Wal-llart Benefit Resolutions
Development Agreement No. 91-02, between the City and the developer of
the Wal-Mart Center on the north side of Highland Avenue at Boulder
Avenue, provides that the City will design and construct certain
improvements on Highland Avenue adjacent to the site. The improvements
consist primarily of street improvements, street lights, a storm drain
and landscaping on Highland Avenue, as well as a traffic signal at the
intersection of Highland and Boulder Avenues. These funds, totalling
$800,000 are to be provided from bond proceeds of the Agency as
indicated by the priority list of projects adopted by the Community
Development Commission at the March 7, 1992 IDA Budget Workshop.
The funds of the Agency have been proposed for this matter because the
improvements will further the redevelopment purposes of the Agency by
encouraging and enhancing development along a major entrance to the
City whiCh provides access to and from the various redevelopment
project areas of the Agency. The improvements will increase the
desireability of industrial, commercial and residential development in
Agency redevelopment project areas due to the realignment of a major
entrance to the City which allows for safe access to a major
development on streets leading into and out of the project areas. Due
to recent actions by the State of California and the impacts of the
downturn in the City's economy, no other reasonable means of financing
is presently available to the Ci ty or the Agency.
The state Health and Safety Code provides that the Agency may fund the
improvements to the extent that it determines that the activity is of
benefit to the project areaa of the Agency. Based upon the foregoing
it is appropriate that the Agency and the City adopt the attaChed
resolutions making findings and determinations aa to the benefit of the
improvements. The resolutions will provide for the consent of the
Council and the Commission to the payment of the costa of the
improvements by the Agency.
Based upon the foregoing, staff recommends adoption of the attached
resolutions.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO MAKING FINDINGS AND DETERMINATIONS AS TO THE
BENEFIT OF UNDERTAKING CERTAIN PUBLIC IMPROVEMENTS TO VARIOUS
REDEVELOPMENT PROJECT AREAS OF THE AGENCY.
WHEREAS, the City of San Bernardino, (the "City"), is a
municipal corporation and a charter city duly created and existing
pursuant to the Constitution of the laws of the State of
California: and
WHEREAS, the Community Development Commission of the City of
San Bernardino (the "Commission") on behalf of the Redevelopment
Agency of the City of San Bern?~'dino (the "Agency"), is a
redevelopment agency, a public body, corporate and politic of the
State of California, organized and existing pursuant to the
Community Redevelopment Law (Part 1 of Division 24) commencing
with "Section 33000 of the Health and Safety.Code of the State of
California (the "Act"): and
WHEREAS, the Agency may, in furtherance of its r~development
purposes, undertake redevelopment projects either within or
without redevelopment project areas of the Agency to the extent
that it determines that such prc:-;!ects are of benefit to the
project areas of the Agency: and
WHEREAS, the Agency may undertake the financing and
construction of various redevelopment activities including public
improvements (the "Public Improvements") including but not limited
to the participation in the installation of certain Highland
Avenue Street improvements, including street lights, installation

Highland Avenue Median and North parkway, and inspection and
contract administration, which work is located outside the
boundaries of the various redevelopment project areas, if the
Agency determines: ( 1 ) that such Public Improvements are of
benefit to the redevelopment project areas of the Agency or the
immediate neighborhoods in which the projects are and (2) that no
other reasonable means of. financing such Public Improvements is
available to the community; and
WHEREAS, it is in the interests of the City and the Agency
that the Agency causes the undertaking of the Public Improvements
in order to encourage and enhance development on a major entrance
to the City, which entrance and attendant streets provide access
to and from the various redevelopment project areas of the Agency;
and
WHEREAS, the undertaking of the Public Improvements will
promote the development of redevelopment project area within the
City which project areas include: Meadowbrook-Central City
Project Area, Central City North Project Area, Central City East
Project Area, Central City South Project Area, Central City West
Proje~t Area, Tri-Cities Project Area, Southeast Industrial Park
Redevelopment Project Area, South Valle Project Area, State
COllege Project Area, Northwest Project Area, the Uptown Project
Area, and Mt. Vernon Corridor Project Area, to the extent that it
will make such project areas more desirable for industrial,
commercial or residential development which in turn will assist in
the elimination of blight within such areas; and
WHEREAS, in order to promote the City's health, safety and
welfare and ensure the orderly development of the Agency's various

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Recitals hereinabove are true and correct
and are incorporated herein by this reference.
SECTION 2. The Council consents to the payment by the
Agency of the costs of the Public Improvements as outlined in the
Reimbursement Agreement Wal-Mart Site Highland Avenue Improvements
dated , 1992, and the Development Agreement Between
the City of San Bernardino and GatlinjDoerken Developments, dated
, in order to implement the redevelopment plans of the
Agency for the reasons set forth in the Recitals hereinabove. The
Council further finds and determines that no other reasonable
means of financing the Public Improvements is presently available
to the City or the Agency and that the City and the Agency require
the use of revenues generated from the various project areas of
the Agency in order to fund the Public Improvements.
SECTION 3. The undertaking of the Public Improvements will
allow the Agency to promote redevelopment within the project areas
of the Agency by realigning a major entrance to the City and
allowing for safe access to a major development through streets
and highways leading into and out of the project areas which in
turn will help stimulate development of such project areas and
