Subiect:
Resolution supporting the State of California, Department of Transportation and San
Bernardino Association of Governments Plan to expend State Funds for Right of Way
Acquisition for the 1-215 Freeway,
Backl!round:
The California Department of Transportation (Caltrans) and the San Bernardino Association of
Governments (SANBAG) are in the process of designing improvements to the 1-215 Freeway
between 1-10 and SR 210(30) Freeways. These improvements will widen the freeway and will
include high occupancy vehicle (HOV) lanes. Caltrans will acquire the right-of-way for the
project concurrently with the design, and construction will begin shortly thereafter.
Approximately 150 parcels in the Freeway main corridor will have to be fully or partially
acquired. The parcels to be acquired have been identified based on the braid-split design
alternative, which has been reviewed and accepted by the Mayor and Council on January 22,
2001.
Section 100,21 (b) of the Streets and Highways Code allows the purchase of parcels contained
within the main line corridor of the proposed freeway, provided that the alignment of the
freeway is not at issue, upon adoption of a resolution by the City Council of the affected
municipality. Therefore, adoption of this Resolution will enable Caltrans to proceed with the
necessary acquisition of parcels. The Resolution further encourages Caltrans to expend funds
for the accelerated acquisition of parcels in connection with improvements to the 1-215
Freeway.

RESOLUTION OF THE CITY OF SAN BERNARDINO SUPPORTING
THE STATE OF CALIFORNIA, DEPARTMENT OF TRANSPORTATION, AND
SAN BERNARDINO ASSOCIATION OF GOVERNMENTS STRATEGIC PLAN
TO EXPEND STATE FUNDS FOR FULL RIGHT-OF-WAY ACQUISITION FOR
CONSTRUCTION OF IMPROVEMENTS TO THE 1-215 FREEWAY BETWEEN
1-10 FREEWAY AND SR 210(30) FREEWAYS, AND TO ACCELERATE
ACQUlSITON OF CERTAIN PARCELS LOCATED WITmN CITY
BOUNDARIES.
WHEREAS, the 1-215 Freeway was initially adopted in 1949; and
WHEREAS, a Record of Decision relative to the Environmental Impact Statement
was entered in January 2, 2001, and a Notice of Determination by the California
Transportation Commission filed January 31, 2000 in compliance with Section 21108 of
Public Resources Code to allow improvements of the Interstate-215 Freeway; and
WHEREAS, the right-of-way acquisition for this construction and improvement
requires the full or partial acquisition of approximately 150 parcels; and
WHEREAS, Section lOO.21(b) of the Streets and Highways Code allows the
purchase of parcels contained within the main line corridor of the proposed freeway,
provided that the alignment of the freeway is not at issue, upon adoption of a resolution by
the City Council of the affected municipality.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the State of California, Department of Transportation be
encouraged to expend funds for the accelerated acquisition of parcels in connection
with improvements of the Interstate 215 Freeway; and
SECTION 2. That the State of California, Department of Transportation be
authorized to acquire parcels as provided in Section 100.21 (b) of the Streets and
Highways Code.
