to
reinstate the Agency's power to acquire property by exercise of erninent domain with respect to
the properties identified on the Eminent Domain Restoration Listing. The City Clerk, in
cooperation with the Agency Secretary, is hereby authorized and directed to give notice of the
joint public hearing as hereby ordered in the form and manner required by the California
Community Redevelopment Law.
Section 7. This Resolution shall become effective irnmediately upon its adoption.

NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER. AS
FOLLOWS:

Section 1. The recital paragraphs of this Resolution are true and correct.
Section 2. The Mayor and Cornmon Council acknowledges receipt of a staff report
dated November 5, 2001, prepared by the Agency, which indicates that the restoration of the
power of the Agency to acquire property in the redevelopment project area of the
Meadowbrook/Central City Redevelopment Project by exercise of eminent domain will foster
and promote the elimination and prevention of the spread of blight in the redevelopment project
area. The Mayor and Common Council further acknowledge receipt from the Agency of a list

of properties (identified by assessor parcel number) in the redevelopment project area of the
Meadowbrook/Central City Redevelopment Project, which the Agency recommends for the
restoration of eminent domain acquisition powers (the "Eminent Domain Restoration Listing").
The Mayor and Cornmon Council is further informed by the Agency that none of the properties
identified on the Eminent Domain Restoration Listing is believed to be used or occupied for
residential dwelling purposes at the time of adoption of this resolution.
Section 3 The Mayor and Cornmon Council hereby acknowledges the receipt and
approval of a draft, each dated November 5, 2001, of the text of the proposed amendments to
the applicable section of the Redevelopment Plan, as previously amended (one section amends
the property acquisition procedures for the "Meadowbrook" area of the redevelopment project
area, and the other section amends the property acquisition procedures for the "Central City"
area of the redevelopment project area), which, if fmally adopted, shall reinstate the power of
the Agency to acquire certain non-residential use and/or occupied properties in the project area
for twelve (12) years following the adoption of an ordinance of the Mayor and Cornmon
15 Council approving such an amendment.
Section 4. The Mayor and Common Council hereby finds and determines that the
proposed amendment to the Redevelopment Plan, as amended, to restore the Agency's power to
acquire property by eminent domain shall not result in the residential displacement of any low-
income persons or household nor in the residential displacement of any moderate-income
person or household for the reason that the proposed amendment shall expressly limit the
Agency's power to acquire property for community redevelopment purposes to property which
is not residentially used or occupied. In view of this fmding, the Mayor and Cornmon Council
hereby detennine in accordance with Health and Safety Code Section 33385 that further
consideration of the proposed amendment to the Redevelopment Plan shall not require the
formation or consultation with a project area committee, as no low-or-moderate income person

C or household shall be displaced by any project which may be undertaken by the Agency on
2 property hereafter acquired by eminent domain.
Section 5. The Mayor and Cornmon Council hereby acknowledges receipt of an Initial
Study, dated November 5, 2001, as prepared in accordance with CEQA with respect to the
proposed amendment to the Redevelopment Plan to restore eminent domain power of the
Agency to acquire non-residentially used or occupied properties in the redevelopment project
area of the Meadowbrook/Central City Redevelopment Project. The Initial Study indicates that
an addendum to the 1975 FEIR - Meadowbrook/Central City, shall be prepared in connection
with the consideration by the Mayor and Cornmon Council of the City of San Bernardino and
the Mayor and Common Council at a public hearing of the proposed amendment to the
Redevelopment Plan, as amended. The Agency staff are hereby authorized and directed to
complete the addendum to the 1975 FEIR - Meadowbrook/Central City for consideration by the
Mayor and Common Council at the time and date of the public hearing scheduled in Section 6
of this Resolution.
Section 6. The Mayor and Common Council hereby authorizes and consents to
conducting a joint public hearing with the Mayor and Cornmon Council of the City of San
Bernardino, on December 3, 2001 at the hour of 2:00 PM, or as soon thereafter as may be
practicable, for the purpose of considering an amendment to the Redevelopment Plan to
reinstate the Agency's power to acquire property by exercise of eminent domain with respect to
the properties identified on the Eminent Domain Restoration Listing. The City Clerk, in
cooperation with the Agency Secretary, is hereby authorized and directed to give notice of the
joint public hearing as hereby ordered in the form and manner required by the California

