Recommended motion:
1. That the Mayor and Common Council authorize the Director of Finance to amend
the FY 2000/01 budget to transfer $37,700 from Account No. 243-363-5504-3405
(Unappropriated Park Construction Fund) to Account No. 243-363-5504-7107
(Seccombe Lake Activity Center); and
2. Adopt Resolution

STAFF REPORT
Subiect:
Authorize the Director of Finance to amend the FY 2000/01 budget and adopt
Resolution awarding contract to Anthony Marmolejo Construction Company, Inc. for
modifications to the Seccombe Lake Activity Center to meet ADA Standards.
Background:
The Parks and Recreation Department requested that the Public Works Division
administer the design and construction of the above. This project consists of removal
and reinstallation of partition walls, toilets, and sinks in the men and women's
restrooms, and modifies the path of travel from the parking lot to the Parks and
Recreation Department's main office annex building at 555 North Sierra Way. These
modifications are necessary in order to meet Americans with Disabilities Act
requirements.
The initial cost estimate was for construction costs only, without the including the cost
for design engineering, contract administration, inspection and contingencies.
Plans and specifications for this project are complete and it is ready to be awarded.
The estimated project costs are as follows:
Construction Estimate $70,528,00
Continaencies $10,580,00
Desian (Gary Miller and Associates) $10,000.00
InsDection and Contract Administration $10,892,00
Total $102,000.00
This project was advertised locally in the San Bernardino County Sun Newspaper,
Construction Trend Newspaper, the City's web site, and with the San Bernardino Area
Chamber of Commerce; the following companies responded:

Financial Impact:
Funding for this project in the amount of $64,300 was budgeted in Account No. 243-
363-5504-7107 (Seccombe Lake Activity Center). The remaining balance of $37,700
will be transferred from Account No. 243-363-5504-3405 (Unappropriated Park
Construction Fund).
Recommendation:
Adopt Resolution and authorize the Director of Finance to amend the FY 2000/01
budget and transfer $37,700 from Account No. 243-363-5504-3405 to Account No, 243-
363-5504-7107.

This memorandum is in response to the questions posed at this morning's Council Meeting Session
regarding the referenced agenda item, Specifically, a question what asked regarding the estimated
total project cost detailed in the staff report verses the original estimated cost of $64,300.00
provided in the Capital Improvement Program (CIP)
Although the project estimate at the point of contracting is sometimes different from the initial CIP
estimate based on the greater detail of information provided by the design process itself, in this
particular project that process resulted in additional work items than were previously anticipated by
the Parks and Recreation Department, some of which, like the "path of travel improvements",
even fall outside the building itself,
Consequently, in order to fully fund the project it is anticipated that $102,000.00 will be required.

RESOLUTION NO.
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AWARDING A CONTRACT TO ANTHONY MARMOLEJO
CONSTRUCTION COMPANY, INC. FOR MODIFICATIONS TO THE SECCOMBE
LAKE ACTIVITY CENTER, LOCATED AT THE PARKS AND RECREATION
DEPARTMENT MAIN OFFICE ANNEX, TO MEET AMERICANS WITH
DISABILITIES ACT (ADA) STANDARDS.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION L Anthony Marmolejo Construction Company, Inc. is the lowest
responsible bidder for modifications to the Seccombe Lake Activity Center located at the
Parks and Recreation Department Main Office Annex to meet Americans with Disabilities
Act (ADA) Standards. A contract is awarded accordingly to said bidder in a total amount of
$70,528.00, with a contingency amount of $10,580,00, but such award shall be effective only
upon being fully executed by both parties, All other bids, therefore, are hereby rejected.
The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a
copy of the contract is on file in the office of the City Clerk and incorporated herein by
reference as fully as though set forth at length,
SECTION 2. This contract and any amendment or modifications thereto shall not
take effect or become operative until fully signed and executed by the parties and no party
shall be obligated hereunder until the time of such full execution. No oral agreements,
amendments, modifications or waivers are intended or authorized and shall not be implied
from any act or course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute
it within sixty (60) days of the passage of the resolution,

At the Mayor and Common Council meeting of May 21, 2001, the City of San Bernardino
adopted Resolution 2001-129 - Resolution awarding a contract to Anthony Marmolejo
Construction Company, Inc., for modifications to the Seccombe Lake Activity Center, located at
the Parks and Recreation Department main office annex, to meet Americans with Disabilities Act
(ADA) standards.
Enclosed are four (4) bound contracts. Please obtain signatures where indicated and return one
original contract to the City Clerk's Office as soon as possible, to my attention.
Please be advised that the resolution and agreement will be null and void if not executed
with 60 days, or by July 20, 2001.
