Amendment No.1 To The Al!reement Between The Redevelopment Al!encv And Oldtimers
Fonndation-ElderIv/SpeciaI Needs Home Repair Grant Prol!ram
CURRENT ISSUE
The Oldtimers Foundation is a non-profit charitable and educational organization serving the
needs of senior citizens and created in 1964 for the purpose of maintaining and improving the
physical, psychological and social well being of older low income and handicapped persons. It
accomplishes this through comprehensive and coordinated programs, including congregate and
home-delivered meals, minor home repairs, transportation, volunteer opportunities, supportive
services and also provides affordable housing. Their annual budget is in excess of $3.5 million
and they employ more than 120 individuals. Currently, Oldtimers works with the County of San
Bernardino Department of Aging & Adult Services, the City of Rialto, Rancho Cucamonga and
the City of Fontana.
Last year, the Community Development Commission approved a contract with the Oldtimers in
the amount of$75,000 to conduct the Elderly/Special Needs Minor Home Repair Program in the
City. To date, the Oldtimers has assisted 102 households in the City with minor repairs to their
homes, exceeding their goals under the Agreement. Because of the continuous demand for the
Program, staff proposes to allocate $40,000 to the Oldtimers to continue the Elderly/Special
Needs Home Repair Program in the City (the "Program"). The Oldtimers will continue to
provide housing assistance to eligible homeowners, which include, but are not limited to:
plumbing, heating, electrical, carpentry, and general minor repairs. (See attached brief
description), Other existing contract provisions will continue to apply such as, the Oldtimers
will expend no more than $750 per housing unit, and they will be limited to visiting a housing
unit to twice a year. An applicant would not be eligible to apply for assistance again until three
(3) years following the date of the last assistance. The Program will be offered to residents on a
first come, first serve basis. In order to be eligible for the Program an Applicant must meet the
basic criteria set forth below: (1) Be an owner occupant for a minimum period of one (1) year;
(2) Meet the applicable Income Criteria, which shall not exceed 80% of the median income for
San Bernardino County (i.e., family of 1, $27,950; family of 2, $31,950); (3) Be an elderly
person, age 60 or above, or disabled or handicapped, or a recipient of S.S.I; (4) Applicant would
be required to complete a Grant Application and provide proof of ownership and residency.
Accordingly, staff requests approval of the Amendment No. 1 to the Agreement with the
Oldtimers Foundation.

FISCAL IMPACT
The approval of Amendment No. I to the Agreement will result in an expenditure of $40,000
from the Redevelopment Agency's Housing 2001/2002 (low/mod) Fund.
RECOMMENDATION
That the Community Development Commission adopt the attached Resolution.

RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION
OF THE CITY OF SAN BERNARDINO APPROVING AND
AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE
AMENDMENT NO. 1 TO THE AGREEMENT BETWEEN THE
REDEVELOPMENT AGENCY AND OLDTIMERS FOUNDATION, INC.,
IN THE AMOUNT OF $40,000, TO CONTINUE THE ELDERLY/SPECIAL
NEEDS MINOR HOME REPAIR GRANT PROGRAM
WHEREAS, the Community Development Commission of the City of San Bernardino
(the "Commission") is the governing body of the Redevelopment Agency of the City of San
Bernardino (the "Agency"), a public body corporate and politic, organized and existing pursuant
to the Community Redevelopment Law (California Health and Safety Code Section 33000, et
11 seq.); and
WHEREAS, the Agency and Oldtimers Foundation, a California non-profit Corporation
(the "Contractor") entered into that certain 7th day of August 2000 Agreement (the "Agreement")
for the purpose of implementing the elderly/special needs minor home repair grant program as
described in the Scope of Services Exhibit "A" of the Agreement; and
WHEREAS, the Agency and Contractor agree to continue the Grant Program for low
income homeowners for the fiscal year 2001/2002 and ending June 30, 2002; and
WHEREAS, the Agency and Contractor agree that all other terms ofthe original
Agreement remain unchanged, and in full force and affect.
NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION ACTIN
ON BEHALF OF THE REDEVELOPMENT AGENCY OF THE CITY OF SAN
BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1.
The Commission hereby approves Amendment No.1 attached hereto as
Exhibit "A".
Section 2. The Executive Director of the Agency is hereby authorized to execute
Amendment No. 1 on behalf of the Agency in substantially the form attached hereto, together
with such non substantive changes therein as may be approved by the Executive Director and

Agency Special Counsel. The Executive Director or such other designated representative of the
Agency is further authorized to do any and all things and take any and all actions as may be
deemed necessary or advisable to effectuate the purposes of Amendment No.1.
This Resolution shall become effective immediately upon its adoption.

AMENDMENT NO.1 TO THE AGREEMENT DATED AUGUST 7, 2000 BETWEEN
THE REDEVELOPMENT AGENCY AND THE OLDTIMERS FOUNDATION FOR
THE ELDERLY/SPECIAL NEEDS HOME REPAIR GRANT PROGRAM
THIS AMENDMENT NO. 1 ("Amendment No.1") amends the Agreement, date
August 7,2000, (the "Agreement"), and is dated as of this 5th day of November 2001, by an
between the Redevelopment Agency of the City of San Bernardino, a public body corporate an
politic ("Agency"), and Oldtimers Foundation, Inc., a California non-profit corporation
("Contractor") in view of the facts set forth in the following Recitals;
RECITALS

WHEREAS, the Agency and Contractor have previously entered into an Agreement fo

the purpose of allowing the Contractor to implement an affordable housing improvemen
12
program known as the "Elderly/Special Needs Minor Home Repair Grant Program" (referred t
as the "Program") as described in the Agreement, to assist the Agency in effectuating its low
and moderate-income housing requirements pursuant to the California Redevelopment Law;

WHEREAS, the Agency and Contractor desire to amend the Agreement as set forth i

this Amendment No.1 to increase the amount appropriated for the "Program", and extend th
term of the Agreement.

NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANT
HEREIN SET FORTH AND THE MUTUAL BENEFITS TO BE DERIVED THEREFROM
THE CONTRACTOR AND THE AGENCY HERETO AGREE AS FOLLOWS:

Section 2. Section II - Responsibilities of the Contractor, of the Agreement is hereb
amended by this Amendment No. 1 to read as follows:
"Section 4. Time of Performance - The Services to be performed under and
pursuant to the Agreement and Amendment No. I shall be for period
cornmencing on the date Amendment No. I is approved by the Cornmission
(the "Effective Date") and ending June 30, 2002. The Executive Director of
the Agency, is authorized to extend the completion date of this Amendment
No. 1 for up to one hundred and twenty (120) days and approve any other
minor, non-substantive modifications to this Agreement as long as such
modifications are in writing and approved by the parties upon the same terms
and conditions as specified herein.
Section 3. Section IV - Compensation, of the Agreement is hereby amended by thi
Amendment No.1 to read as follows:
"Section 1. Comoensation - In consideration of the performance of the Scope
of Services (Exhibit "A" of the Agreement) by the Contractor, the Agency
shall pay to the Contractor Forty Thousand ($40,000) dollars as set forth on
Exhibit "B" of the Agreement."
Section 4. Section VI - General Provisions, of the Agreement is hereby amended by th
Amendment No.1 to add Section 24 to the Agreement as follows: The Executive Director ofth
Agency is authorized to make non-substantive changes, clarifications, corrections to th
Agreement, including budget line item adjustments, provided such actions do not increase th
Agency's monetary annual appropriation to the Contractor as approved by the governing boar
of the Agency.