24 Section 7. This Resolution shall become effective irnmediately upon its adoption.

2001 EMINENT DOMAIN AMENDMENT
to the
MEADOWBROOK REDEVELOPMENT PLAN
for the
MEADOWBROOK/CENTRAL CITY REDEVELOPMENT PROJECT AREA
AMENDMENT
That Subsection "1" of the Redevelopment Plan, as previously amended, entitled "Land
Acquisition of Section D. PROJECT PROPOSALS" is hereby amended to read as follows:
"1.
Acquisition of Real Property
"The Agency may acquire, purchase, lease, obtain option, or otherwise
acquire any interest in real property, and any improvements on it by any
means authorized by law, including by gift, grant, exchange, purchase,
cooperative negotiations, lease, and any other means authorized by law
including the use of eminent domain for purposes of redevelopment in the
Project Area as authorized by law. Not withstanding the provisions of the
preceding sentence, the Agency shall not acquire by eminent domain any
property within the Project Area on which a person or persons reside or
any property which is either designated under applicable General Plan or
zoning regulations as residential property, as of the date when the Agency
transmits its written offer to acquire such property to the owner thereof in
accordance with Government Code Section 7267.2, or other applicable
law.
With regard to the time period to exercise the Agency's power of eminent
domain within the Project Area, the Agency shall not initiate legal
proceedings to acquire an interest in real property by the exercise of the
power of eminent domain after the twelfth anniversary (12111) following the
effective date of the ordinance last amending this Section 1,
The Agency is not authorized to acquire real property owned by public
bodies, which do not consent to such acquisition. The Agency is
authorized, however, to acquire public property, if it is transferred to
private ownership before the Agency completes land disposition within the
entire Project Area, unless the Agency and the private owner enter into a
participation agreement.
The Agency shall not acquire real property on which an existing building is to be
continued on its present site and in its present form and use without consent of the
owner, unless (I) such building requires structura1 alterations, improvement,
modernization or rehabilitation, or (2) the site or lot on which the building is

WHEREAS, the Mayor and Common Council have previously adopted Ordinance Nos.
10
2233 and 2649, dated July 21, 1958, and February 23, 1965, respectively, which approved the
11
Redevelopment Plans for the Meadowbrook/Central City Redevelopment Project (the
12
"Redevelopment Plan") in accordance with the applicable provisions of the Community
13
Redevelopment Law (Health and Safety Code Section 33000 et seq.); and
14
WHEREAS, the Redevelopment Plan has subsequently been amended by Ordinance No.
15
3059, dated March 16, 1970, and the redevelopment project areas of the Central City
16
Redevelopment Project and the Meadowbrook Redevelopment Project were merged for
17
financial purposes and further amended by Ordinance No. 3683, dated November 7, 1977; and
18
concurrently with the 1977 amendment the Mayor and Common Council certified a Final
19
Environmental Improvement Report (the "1976 FEIR - Meadowbrook/Central City") for the
20
Redevelopment Plan as amended in accordance with the California Environmental Quality Act
21
of 1970, as amended ("CEQA"); and
22
WHEREAS, the Redevelopment Plan was further amended after 1977 by Ordinance No.
23
24
33470, dated 1983, by Ordinance Nos. MC-558 and 559, each dated December 8, 1986, by
Ordinance No. MC-723, dated April 2, 1990 and further amended by Ordinance No. MC-916,
dated December 20, 1994; and

WHEREAS, the Redevelopment Plan as amended in 1986 authorized the
2 Redevelopment Agency of the City of San Bernardino (the "Agency") to acquire property
3 within the redevelopment project area of the Meadowbrook/Central City Redevelopment Project
4 for community redevelopment purposes by grant, donation, negotiated purchase or lease or by
5 exercise of eminent domain, which power to acquire land by eminent domain however, lapsed
6 in 1999 under applicable provisions of the Community Redevelopment Law; and
7 WHEREAS, conditions of blight still persist in the redevelopment project area of the
8 Meadowbrook/Central City Redevelopment Project, and the resources available to the Agency
9 to implement the Redevelopment Plan, as amended and eliminate and reduce the spread of
10 blight from the redevelopment project area will be enhanced and strengthened if the Agency's
11 power to acquire property by exercise of eminent domain is restored; and
12 WHEREAS, it is appropriate for the Community Development Commission of the City
13 of San Bernardino (the "Commission") as the governing board of the Agency to take certain
14 action as provided in this Resolution with respect to the implementation of appropriate action to
15 prevent and eliminate spread blight in the redevelopment project area of the
16 Meadowbrook/Central City Redevelopment Project.
17 NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION OF
18 THE CITY OF SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND
19 ORDER AS FOLLOWS:
20 Section 1. The recital paragraphs of this Resolution are true and correct.
21 Section 2. The Cornmunity Development Commission acknowledges receipt of a staff
22 report dated October 15,2001, prepared by the Agency, which indicates that the restoration of
23 the power of the Agency to acquire property in the redevelopment project area of the
24 Meadowbrook/Central City Redevelopment Project by exercise of eminent domain will foster
25 and promote the elimination and prevention of the spread of blight in the redevelopment project

