Synopsis of Previous Council Action:

Staff Report
Subiect:
Resolution approving Amendment No.1 to Agreement with Korve Engineering, Inc., for
preparing final plans, specifications, and estimate for the design of street improvements on
Pepper Linden.
Backl!round:
On November 20, 2000, the Mayor and Common Council adopted Resolution No. 2000-330
approving a Professional Services Agreement with Korve Engineering, Inc., in an amount not
to exceed $52,240, for preparing final plans, specifications, and estimate for the design of
street improvements on Pepper Linden.
The Engineer began work about December 11, 2000, and monthly progress meetings between
the Engineer and City staff have been held since that date to discuss issues and resolve
problems. At a meeting on June 26, 2001, design revisions were requested by City staff to
increase design flexibility for future improvements (landscaped median), address aesthetic
considerations, and significantly reduce the cost of construction. On July 23, 2001, the Mayor
and City Council had recently directed staff to proceed promptly with the design of the traffic
signal at Wagonwheel Road and Kendall Drive, including interconnect coordination with the
Pepper Linden and Kendall Traffic Signal. Staff believes that by adding the design of the
traffic signals at Wagonwheel Road & Kendall Drive and Pepper Linden & Kendall Drive to
this change order No.1, it will significantly reduce the time to complete the design. These
revisions will require the following changes to the Engineer's scope of services (See Exhibits
"B"-"D"):
1. Significant changes to the proposed street section from two lanes undivided to a two lane
divided highway including a future landscaped median with the ability to easily (and cost
effectively) increase the number of paved lanes at a later date as funding becomes
available, and horizontal/vertical alignments changes (See Exhibit "B" amount
$15,000.00).
2. The addition of a traffic signal design at Pepper Linden and Kendall Drive with additional
street improvement design work to accommodate the new traffic signal (See Exhibit "c"
amount $18,000.00).
3. The addition of a traffic signal design at Wagonwheel Road & Kendall Drive including
interconnection with Pepper Linden & Kendall (See Exhibit "D" amount $12,000.00).
The compensation to the Engineer for these design changes is $45,000.00 fixed fee.
Paragraph 5. B. of the Agreement requires that:
"Any adjustment of the total cost of services will only be permitted when the Engineer
establishes and City has agreed in writing that there has been, or is to be, a significant
change in:
1. Scope, complexity, or character of the services to be performed;
2. Conditions under which the work is required to be performed; and
3. Duration of work if the change from the time period specified in the Agreement
for Completion of the work warrants such adjustment."
Staff has reviewed the Engineer's request and agrees that this work will result in a change in
the scope of services from that proposed in the Agreement and will result in increased cost to
the Engineer. The Engineer has proposed a total compensation of $45,000.00, and has
provided a breakdown (See Exhibits "B"-"D") of costs to justify the fee. Staff has reviewed
the breakdown and believes it is fair and reasonable for the additional work required by
Amendment No.1 to the Agreement.
Financial ImDact:
Funding for the Pepper/Linden Street Improvement project in the amount of $475,000 was
approved in the FY 2001102 budget in Account No. 126-369-5504-7007. Funding for the
Pepper/Kendall Traffic Signal in the amount of $93,000 was approved in the FY 2001102
budget in Account No. 250-370-5504-7262. Staff was directed by the Mayor and Common
Council to utilize an estimated $110,000 from the Street Improvement/Safety Improvements-
Citywide Account approved in the FY 2001102 budget in Account No. 129-367-5504-7156 to
design and construct a traffic signal at the intersection of Wagonwheel and Kendall. There are
adequate funds available in each of these accounts, and although the same firm will do the
designs to expedite the process, all charges will be tracked individually among the project
accounts.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The attached Proposals dated June 27, 2001, July 23, 2001, and July 24,
2001, and marked Exhibit "B", "C", and "0", respectively, submitted by KORVE

10 ENGINEERING, INC. to perform extra work for a fixed fee of $45,000.00, under terms of a
11 Professional Services Agreement with said Engineer authorized by Resolution No. 2000-330,
12 is hereby approved. Such approval shall be effective only upon Amendment No. 1 being fully

executed by both parties. The Mayor is hereby authorized and directed to execute said

Amendment No. I on behalf of the City. A copy of Amendment No. 1 is attached as Exhibit
"A" and incorporated herein by reference as fully as though set forth at length.
SECTION 2. This Amendment shall not take effect until the Amendment is fully
signed and executed by the parties, and no party shall be obligated hereunder until the time of
such full execution. No oral Contracts, amendments, modifications or waivers are intended or

21 authorized and shall not be implied from any act or course of conduct of any party.
22 SECTION 3. This resolution is rescinded if the parties to the Amendment fail to
23 execute it within sixty (60) days of the passage of the resolution.

