STAFF REPORT
On April 24, 1992, Resolution No. 91-145 was adopted authorizing the execution of
a Cooperative Agreement with the County of San Bernardino, relative to right of
way acquisition and the widening of 40th Street from 3rd Avenue to Acre Lane. The
City's share of right of way acquisition was estimated at $132,000.
The City sent out Requests for Proposals for appraisal services and the
of Donald A. Cox were retained. The total market value of the portion of
parcels needed for right of way was valued at $46,226. The appraisal
$4,000 and the estimated escrow, title and closing costs is estimated
for all four parcels, bringing the total acquisition and related
$54,226.

The attached Resolution accepts the appraiser's report and determines the market
value of said parcels at $46,226.
After adoption of the Resolution, this office will contact the respective
property owners to negotiate the acquisitions.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO ACCEPTING THE APPRAISER'S
DETERMINATION OF FAIR MARKET VALUE OF THE LAND LOCATED ON THE NORTH SIDE OF
3 40TH STREET, WEST OF ACRE LANE, IN THE CITY OF SAN BERNARDINO, CALIFORNIA,
CERTIFYING THE WORK OF THE APPRAISER AND AUTHORIZING PAYMENT IN THE AMOUNT
4 OF FORTY-SIX THOUSAND TWO HUNDRED TWENTY SIX DOLLARS ($46,226) FOR THE
PURCHASE OF SAID LAND.

WHEREAS, the City of San Bernardino is contemplating the purchase of
portions of four parcels of land located on the north side of 40th Street,
West of Acre Lane, in the City of San Bernardino for street widening
purposes; and
WHEREAS, Margaret Mowatt Petersen is the owner of Parcel One as
described below; Rodney York Baker is the owner of Parcel Two as
described below; Claudia Rivera is the owner of Parcel Three described
below, and Jim Parrish and Peggy Parrish are the owners of Parcel Four
described below; and
WHEREAS, the City desires to now purchase portions of said lots and
parcels of real property; and
WHEREAS, City has reviewed the Appraiser's determination of fair
market value of the land and his report thereon; and
WHEREAS, the City intends to purchase portions of said lots and
parcels of real property with City funds.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That said lots or parcels of real property, or portions
23 thereof are described in full in the attached Exhibit "A", attached hereto
24 and incorporated by reference as though fully set forth in length.
25 SECTION 2. It is hereby determined, based upon the appraiser's report
26 submitted herewith, to have a fair market value of $21,335 for Parcel One;
27 $9,057 for Parcel Two; $3,570 for Parcel Three and $12,264 for Parcel Four

work of the Appraiser with respect to lots and parcels of real property has
been performed in a competent manner in accordance with the applicable State
Laws and the policy requirements of the City of San Bernardino.
SECTION 4. The City of San Bernardino is hereby authorized to make
payment for the herein described properties in the amounts as set forth in
Section 2 above.
SECTION 5. The the Real Property Section of the Department of Public
Works is directed to commence formal negotiations with said property owners
and to enter into escrow for the purchase of said parcels of real property.

That portion of the South one-fifth of Lot 10, Arrowhead Suburban
Farms Tract "A" , as per plat thereof recorded in Book 21 of Maps,
pages 6, records of the County Recorder of San Bernardino County,
State of California, described as follows:
Beginning at the intersection of the North line of 40th Street and
the East line of the West 196.3 feet of said Lot 10; thence North,
along said East line, a distance of 24 feet; thence East, along a
line that is parallel with said North line of 40th Street, to a
point that is 37.86 feet West of the West line of Acre Lane;
thence Northeast, along a straight line, to a point on the West
