Staff Report
Subject:
Resolution of the Mayor and Common Council of San Bernardino authorizing an agreement
with the City of Inglewood relating to the processing of parking citations, and terminating the
previous agreement under resolution 1999-249.
Background:
Previously, the Facilities Management Department processed parking citations in house at an
approximate direct cost of$12,000. This included printing of notices and citation tracking. The
software used at that time was 10 years old and was not year 2000 compliant. It also lacked
report writing and tracking features which were completed manually. The Department used 9
inch magnetic tapes to communicate delinquent information to the Department of Motor
Vehicles (DMV). The DMV eliminated the use of magnetic tapes in favor of IBM cartridges,
which the City of San Bernardino did not use. The cost to purchase new hardware and software
to perform this function would have been cost prohibitive.
A number of options were considered to replace the current system including: purchasing new
software and hardware, contracting out the citation processingladjudication system, and a
combination of purchasing software and leasing equipment. All of the cities contacted by staff,
highly recommended the City ofInglewood. Ofthe other processing options reviewed,
Inglewood offered the desired features and connectivity without a significant increase in price.
After reviewing several options and vendors, staff recommended contracting with the City of
Inglewood's Parking Ticket System (PTS) for citation processing.
July 1999, the San Bernardino Mayor and Common Council authorized execution of an
agreement with the City of Inglewood to provide citation processing software and printers.
Effective February 2000 the City of San Bernardino went "on-line" with PTS. San Bernardino
processes an average of25,000 parking citations per year using PTS at an approximate annual
cost of $56,000. This includes citations written by Parking Control, Code Compliance, and the
Police Department.
Currently, seventy-seven cities contract with Inglewood for citation processing. The automated
system generates notices, letters, DMV liens and reports. It also has the ability to establish
deadlines, track adjudications, process payment plans, make adjustments, post payments, and
download electronic citations. This system also provides online access to DMV files to facilitate
collections efforts and access to information on out-of-state vehicles. Since January 2001,
Inglewood's tax offset collection program has produced an increased in net revenue of
$74,132.46 (citations issued from 1997 through 2000). Overall, citation revenue has increased
from $434,900 FY 1999100 to $591,750 in FY 2000101.

This is the first time Inglewood has proposed an increase in fees. The proposed additions to the
Agreement between the City of San Bernardino and the City of Inglewood include:
Fee Increases
· Annual fee adjustments based on the Los Angeles/Long Beach Consumer Price Index
(CPI) beginning July 1,2001
. Manual Entry increased $.1 0 per citation
. Payment Processing increased $.07 per citation
· Delinquent Collections increased $.50 per citation following the first twelve months
and billed monthly by invoice.
Security of DMV Data
Presently, we receive registered owner information from Department of Motor Vehicles
at the time of the citation. Whenever DMV data is updated, the City of San Bernardino
cannot access those file changes. This new access is necessary to obtain current
information to facilitate the notification and collection process. Therefore, a DMV MOD
is necessary to obtain on-line access. There is no additional cost associated with this
feature.
Hardware Replacement Fund
The Hardware Replacement Fund will be used to replace or repair on-site equipment
supplied by Inglewood. Contributions to the Fund will be paid from monies collected
from citations on out-of-state vehicles and included on monthly invoices as a separate
line-item from Inglewood.
Financial Impact:
Based on the following individual costs listed below, the estimated annual cost to be billed
monthly by the City ofInglewood is an increase of$16,750 over FY 2000101, making the annual
change $72,400 for FY 2001/02, which has been budgeted.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and
directed to execute on behalf of the City of San Bernardino an agreement with the City of
Inglewood relating to citation processing services, a copy of which is attached hereto as Exhibit
A and incorporated herein by reference,
SECTION 2. The authorization granted hereunder shall expire and be void and of no
further effect if the agreement is not executed by both parties and returned to the Office of the
14 City Clerk within 120 days following effective date of the Resolution.

citations. This final ~otice shall contain the information specified in Section
40207 of the Califomia Vehicle Code. These notices to be either sent to San
Bernardino or mailed by Inglewooc:l to the registered owner, in accord with San
Bernardino's instructions.

Inglewood will provide San Bemardino with two (2) video display terminels, to
access the Inglewood Parking Ticket System, and requisite meintenence for
direct connection into the Ingle wood Computer Center. A dedicated, leased,
high speed digital telephone line to be acquired and paid for by San Bernardino.

Inglewood reserves the right when necessary, with prior notice and c"onsent,
to make the entire system unavailable, for hardware and softwere
maintenance. It is understood that such unavailability will be rare. and that
consent will not be unreasonably withheld.