area. The Cornmunity Development Commission further acknowledge receipt from the Agency
2 of a list of properties (identified by assessor parcel number) in the redevelopment project area of
3 the Meadowbrook/Central City Redevelopment Project, which the Agency recommends for the
4 restoration of eminent domain acquisition powers (the "Eminent Domain Restoration Listing").
5 The Cornmunity Development Commission is further informed by the Agency that none of the
6 properties identified on the Eminent Domain Restoration Listing is believed to be used or
7 occupied for residential dwelling purposes at the time of adoption of this resolution.
8 Section 3 The Community Development Cornmission hereby acknowledges the receipt
9 and approval ofa draft, each dated October 15, 2001, of the text of the proposed amendments to
10 the applicable section of the Redevelopment Plan, as previously amended (one section amends
1 t the property acquisition procedures for the "Meadowbrook" area of the redevelopment project
12 area, and the other section amends the property acquisition procedures for the "Central City"
13 area of the redevelopment project area), which, if finally adopted, shall reinstate the power of
14 the Agency to acquire certain non-residential use and/or occupied properties in the project area
15 for twelve (12) years following the adoption of an ordinance of the Mayor and Common
16 Council approving such an amendment.
17 Section 4. The Community Development Cornmission hereby finds and determines that
18 the proposed amendment to the Redevelopment Plan, as amended, to restore the Agency's
19 power to acquire property by eminent domain shall not result in the residential displacement of
20 any low-income persons or household nor in the residential displacement of any moderate-
21 income person or household for the reason that the proposed amendment shall expressly limit
22 the Agency's power to acquire property for cornmunity redevelopment purposes to property
23 which is not residentially used or occupied. In view of this finding, the Community
24 Development Commission hereby determine in accordance with Health and Safety Code
25 Section 33385 that further consideration of the proposed amendment to the Redevelopment Plan

shall not require the formation or consultation with a project area committee, as no low-or-
2 moderate income person or household shall be displaced by any project which may be
3 undertaken by the Agency on property hereafter acquired by eminent domain.
4 Section 5. The Community Development Commission hereby acknowledges receipt of
5 an Initial Study, dated October 15,2001, as prepared in accordance with CEQA with respect to
6 the proposed amendment to the Redevelopment Plan to restore eminent domain power of the
7 Agency to acquire non-residentially used or occupied properties in the redevelopment project
8 area of the Meadowbrook/Central City Redevelopment Project. The Initial Study indicates that
9 an addendum to the 1976 FEIR - Meadowbrook/Central City, shall be prepared in connection
10 with the consideration by the Community Development Commission of the City of San
11 Bernardino and the Mayor and Common Council at a public hearing of the proposed
12 amendment to the Redevelopment Plan, as amended. The Agency staff are hereby authorized
13 and directed to complete the addendum to the 1976 FEIR - Meadowbrook/Central City for
14 consideration by the Cornmunity Development Commission at the time and date of the public
15 hearing scheduled in Section 6 ofthis Resolution.
16 Section 6. The Cornmunity Development Commission hereby authorizes and consents
17 to conducting a joint public hearing with the Mayor and Common Council of the City of San
18 Bernardino, on November 19, 2001 at the hour of 2:00 PM, or as soon thereafter as may be
19 practicable, for the purpose of considering an amendment to the Redevelopment Plan to
20 reinstate the Agency's power to acquire property by exercise of eminent domain with respect to
21 the properties identified on the Eminent Domain Restoration Listing. The City Clerk, in
22 cooperation with the Agency Secretary, is hereby authorized and directed to give notice of the
23 joint public hearing as hereby ordered in the form and manner required by the California
24 Cornmunity Redevelopment Law.
25 Section 7. This Resolution shall become effective immediately upon its adoption.

