Staff Report
SUBJECT:
Resolution Establishing Fair Market Value and Giving Notice Inviting Bids - four City owned
parcels north and south of Orange Show Road, west of Waterman Avenue.
BACKGROUND:
On August 7, 2000, Resolution No. 2000-235 was adopted, establishing the right of way
boundaries for Orange Show Road, between Waterman Avenue and the Twin Creek Flood
Control Channel. This portion of Orange Show Road is part of the Orange Show Road extension
from Arrowhead Avenue to Tippecanoe A venue. As a result of the fee acquisition of various
parcels between Waterman Avenue and the Twin Creek Flood Control Channel (the remainder
of Orange Show Road extension was acquired as easements), four remnant parcels remain.
On August 7, 2000, staffwas authorized to proceed with the sale of 3 parcels. All City
departments were notified of the proposed sale and no conflicts were noted. The fourth parcel is
under the control of the Water Department, and they have requested, through formal action of the
Board of Water Commissioners on October 3, 2000, that this parcel also be included with this
sale and that the net proceeds from the sale of this parcel be transferred to them.
Staff was authorized to secure an appraisal on these parcels and after receiving proposals from 9
appraisers, James Smothers was selected. The valuation of the four parcels, as determined by the
appraiser, is as follows:

The City Charter requires that any real property sales of $25,000 or higher be sold through the
public bid process. Although Parcel Four could be sold without going to bid, staff is
recommending that this parcel be included to obtain the best price, since the bid process will still
need to be carried out for the other three parcels.
The attached Resolution establishing the fair market values for these four parcels as set forth
above, and declares these parcels as surplus property and authorizes the advertising of a Notice
Inviting Bids. The various parcels will also have "For Sale" signs posted on each one.
As stated in the Resolution and Bid Specifications, bids may be submitted on anyone or any
combination of parcels and each parcel may be given separate consideration from the same
bidder. The bids will be opened and declared at 2:00 p.m. on March 20, 2001. The results of the
bids will be submitted at the Council Meeting of April 16, 2001 for your review and action. Oral
bids may also be considered at that time.
FINANCIAL IMPACT:
All expenditures relative to this sale (staff time, escrow, title and closing costs, etc.) will be paid
for from the sale proceeds. The minimum gross proceeds to the City will be $248,000 for the
three City owned parcels. The Net proceeds of the fourth parcel is proposed to be transferred to
the Water Department.
RECOMMENDATION:
Staff recommends that the attached resolution establishing fair market value and giving notice
inviting bids relative to four City owned parcels be approved.

SALE OF SAID PROPERTY.
WHEREAS, the City of San Bernardino, a municipal corporation, is the owner of the
hereinafter described parcels of real property, generally located north and south of Orange Show
Road, and west of Waterman Avenue in the City of San Bernardino, State of California; and
WHEREAS, the Mayor and Common Council of said City find and determine that there
is no further need or necessity for the City's ownership of said real property and is hereby

declared surplus property;

WHEREAS, the Mayor and Common Council of said City believe it is in the best interest
15 of the City that said parcels of real property be disposed of at the highest price obtainable in the

open market; and
WHEREAS, an appraisal was prepared by James Smothers, a licensed appraiser,
indicating a fair market value of Forty-one Thousand Dollars ($41,000) for Parcel One; Thirty-

o Thousand Dollars ($32,000) for Parcel Two; One Hundred Seventy-five Thousand Dollars
21 ($175,000) for Parcel Three; and Seventeen Thousand Dollars ($17,000) for Parcel Four.

WHEREAS, Parcel Four was dedicated for use by the San Bernardino Municipal Water
epartment;
WHEREAS, on October 3, 2000, the Board of Water Commissioners of said Water
epartment approved the sale of said Parcel Four.

SECTION 1. Notice is hereby given inviting competitive sealed and oral bid proposals
for the disposition of the following parcels of real property, more particularly described in and
subject to the terms of Bid Specification No. 15.05-223, a copy of which is attached hereto as
Exhibit "A" and made a part hereof, and also on file in the Development Services Department,
Real Property Section, City Hall, 300 North "D" Street, San Bernardino, California, generally

SECTION 3. Sealed bid proposals must be accompanied by a cashier's check in an
7 amount equal to 10% of bid amount.
8 SECTION 4. Sealed bids must be delivered to the office of the Director of Development
9 Services, Real Property Section, Third Floor, City Hall, 300 North "D" Street, San Bemardino,

California, prior to 2:00 P.M., March 20, 200 I, at which time said sealed bids will be opened and
11
publicly declared. The results of said bidding shall be submitted to the Mayor and Common
12
13 Council on April 16, 2001, at the hour of 10:00 A.M. or as soon as possible thereafter. At that
14 time, oral bids may be received in at least $100 increments for the outright purchase of said
15 parcels of real property, provided that the initial oral bid shall be an amount not less than the

highest sealed bid plus 10%. The successful bidder shall make a non-refundable deposit with the
City Clerk in the form of a cashier's check, prior to the end of the meeting or within 2 hours of
19 awarding the bid, whichever shall occur later, in an amount equal to 10% of the bid amount. Bids