Inglewood agrees that all San Bernardino citetion data remains the lole
property of Sen Bemerdino.
2.
San Bemerdino Agrees to the Following Obligations:
(A)
To fully cooparate with Inglewood.
(B)
To provide Inglewood with all information deemed necessary for the
performence of its services under this Agreement.

To pool one helf of en money collected from citetions issued to out-of-state

vehicles into a Hardware Replacement Fund for the purpose of replacing or

repairing on-site equipment. The amount of San Bernardino's contribution to

said Fund shall be included in the monthly invoices sent by Inglewood to San
5
Beraardino as a separate line item. All such moneys contributed by San
6
Bernardino and collected by Inglewood shall be used only for the purpose of
7
replacing and repairing San Bernardino's on-site equipment. San Bernardino's
8
contribution to the Hardware Replacement FUnd- shall commence July 1, 2001
9
and shall be applicable thereafter during the term of this Agreement.

To attend Inglewood sponsored Parking Citation conferences.
11 Article 2 . EQUIPMENT
12 Inglewood agrees to provide San Bemardino with the requasted number of hand held
13 units and a minimum of one personal computer, which shall be located at the site of San
14 Bernardino's Choosing. Additionally. Inglewood shall provide San Bemardino with the
IS necessary communications equipment to upload the information from the hand held units to

16 the personal computer; as well as software; support; and supplies. Software, as
17 contemplatad by this Agreement, shall mean the computer programs nec....ry to both issue
18 and process the data collected from the hand held units. Support, as contemplated by this
19 Agreement. shall mean the on-going professional support of the equipment end software by
20 Inglewood. Supplies, as -contemplated by this Agreement, shall mean blank ticket stock.
21 envelopes, and batteries for the hand held units.
22 San Bernardino agrees that it shall select a type of hand held unit from the following
23 list and that San Bernardino shall use the selected hend held units for a period of four (4)
24 continuous years from the data of purchase. The parties hereto agree that San Bemardino
25 may change the type of hand held units. prior to the expiretion of the required four year
26 period. at its sole expense.

In the event of damage to or destNction of any of the equipment provided to San
Bernardino by Inglewood, which is covered by a warranty. San Bernardino shall receive any
and all banefits of any such warranty. In the event of damaga to or destNction of any of the
aquipment provided to San Bemaidino by Inglewood which is either not covered by a
warranty or which is excluded therefrom for any reasons, San Bernardino shall be responsible
for the cost of repair or replacement, at Inglewood's discretion.
Article 3 - COMPENSAnON
A. CITATION SERVicES

San Bernardino agrees to pay Inglew~ for its citation handling services, the sum of
12 $1.25 per citation processed by the system. The citation handling fees, including but not
13 limited to those set forth in Exhibit "A" hereto. MOther Fees., attached hereto and
14 incorporated herein by this reference as if set forth in full, shall be edjusted annually on July
15 1, the rate being adjusted upward by the percentage of annual change in the Los
16 AngeleslLong Beach Consumer Price Index (CPI), as identified each June 1. The adjustment
17 to the citation handling fees besed upon the Los AngeleslLong Beach Consumer Price Index
18 (CPI,) es identified each June 1, shall commence July 1.2001 and shall be applicabla for
19 each year thereafter during the tenn of this Agreement.

21 San Bernardino agrees to pay Inglewood, in addition to the fees set forth in the
22 immediately preceding paragraph, the prevailing U.S. first class postage rate, plus a five
23 cents (.05CI mailing service charge for each lIIeg.1 Parking notice postc.id and a nine cents
24 (.09C) service charge for each letter San Bemaidino chooses to have mailed by Inglewood.

Invnir.ing
Invoices for services rendered pursuant to this Agreement will be prepared by
Inglewood and submitted to San Bemaidino on a monthly besis. Invoices shall be paid within
thirty (30) days after receipt. Should San Bemardino require the assistance of Inglewood in
the data entry of citations, the processing of cash payments, or the handling of
32 administrative questions, these services will be provided at Inglewood'is current rates for