AMENDMENT NO.1 TO AGREEMENT FOR PROFESSIONAL SERVICES
This AMENDMENT NO.1 is made and entered into this of
2001, by and between the CITY OF SAN BERNARDINO, California, a municipal
corporation, hereinafter referred to as the "CITY" Korve Engineering, Inc., hereinafter
referred to as "ENGINEER".
WITNESSETH
WHEREAS, San Bernardino City Council, on November 20, 2000, adopted
Resolution No. 2000-330 approving an Agreement for Professional Services with Engineer
for preparation of plans, specification, and estimate for the design of street improvements on
Pepper Linden; and
WHEREAS, subsequent to Agreement approval, revisions were requested by
CITY staff to change the roadway section and vertical/horizontal alignment of Pepper
Linden; and
WHEREAS, City has requested the Engineer to provide plans specification &
estimate for the traffic signals at Pepper Linden & Kendall Drive and for Wagonwheel &
Kendall Drive; and
WHEREAS, Engineer has requested an amendment to the Agreement to
cover the cost of additional services required to complete these revisions; and
WHEREAS, paragraph 5.B. of Agreement allows adjusunent to the total cost
of services when the Engineer and City agree in writing that there has been, or will be, a
significant change in the scope, complexity or character of the services to be performed; and
WHEREAS, City agrees that the requested revisions are not within the scope
of services covered in Agreement; and
WHEREAS, the proposed additional services to be performed by Engineer
are described in a letters from Engineer dated June 27,2001, July 23, 2001, and July 24,
2001, identified as Exhibits "B", "C", and "D", respectively, attached hereto and made a
part hereof.
NOW, THEREFORE, it is mutually agreed, as follows:
1. SCOPE OF SERVICES
Engineer shall perform those additional services identified in Exhibits "B",
"C", and "D".
2.
COMPENSATION
Upon satisfactory completion of the additional services contained herein City
shall be pay to Architect an additional fixed fee of $45,000.00.

Weare pleased to submit this Proposal for Civil Engineering Services for additional work for Pepper-Linden
Drive. Per your request in our project meeting on June 26, 2001, we understand that the City wishes to
revise the design plans to include the new roadway section that provide provisions for future median island
along Pepper-Linden Drive and modify the vertical alignment to better serve the existing property along the
south east corner of Pepper-Linden Dr. and Kendall Dr. This vertical alignment will also eliminate the need
for any additional fill material within the project limits. The following task represents our scope of work for

We will meet with the City staff to coordinate the proposed changes and provide progress of the work

Preliminary Design
Under this task, we will revise the vertical alignment of the roadway, calculate the quantities for the cut and
fill material, produce cross section at 50 ft intervals and highlight the limits of the cut and/or the fill within the
project limits. Meet with the City staff to review and approve the proposed alignment and the typical cross
sections.

Based on the City's approval of the HorizontalNertical alignment, we will produce 95% design plans, cost
estimate and specifications and submit to the City for review and comments.

Oeliverables: Sheet 2 through 8 will be revised and resubmitted for review

Final Plans, Specifications and Estimates (PS&E)
Based on the City's comment from the 95% submittal, we will revise the project plans, cost estimates and
specifications to produce a final deign (PS&E) package for construction.
Oeliverables: One set of Mylar sheet 1 through 8, Final Cost Estimate & Specifications and one
electronic set on CO using AutoCAO 14 or 2000.
Exclusions: The following items are not included in this proposal:

We estimate that this work will take approximately four weeks from notice to proceed. The following fee

$15,000.00, which includes direct labor, fringe benefits and indirect cost. Any changes or additions to this
scope of work may constitute additional charges beyond the amount shown herein.