2001 EMINENT DOMAIN AMENDMENT
to the
MEADOWBROOK REDEVELOPMENT PLAN
for the
MEADOWBROOK/CENTRAL CITY REDEVELOPMENT PROJECT AREA
AMENDMENT
That Subsection "1" of the Redevelopment Plan, as previously amended, entitled "Land
Acquisition of Section D. PROJECT PROPOSALS" is hereby amended to read as follows:
"1. Acquisition of Real Property
"The Agency may acquire, purchase, lease, obtain option, or otherwise
acquire any interest in real property, and any improvements on it by any
means authorized by law, including by gift, grant, exchange, purchase,
cooperative negotiations, lease, and any other means authorized by law
including the use of eminent domain for purposes of redevelopment in the
Project Area as authorized by law. Not withstanding the provisions of the
preceding sentence, the Agency shall not acquire by eminent domain any
property within the Project Area on which a person or persons reside or
any property which is either designated under applicable General Plan or
zoning regulations as residential property, as of the date when the Agency
transmits its written offer to acquire such property to the owner thereof in
accordance with Government Code Section 7267.2, or other applicable
law.
With regard to the time period to exercise the Agency's power of eminent
domain within the Project Area, the Agency shall not initiate legal
proceedings to acquire an interest in real property by the exercise of the
power of eminent domain after the twelfth anniversary (12th) following the
effective date of the ordinance last amending this Section 1.
The Agency is not authorized to acquire real property owned by public
bodies, which do not consent to such acquisition. The Agency is
authorized, however, to acquire public property, if it is transferred to
private ownership before the Agency completes land disposition within the
entire Project Area, unless the Agency and the private owner enter into a
participation agreement.
The Agency shall not acquire real property on which an existing building is to be
continued on its present site and in its present form and use without consent of the
owner, unless (1) such building requires structural alterations, improvement,
modernization or rehabilitation, or (2) the site or lot on which the building is
situated requires modification in size, shape or use, or (3) it is necessary to impose
,upon such property.any of the standard, restrictions and controls of the Plan and
the owner fails or refuses to participate in the Plan by executing a participation
agreement."

2001 EMINENT DOMAIN AMENDMENT
to the
REDEVELOPMENT PLAN
for the
CENTRAL CITY EAST REDEVELOPMENT PROJECT AREA
AMENDMENT
That Subsection "A" of the Redevelopment Plan, as previously amended,
entitled "property Acquisition of Section IV. PROPOSED REDEVELOPMENT
ACTIVITIES" is hereby amended to read as follows:
"A. Propertv ACquisition
1. ACquisition of Real Property
"The Agency may acquire, purchase, lease, obtain option,
or otherwise acquire any interest in real property, and any
improvements on it by any means authorized by law, including
by gift, grant, exchange, purchase, cooperative negotiations,
lease, and any other means authorized by law including the use
of eminent domain for purposes of redevelopment in the
project Area as authorized by law. Not withstanding the
provisions of the preceding sentence, the Agency shall not
acquire by eminent domain any property within the project
Area on which a person or persons reside or any property
which is either designated under applicable General Plan or
zoning regulations as residential property, as of the date when
the Agencv transmits its written offer to acquire such property
to the owner thereof in accordance with Government Code
Section 7267.2, or other applicable law.
The Agency is not authorized to acquire real property
owned by public bodies, which do not consent to such
acquisition. The Agency is authorized, however, to acquire
public property, if it is transferred to private ownership before
the Agency completes land disposition within the entire
project Area, unless the Agency and the private owner enter
into a participation agreement.
The Agency shall not acquire real property on which an
existing building is to be continued on its present site and in its
present form and use without consent of the owner, unless (1)
such building requires structural alterations, improvement,
modernization or rehabilitation, or (2) the site or lot on which
the building is situated requires modification in size, shape or
use, or (3) it is necessary to impose upon such property any of
the standard, restrictions and controls of the Plan and the
owner fails or refuses to participate in the Plan by executing a
participation agreement.
2. Acquisition of personal property
Generally, personal property shall not be acquired.
However, where necessary in the execution of this Plan, the
agency is authorized to acquire personal property in the
Project Area by any lawful means.
3. Time Limit for Commencement of Eminent Domain
The Agency shall not initiate legal proceedings to acquire
an interest in real property by the exercise of the power of
eminent domain after the twelfth anniversary (12tn) following
the effective date of the ordinance last amending this Section
3."
