Staff Report
SUBJECT:
Authorization to Proceed - Sale of City property, being a portion of the vacated portion of the
northwest corner of Washington Street and Waterman Avenue, and Resolution setting fair
market value and a public hearing.
BACKGROUND:
On August 21, 2000, Resolution No. 2000-258 was adopted, approving the Final Map for
Subdivision Tract No. 15826, located at the southwest corner of Wier Road and Waterman
Avenue. A portion of excess right of way along Waterman Avenue, south of Wier Road was
vacated on the map of Tract 15826. This strip was incorporated into the rear ofIots 14 through
21 and is encumbered by the backyards of these homes.
This 10,479 square foot strip of land that was vacated, was acquired by the County in 1958 as
part of the Waterman Avenue right of way acquisition. The land was subsequently passed to the
City by annexation in 1961 so no funds were expended. City ownership of this strip ofIand was
not shown on the title report submitted by the developer. The developer was in the process of
obtaining a loan and it was discovered at that time that the City still owned this strip ofIand.
City staff was notified of this finding and contacted the developer. In order for the developer to
sell the lots with clear title, the City strip would need to be quitclaimed to the developer. This
strip of land is a slope behind the perimeter block wall of the tract which is of no use to the City
and is not buildable. It would also have to be maintained by the City as it presently stands.
Staff's recommendation is that it would be in the best interest of the City to quitclaim this land
for a nominal fee of $1 ,000, based on the fact that this strip would have no value on the open
market and there are no comparable sales in the area for this type of property. Staffhas
determined that this amount is reasonable to cover staff cost for this action. Proceeds from this
sale would go to the general fund to cover staff time.
Pursuant to Section 2.65.030 of the San Bernardino Municipal Code, property valued at less then
$25,000 may be sold without going through the public bid process, but a public hearing on the
proposed sale must still be held. The attached Resolution sets the fair market value of the
property at $1,000 and sets a public hearing relative to the sale. Staff is recommending a
nominal value of $1 ,000 based on the conditions stated above, and also based on the fact that this
strip could have no value on the open market. All affected City departments will be given notice
of the sale for potential conflicts and the property will be posted as required by law. A Sales and
Purchase Agreement will be prepared and submitted for action at the close of the public hearing.
Upon sale of the property, title will be transferred by quit claim deed.

RESOLUTION NO.
WHEREAS, the City of San Bernardino, a municipal corporation, is the owner of the
hereinafter described parcel of real property, generally located at the northwest corner of
Washington Street and Waterman Avenue, south of Wier Road in the City of San Bernardino,
11 State of California, consisting of a 10,479 square foot, triangle-shaped strip of non-buildable
12 land, and more fully described below in Exhibit "A" attached hereto and made a part hereof; and
13 WHEREAS, the Mayor and Common Council of said City find and determine that there

is no necessity for the City's ownership of said Real property; and

WHEREAS, the Mayor and Common Council of said City believe it is in the best
interest of the City that said parcel of real property be disposed of at fair market value; and
WHEREAS, City staff have estimated a fair market value of One Thousand Dollars

SECTION 1. The public interest and convenience require the sale of City owned real
property, generally located at the northwest corner of Washington Street and Waterman Avenue
in the City of San Bernardino and same is hereby declared as surplus real property.
SECTION 2. It is therefore the intention of the Mayor and Common Council of the City
of San Bernardino to sell said real property to Steven Walker Homes.
SECTION 3. The Mayor and Common Council do hereby find and determine that the
Fair Market Value of the property and sales price is One Thousand Dollars ($1,000.00).
SECTION 4. The Mayor and Common Council of the City of San Bernardino do hereby
set a public hearing to be held on December 3, 2001, at 10:00 a.m. or as soon thereafter as the
matter can be heard, in the Council Chambers of City Hall, 300 North "D" Street, San
Bernardino, California, relative to the proposed sale.
SECTION 5. Notice of the public hearing shall be published in The San Bernardino
County Sun, a newspaper of general circulation, at least once prior to the public hearing and shall
be posted in at least 3 conspicuous places on the property at least (10) days prior to the hearing.
SECTION 6. Written and oral protest to such sale may be submitted and shall be
received at or prior to the public hearing. Written protests may also be submitted to the City
Clerk's Office, City Hall, 300 N. "D" Street, San Bernardino, California, prior to the public
hearing.
SECTION 7.
It is the intent of the Mayor and Common Council to consider and
approve said sale at the public hearing, said property more particularly described in said Exhibit