VARIOUS PARCELS LOCATED NORTH AND SOUTH OF
ORANGE SHOW ROAD. WEST OF WATERMAN AVENUE
REQUIREMENTS OF BIDDING AND SALE
NOTICE IS HEREBY GIVEN inviting sealed bids for the sale of City owned property, as
authorized by action of the Mayor and Common Council of the City of San Bernardino.
1. LOCATION AND DESCRIPTION OF PARCELS TO BE SOLD:
(A) Parcel Locations: The subject parcels consists of four (4) non-contiguous parcels of
VACANT land. A vicinity map of the general area is attached as Exhibit 1. A plat map
showing the location of the four parcels is attached as Exhibit 2. The parcels are
described as follows:
1) Parcel One: totaling approximately 16,225 square feet, is located on the North side
of Orange Show Road, east of Amos Avenue, referred to as a portion of Assessor's
Parcel 0136-431-13. A plat map showing parcel details is attached as Exhibit 3A
along with a full legal description, attached as Exhibit 3B.
2) Parcel Two:. totaling approximately 16,131 square feet, is located on the South side
of Orange Show Road, east of Amos Avenue, referred to as a portion of Assessor's
Parcel 0136-431-13. A plat map showing parcel details is attached as Exhibit 4A
along with a full legal description, attached as Exhibit 4B.
3) Parcel Three: totaling approximately 43,839 square feet, is located on the South
side of Orange Show Road, west of Waterman Avenue, referred to as Assessor's
Parcel 0136-431-23. A plat showing parcel details is attached as Exhibit SA along
EXHIBIT "A"

4) Parcel Four: totaling approximately 16,557 square feet, is located on the North side
of Orange Show Road, west of Washington Avenue, referred to as a portion of

Exhibit 6A along with a full legal description, attached as Exhibit 6B.
(B) Zoning and Use: The subject parcels are currently zoned as follows:
1) Parcel One - IL (Light Industrial)
2) Parcel Two - IL (Light Industrial)
3) Parcel Three - The easterly portion is OIP (Office Industrial Park) and the westerly
portion is IL (Light Industrial)
4) Parcel Four - IL (Light Industrial)
Other uses, such as Commercial, could be implemented through a General Plan
Amendment, but such approval is neither guaranteed nor implied.
(C) Condition ofProoertv: The subject property is being sold "AS-IS".
2. MINIMUM BID:
The minimum acceptable bid (net of any broker fees), determined to be the fair market value
for each of the parcels is as follows:
1) Parcel One
$41,000.00
2) Parcel Two:
$32,000.00
3) Parcel Three:
$175,000.00
4) Parcel Four:

The subject parcels may be inspected by any potential bidders at will.
4. SEALED BIDS:
Sealed bids for each parcel of real property shall be submitted on the Official Bid Form(s)
attached as Exhibits 7-A, B, C and D. A separate bid form shall be submitted for each parcel ofland
for which a bid is being submitted but more than one bid form may be included in one sealed
envelope. NOTE: Bidders may bid on anyone or more of the parcels being offered for sale.
Said sealed bid shall be received in the Real Property Section, Development Services Department,
Third Floor, City Hall, 300 North "D" Street, San Bernardino, California, until the hour of2:00
p.m., March 20, 2001, at which time all bids received will be publicly opened and declared. All

bids must be accompanied by a cashier's check in an amount of at least TEN PERCENT (10%) of
the total amount bid. The results of said bidding shall be submitted to the Mayor and Common
Council at a regularly scheduled meeting on April 16, 2001, at the hour of 10:00 a.m. or as soon as
possible thereafter.
5. ORAL BIDS:
Oral bids may be made at the Council Meeting stated above. Oral bids may be received in
$100 increments for the outright purchase of the property, provided that the initial oral bid shall be
an amount not less than the highest sealed bid plus TEN PERCENT (10%). In the event of a
successful oral bid, a cashier's check in an amount of at least TEN PERCENT (10%) of the bid
amount shall be deposited with the City Clerk prior to the end of said meeting.
6. UNSUCCESSFUL BIDS:

7. REJECTION OF BIDS:
The Mayor and Common Council shall have the right to reject any and all bids.
8. SUCCESSFUL BIDDER:
Bids submitted for each parcel shall be considered seoaratelv. The City may consider
terms for any portion of the bid amount and will give consideration to all factors, including amount
and length ofterms and interest rate to be paid, in determining the successful bidder. The amount
to be carried by the City shall be secured by a Note and Deed ofTrust or other instrument acceptable
to the City. In the event of two or more equal bids, the City reserves the right to select the bid based
on the most favorable terms. The successful bidder will be determined by the Mayor and Common
Council after all facts are considered.
The successful bidder(s) will be required to execute a mutually acceptable Purchase
Agreement and to enter into escrow within TInRTY (30) days after the adoption of a Resolution
authorizing the execution of said Purchase Agreement with the successful bidder(s), or as may
otherwise be mutually agreed upon by the City and the successful bidder(s). The escrow
instructions for each successful bidder, or bidders, shall include, but not be limited to :
A. The recording of the Grant Deed from the City, and the closing of escrow within SIXTY
(60) days of entering into escrow, or as otherwise mutually agreed upon by the City and
the successful bidder, hereinafter referred to as "buyer"
B. The buyer shall deposit the entire amount bid for the property, plus the amounts
necessary as outlined in Paragraph C and D below, less the bid deposit amount, within
said escrow period.
C. Escrow, title policy and all other fees and closing costs shall be divided between the City

D. Broker's Commission, if any, shall be paid in its entirety by the buyer, over and above
the bid amount.
E. In the event of any failure by the buyer to execute and complete escrow instructions, and
any compliance thereto, including the deposit of the balance of the purchase price and
related escrow fees, within the allotted time, the deposit made by the buyer shall be
retained by the City as liquidated damages, and not as a penalty in the event of any
failure on the part of the buyer.