B. DELINQUENT CITATION COLLECTION SERVICES
Inglewood will allow San Bernardino to panlclpete In Ingl.wood's Delinquent Citation
processing program, Said program includes the mailing of individually prepared collection
letters and, if requested by San Bemardino, the placing of offsets egainst the violators'
California Tax Refunds andlor Califomia Lottery winnings. In addition, other similar collection
efforts may be included under the progrem as authorized by Sen Bernerdino end egreed to
8 by Inglewood,
The fee for seid service;;, if authorized by San Bernardino, shall be 15 % of the gross
revenues receival from citations processed using any of the above described collection
mechanisms, In addition, for delinquent citation collections made in the first twelve 1121
calendar months of this Agreement following" its execution by all the parties hereto. the direct
expenses associated with this process, not to exceed $2.00 (two dollars) per citation, will
be deducted from the gross revenues actually received by San Bernardino through its
participation in the Delinquent. Citation Collection program. The panies hereto agree that,
following the first twelve (121 months of this Agreement, the direct expenses essociated with
this process, not to exceed $2.50 (two dollars and fifty centsl per citetion. will be peid by
San Bernardino to Inglewood upon receipt of Inglewood'sinvoices.
C. CONVERSION
The fees for the conversion of San Bernardino's existing system to the Inglewood
Citation Processing System, if applicable, will be es follows: .35Q/citation for all citations thet
do not require either delinquent notices or the placing or removal of DMV registration holds
and .75 Q (plus postage end mailing expenses es specified in Article 2, Compensation:ieclion
A, Citation SeNiees. subsection (2) Postage fees) for all other citations. Optionally, rather
than paying for 8 conversion on a per citation basis, San Bemardino may compensate
Inglewood for conversion in the amount of 15% of gross revenues received, after the date
San Bernardino approves this agreement, from all citetions issued prior to the date San

Article 4 - CONFIDENTIALITY OF DOCUMENTS

All of Sen Bernerdino's citation data is and shall remain the property of San
31 Bernardino. All the deta prepared, essembled, or maintained by Inglewood pursuant to this

Article 5 . SECURITY OF DMV DATA
4 Inglawood and San Bernardino agree that aither prior, to or as soon as is practical
5 following the exepution of this Agreement, both parties shall execute a Memorandum of
6 Understanding with the California Departmant of Motor Vehicles. Inglewood and San
7 Bernardino agree that all the terms and conditions contained in the Memorandum of
8 Undarstanding which they execute with California Depertment of Motor Vehicles shall be
9 binding on tha parties hereto.
10 Article 6. - DISCRIMINATION
II Inglewood agrees that during the performanca of this Agreement, it will not
12 discriminate against any employee or applicant, for employment because of race, creed,
13 color, sex, age or national origin.

Article 7 - DURATION
This Agreement to remein in effect, until canceled by either party, with a 90 day
written notification. At .such time, Inglewood agrees to provide San Bernardino, in computer
readable form, a copy of all data files necessary to service its citations.
Article 8 -INDEMNIRCATlON
A. Neither San Bernardino nor any officer or employee of San Bernardino shall ba
responsible for any damage or liability occurring by reason of anything done or omitted to be
dona by Inglawood under or in connection with any work, authority or jurisdiction delegated
to Inglewood under this Agraement. It is also undarstood and agreed thet, pursuant to
California Government Coda Section 894.5, Inglewood sholl fully indamnify. defend end hold
harmless San Bernardino from any liebility .imposed for injury, as dafined by California
Government Code Section 810.8, occurring by reason of anything done or omitted to be done
by Inglewood under or in connection with any work, authority or jurisdiction delegeted to

B. Neither Inglewood nor eny officer or employee of Inglewood shell be
responsible for any damage or liability occurring by reason of anything done or omitted to be
done by San Bernardino under or in connection with any work. authority or jurisdiction
delegated to San Bernardino under this Agreement. It is also understood and agreed that,
pursuant to California Government Code Section 894.5, Sen Bernardino shall fully indemnify,

ArtICle 10 . ENTIRE AGREEMENT
9 This Agreement and the documents attached hereto and referred to herein contain all
10 the terms 'and conditions applicable to the parties and Suparsecle all oral
11 negotiations and prior writings with respect to the subject matter hereof. In the event of any
12 conflict between the terms, conditions and provisions of this Agreement and any such
13 document or instrument, the terms and conditions of this Agreement shall prevail.

At the Mayor and Common Council meeting of June 18, 2001, the City of San Bernardino
adopted Resolution 2001-192 - Resolution authorizing the execution of an agreement with the
City of Inglewood relating to the processing of parking citations, and terminating the previous
agreement under Resolution 1999-249.
One original agreement was mailed to you on June 25, 2001; with a second original being mailed
on September 6, 2001. As of the above date, the City Clerk's Office has not received the
executed documents. Please return the executed agreements to the City Clerk's Office, Attn:
Michelle Taylor, P.O. Box 1318, San Bernardino, CA 92402, as soon as possible.
Please be advised that the resolution and agreement will be null and void if not executed by
October 16, 2001.
