Subject:
Resolution awarding contract to All American Asphalt for pavement rehabilitation on Mt.
Vernon Ave from 9th Street to Base Line Street.
Background:
This project consists of the removal and reconstruction of the street section on Mt. Vernon Ave
from 9th Street to Base Line Street. This section of road experiences significant truck traffic,
and the original pavement section has deteriorated. It is currently in very poor condition,
which is why staff is proposing to move forward with this project as soon as possible.
Plan and specifications for this project are complete and it is ready to be awarded. The
estimated project costs are as follows:
Construction Cost $110,617.90
Contingencies $16,000.00
Design, Insoection, and Contract Administration $ 20,000.00
Total $146,617.90
This project was advertised locally in the San Bernardino County Sun Newspaper, Construction
Trend Newspaper, the City's web site, and with the San Bernardino Area Chamber of
Commerce; the following companies responded:

On the basis of sealed compel1l1ve bids received after public advertising for pavement
rehabilitation on Mt. Vernon Ave from 9th Street to Base Line Street, and staff review of the
bids, All American Asphalt, is the apparent lowest responsible bidder, in the amount of
$110,617.90.
Financial Impact:
Funding for this project in the amount of $157,800 has been allocated from the 1/2 cent Sales
and Road Tax Fund for FY 2001/2002. All costs incurred will be charged to Account No. 129-
367-5504-7193.

RESOLUTION NO.
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
3 BERNARDINO AWARDING A CONTRACT TO ALL AMERICAN ASPHALT FOR
4 PAVEMENT REHABILITATION ON MT. VERNON AVE FROM 9TH STREET TO
BASE LINE STREET PER PLAN NO. 10243.
SECTION 1. All American Asphalt is the lowest responsible bidder for pavement
rehabilitation on Mt. Vernon Ave from 9th Street to Base Line Street. A contract is awarded
10 accordingly to said bidder in a total amount of $110,617.90, with a contingency amount of

$16,000, but such award shall be effective only upon being fully executed by both parties. All
other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to
execute said contract on behalf of the City; a copy of the contract is on file in the office of the

City Clerk and incorporated herein by reference as fully as though set forth at length.

SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,

modifications or waivers are intended or authorized and shall not be implied from any act or

course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of passage of the resolution.
