STAFF REPORT
SUBJECT:
Acceptance of Grant Deed from Stephan C. Allan for property located
at 1396 pico Avenue, San Bernardino, and dedicating the property
for Water Department use.
BACKGROUND:
The United States Environmental Protection Agency (USEPA) has
completed a Remediation Investigation Feasibility Study and signed
a Record of Decision in March of 1995 for the clean up of the
Muscoy Operable Unit. This program was undertaken to clean up
solvents that are in the groundwater within the Bunker Hill Basin.
As part of the clean up program, the USEPA will need land for at
least five (5) well sites.
The Water Department is the USEPA's contractor for activities
associated with the clean up, pursuant to a Cooperative Agreement
between the parties. Specifically, the Water Department is
responsible for land acquisition (for well sites) and well design
and drilling.
The Water Department and the USEPA will be meeting with the
community to determine the most appropriate method to mitigate the
well site in the neighborhood, whether the mitigation is a facade
house, landscaping or other treatment.
FINANCIAL IMPACT:
None to the City.
The Water Department will finance acquisition of well sites and the
USEPA will reimburse the Water Department for the costs associated
with acquisition.
RECOMMENDATION:
It is recommended that the resolution accepting the Grant Deed for
the property located at 1396 Pico Avenue, San Bernardino, and
dedicating said property for Water Department use be adopted.
URGENCY CLAUSE:
Action must be taken at the October 15, 2001 meeting as escrow is
scheduled to close on November 2, 2001.

3 OF SAN BERNARDINO ACCEPTING A GRANT DEED FROM STEPHAN C. ALLAN
FOR PROPERTY LOCATED AT 1396 PICO AVENUE, SAN BERNARDINO, AND
4 DEDICATING THE PROPERTY FOR WATER DEPARTMENT USE.
5 WHEREAS, the San Bernardino Municipal Water Department is involved in a project
6 to clean up groundwater contamination in the Bunker Hill Basin, in particular the Muscoy
7 Operable Unit; and
8 WHEREAS, the acquisition of 1396 Pico Avenue, San Bernardino, is necessary for the
9 placement of wells for this project.
10 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
11 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1.
The City of San Bernardino hereby accepts the Grant Deed from
13 Stephan C. Allan for property known as 1396 Pico Avenue, San Bernardino, as set forth in
14 Exhibit "I" attached hereto and incorporated herein by reference as though fully set forth at
C 15 length herein.

SECTION 2.
That the property acquired herein is dedicated for Water
17 Department use.
