Staff Report
Subiect:
Resolution authorizing the Mayor of the City of San Bernardino or her designee to execute an
agreement with New Hope Missionary Baptist Church relating to training related work
experience for students.
Backl!round:
The proposed agreement covered in this Resolution provides training related work experience
sites for New Hope students at City Recreation facilities. The agreement gives full authority to
the City of San Bernardino to supervise New Hope students at selected City job sites of the
Recreation Department.
The Work Experience Program is unique because it offers free labor of potential employees in
exchange for on-the-job training during the summer months. An average of 26 students
participate in the summer work experience program.
The Parks, Recreation and Community Services Department has had a partnership with New
Hope since 1995 in providing work experience sites at senior nutrition kitchens, park sites,
recreation centers, and to support clerical staff located at its facilities.
Financial ImDact:
This program will have no impact upon the city's general fund. There shall be no reimbursement
or compensation on the part of the City of San Bernardino, either in wages or benefits of any
kind. Workers Compensation payments shall be the responsibility of the New Hope Missionary
Baptist Church. The City shall not assume any administrative cost of program sponsorship
except those incurred in providing for planning, monitoring or supervision.
Recommendation:

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of City of San Bernardino or her designee is hereby authorized
and directed to execute on behalf of said City, an agreement with New Hope Missionary Baptist
Church relating to training related work experience for students, a copy of which is hereto,
marked Exhibit<"A" and incorporated herein by reference as fully as though set forth at length.
SECTION 2. The authorization granted hereunder shall expire and be void and of no
further effect if the agreement is not executed by both parties and returned to the Office of the

COOPERATIVE WORKSITE AGREEMENT BETWEEN
NEW HOPE MISSIONARY CHURCH
AND
CITY OF SAN BERNARDINO PARKS, RECREATION & COMMUNITY
SERVICES
I.PARTIES INVOLVED
This Agreement is between the City of San Bernardino Parks, Recreation and
Community Services Department and New Hope Missionary Baptist Church.
It is agreed and understood by both parties that the City of San Bernardino Parks,
Recreation and Community Services Department will provide work sites for the
participants of the New Hope Missionary Baptist Church Summer Youth Program.
The number of participants and work period will be determined by agreement of the
Parks, Recreation and Community Services Department and the New Hope Missionary
Baptist Church.
C II.FURTHER AGREED
That the Parks, Recreation and Community Services Department will provide useful,
work site training experiences consistent with the participants' capabilities.
The Parks, Recreation and Community Services Department will provide supervision
and direction to the participating youth.
There shall be no reimbursement or compensation on the part of the Parks,
Recreation and Community Services Department, either in wages or benefits of any
kind. Workers Compensation payments shall be the responsibility of the New Hope
Missionary Baptist Church. The City shall not assume any administrative cost of
program sponsorship except those Incurred by itself in providing for planning,
monitoring or supervision.
III. PROGRAM COMPONENTS
Accurate time and attendance records will be kept In conjunction with the
supervising staff provided by the New Hope Missionary Baptist Church. The work
areas for each participant will be selected by the Parks, Recreation and Community
Services Department upon the contingent agreement of the New Hope Missionary
Baptist Church. Hours worked by participants will not exceed 20 hours per week.

Should a New Hope Missionary Baptist Church student participant display
Inappropriate behavior or fall to perform In a satisfactory manner, the site supervisor
or manager may excuse the participants from the program.

New Hope Missionary Baptist Church agrees to be responsible for the financial
reimbursement of the participants on a bi-monthly basis including processing of time
sheets and paychecks.
New Hope Missionary Baptist Church agrees to respond as needed to emergencies or
site meetings as requested by the Parks, Recreation and Community Services
Department.
IV.HOLD HARMLESS
New Hope Missionary Baptist Church shall defend, indemnify and hold City, its
officers, agents and employees harmless from and against any and all liability, loss,
expense (including reasonable attorney fees) or claims for injury or damages arising
out of the performance of this agreement but only in proportion to and to the extent
such liability, loss, expense, attorney's fees or claims for injury or damages were
caused by or resulted from the negligence or intentional acts or omissions of New
Hope Missionary Baptist Church, its officials, agents or employees. The costs, salary
and expenses of the City Attorney and members of his office in enforcing the
agreement on behalf of the City shall be considered as "attorney's feesn for the
purposes of this paragraph.
City shall defend, indemnify and hold New Hope Missionary Baptist Church and Its
officers, agents and employees harmless from and against any and all liability, loss
expense (including reasonable attorney fees) or claims for Injury or damages arising
out of the performance of this agreement but only In proportion to and to the extent
such liability, loss, expense, attorney's fees or claims for Injury or damages caused by
or resulted from the negligence or intentional acts or omissions of City, Its officers,
agents or employees.
V.TERMINATION CONDITIONS
Whenever it shall be necessary for either party to give notice to the other, such
notices shall be sent to the Director of Parks, Recreation and Community Services
Department at the following address: 547 North Sierra Way, San Bernardino, Ca.
92410, and such notices shall be deemed to be completed five (5) days after.
This agreement may be terminated at any time by giving either party fifteen (15)
days written notice of such action in accordance with the agreement.

At the Mayor and Common Council meeting of July 9, 2001, the City of San Bernardino adopted
Resolution 2001-212 - Resolution authorizing the Mayor or her designee to execute an
agreement with New Hope Missionary Baptist Church relating to training related work
experience for students.
Attached is one (I) original agreement. Please obtain signatures in the appropriate location and
retum the original agreement to the City Clerk's Office as soon as possible, to my attention.
Please be advised that the resolution and agreement will be null and void if not executed
within 60 days, or by September 7, 2001.
